B.C. Reg. 141/2009 , deposited March 31, 2009, pursuant to the BUDGET MEASURES IMPLEMENTATION ACT, 2008 [Section 121] and the PARK ACT [Sections 29 and 29.2]. Order in Council 256/2009, approved and ordered March 31, 2009.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that

(

a) sections 80 and 82 of the Budget Measures Implementation Act, 2008 , S.B.C. 2008, c. 10, are brought into force, and

(

b) the Park, Conservancy and Recreation Area Regulation, B.C. Reg. 180/90, is amended as set out in the attached Schedule.

Schedule

1 The Park, Conservancy and Recreation Area Regulation, B.C. Reg. 180/90, is amended

(

a) by striking out " shall " in sections 3 (1), 10 (2), 9 (3) after " under subsection (1) ", 11 (4), 23 (3) after " which debt ", 23 (4), 31 (2), and 35 (3) and substituting " must ",

(

b) in

section 9 (3) by striking out " shall " after " but in no case " and substituting " may ",

(

c) by striking out " shall be " in sections 3 (7), 9 (2) and 23 (3) after " by that removal " and substituting " is ",

(

d) in sections 4, 8 (1), 11 (1), (2) and (3), 15, 17 (2), 19 (4), 21, 23 (2), 24 (1) and (3), 25, 28, 29 (1), 30, 33 (1), 34, 37 (1) and 38 (1) by striking out " No person shall " and substituting " A person must not ",

(

e) in sections 8 (2), 12, 17 (1), 19 (1), (3) and (5), 23 (1), 26, 29 (2), 32 (1) and 37 (2) by striking out " no person shall " and substituting " a person must not ",

(

f) in

section 13 by striking out " No parent, guardian, custodian or person in charge of minor shall " and substituting " A parent, guardian, custodian or person in charge of a minor must not ",

(

g) in

section 20 by striking out " no person who owns or is responsible for an animal shall " and substituting " a person who owns or is responsible for an animal must not ", and

(

h) in

section 39 (2) by striking out " no person who owns a vessel or is responsible for a vessel shall " and substituting " a person who owns a vessel or is responsible for a vessel must not ".

Section 1 is amended

(

a) by striking out the

definitions of " mooring buoy ", " senior ", " shoulder season " and " summer season ",

(

b) by adding the following definition:

"designated long-stay campsite" means a campsite in a park, conservancy or recreation area that has been designated as a campsite where a person May camp for more than 14 days in a calendar year;

(

c) by striking out the definition of " party " and substituting the following:

"party" means up to 8 persons, of whom at least one, but no more than 4, are 16 years old or older, and who May have with them

(

a) one recreational vehicle,

(

b) one non-recreational vehicle, or

(

c) one non-recreational vehicle and one legally towed trailer that is not a trailer primarily designed as temporary living quarters for recreational or travel use; , and

(

d) by striking out the definition of " youth group " and substituting the following:

"youth group" means a group of 12 or more persons

(

a) undertaking a camping trip or day use trip organized for the group by a school, not-for-profit society or recreational centre operated by a municipality or regional district for the benefit of the members of the group who are 18 years of age or younger, and

(

b) supervised by an adult representative of the school, not-for-profit society or recreational centre.

Section 23 (2) (

a) is amended by striking out " party or group " and substituting " party, group or youth group ".

Section 35 is amended by striking out " party or group " wherever it appears and substituting " party, group or youth group ".

Section 36 is repealed and the following substituted:

Registration required

36 The designated representative of a party, group or youth group that camps or uses facilities or services of a park, conservancy or recreation area for which the minister, by regulation or directive, has established a fee, must register with the ministry or an operator, as the case May be, by providing all of the following information:

(

a) the correct name of the designated representative;

(

b) the number of persons in the party, group or youth group;

(

c) the mode of transportation of the party, group or youth group;

(

d) any other information reasonably required to identify the party, group or youth group.

Section 37 (1) (

a) is amended by striking out " party or group " and substituting " party, group or youth group ".

Section 39 is amended by striking out subsection (1) and substituting the following:

(1) A person May not camp in a park, conservancy or recreation area for more than 14 days except

(

a) as authorized by a park officer, or

(

b) in a designated long-stay campsite.

Section 40.1 is repealed and the following substituted:

Second vehicles

40.1

(1) A party May not have more than one recreational vehicle on a campsite.

(2) A party May have a second non-recreational vehicle on a campsite

(

a) if so authorized by a park officer and on payment of the fee established by regulation or directive of the minister, or

(

b) if the campsite is a designated long-stay campsite.

Section 41 is repealed and the following substituted:

Fee collection period

(1) If fees established by the minister by regulation or directive are levied on an overnight basis, the overnight period commences at 12 noon and terminates at 12 noon the following day.

(2) If fees established by the minister by regulation or directive are levied on a day basis, the day period commences and terminates at the times approved by a park officer between 7 a.m. and 11 p.m. on the same day.

Section 42 is repealed and the following substituted:

Payment of fees

42 The designated representative of a party, group or youth group that camps or uses a campsite or other authorized facility or area in a park, conservancy or recreation area must,

(

a) in respect of a campsite or other authorized facility or area managed by the minister, pay to the ministry the fees established by regulation or directive of the minister, or

(

b) in respect of a campsite or other authorized facility or area managed by an operator, pay to the operator the fees established by regulation or directive of the minister.

11 Sections 51 and 52 are repealed.

Schedule C is repealed.
