On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective January 1, 2022, the School Tax Exemptions and Refunds (Approved and Eligible Hydroelectric Power Projects) Regulation, B.C. Reg. 144/2005, is amended as set out in the attached Appendix.

Appendix

Section 1 of the School Tax Exemptions and Refunds (Approved and Eligible Hydroelectric Power Projects) Regulation, B.C. Reg. 144/2005, is amended by adding the following definition:

"listed facility" means a facility in Column 3 in the attached Schedule; .

Section 4 (1) and (2) is amended by striking out " Subject to the conditions set out in

section 5 " and substituting " Subject to

section 5 ".

Section 5 is amended

(

a) in subsection (1) by adding " the eligible hydroelectric power project is at a listed facility or " after " in a taxation year unless ",

(

b) by repealing subsection (1) (a) (

i) and substituting the following:

(

i) licensed to display the EcoLogoTM certified by Underwriters Laboratories, and ,

(

c) in subsection (3) by striking out " In addition " and substituting " Subject to subsection (4), and in addition ", and

(

d) by adding the following subsection:

(4) Subsection (3) does not apply in respect of a listed facility.

Section 6 is amended in subsection (1) in the definition of "first exempt taxation year" and in subsection (2) by striking out " as a result of the conditions set out in

section 5 (1) being met " and substituting " as a result of being a listed facility or of meeting the conditions set out in

section 5 (1) (

a) and (b) ".
