Section 8 of the

Summary Proceedings Act I, Lena Metlege Diab, Attorney General and Minister of Justice for the Province of Nova Scotia, pursuant to

Section 8 of

Chapter 450 of the Revised Statutes of Nova Scotia, 1989, the

Summary Proceedings Act, hereby (

a) amend the

Summary Offence Tickets Regulations, N.S. Reg. 281/2011, made by order of the Attorney General and Minister of Justice dated October 4, 2011, to designate an offence under the Fish Harvester Organizations Support Act as a

summary offence ticket offence, in the manner set forth in the attached

Schedule “A”; and (

b) order and direct that the penalty to be entered on a summons in respect of an offence set out in amendments to the schedules to the

Summary Offence Tickets Regulations, N.S. Reg. 281/2011, as set forth in the attached

Schedule “A”, is the out-of-court settlement amount listed in the out-of-court settlement column set out opposite the description for the offence, and includes the charge provided for in, and in accordance with, Sections 8 and 9 of the Act. whereas the Nova Scotia Utility and Review Board (“Board”) considered the manner in which it would proceed to set petroleum prices in its decision, 2006 NSUARB 108, issued on October 16, 2006; And

whereas the Board revised the retail margin and transportation allowance effective January 6, 2012, in its decision, 2011 NSUARB 181, issued on November 23, 2011; And

whereas the Board revised the wholesale margin effective January 4, 2013, in its decision 2012 NSUARB 213, issued on December 12, 2012; And

Now therefore the Board prescribes the benchmark prices for petroleum products to be: Gasoline: Grade 1 84.4¢ per litre Grade 2 87.4¢ per litre Grade 3 90.4¢ per litre Ultra-low-sulfur diesel oil 86.1¢ per litre And

now therefore the Board has determined, based on historical data regarding price changes and to achieve revenue neutrality, it is appropriate to apply, and the Board so orders, forward averaging corrections of: Gasoline: plus 0.4¢ per litre Ultra-low-sulfur diesel oil: plus 0.6¢ per litre And

now therefore the Board prescribes the prices for petroleum products as set forth in

Chapter 462 [of the] Revised Statutes [of Nova Scotia,] 1989

Whereas Sections 14 and 20 of

Chapter 26 of the Acts of 1998, the Teachers’ Pension Act, provides that the Minister of Finance (“the Minister”) and the Nova Scotia Teachers’ Union (“the Union”) may make regulations setting out the terms of the Teachers’ Pension Plan (“the Pension Plan”); And

whereas the Teachers’ Pension Plan Regulations (“the Regulations”) were made as of March 31, 1999, as Nova Scotia Regulation 88/99; And

whereas the By-laws of the Union, as amended by Resolution 2000–15, authorize the Executive of the Union to exercise on behalf of the Union the powers of the Union under the Teachers’ Pension Act; And

whereas by resolution of the Executive of the Union dated May 26, 2014, the Executive approved the amendments to the Regulations (Section 5) as set out in

Schedule “A” Amendments to the Teachers’ Pension Plan Regulations (Section 5) made pursuant to Sections 14 and 20 of the Acts of 1998, c. 26, the Teachers’ Pension Act 1 Add new subsection 5(2) as follows: 5(2) Despite subsection 5(1), effective August 1, 2014, every employed member shall contribute to the Fund the sum of (a) 9.3% of the portion of the member’s annual pensionable earnings that are equal to or less than the Y.M.P.E.; and (b) 10.9% of the portion of the member’s annual pensionable earnings that are in excess of the Y.M.P.E. 2 Add new subsection 5(2A) as follows: 5(2A) Despite subsections 5(1) and 5(2), effective August 1, 2015, every employed member shall contribute to the Fund the sum of (a) 10.3% of the portion of the member’s annual pensionable earnings that are equal to or less than the Y.M.P.E.; and (b) 11.9% of the portion of the member’s annual pensionable earnings that are in excess of the Y.M.P.E. © NS Registry of Regulations.

Schedule “A” Amendments to the Teachers’ Pension Plan Regulations (subsections 5(2C), 5(2D) and 17(2A) and clauses 5(3)(a), 5(3)(

b) and 31(1)(ai)) made pursuant to Sections 14 and 20 of the Acts of 1998, c. 26, the Teachers’ Pension Act 1 Add subsection 5(2C) as follows: 5(2C) A member who commences receiving Union Long Term Disability Insurance benefits on or after August 1, 2014 shall contribute to the Fund and accumulate pensionable service on the same basis as an employed member who is in receipt of pensionable earnings from a participating employer. 2 Add subsection 5(2D) as follows: 5 (2D) A member who is contributing to the Fund under subsection (2C) shall make contributions based on the pensionable earnings they would receive for the position they held immediately prior to being absent from duty on unpaid sick leave or commencing to receive Union Long Term Disability Insurance benefits. 3 Repeal clause 5(3)(

a) and replace with: 5(3) (

a) The Minister shall match the contributions made by members employed by school boards, the Union or the Canadian Teachers’ Federation, including members who are contributing to the Fund under subsection (2C). 4 Repeal clause 5(3)(

b) and replace with: 5(3) (

b) Participating employers other than those in clause (

Part II - Regulations Vol. 38, No. 14 5 Add subsection 17(2A) as follows: 17(2A) Despite subsections (1) and (2), no application for a disability pension shall be received by the Plan administrator after July 31, 2014 unless the applicant was absent from duty on unpaid sick leave as at June 30, 2014 and the application is made before August 1, 2016. 6 Add clause 31(1)(ai) as follows: 31(1) (ai) Despite clause (a), a member who commences receiving Union Long Term Disability Insurance benefits on or after August 1, 2014 may purchase a period of pensionable service equal to the period during which the member was absent from duty on unpaid sick leave without being subsequently re-employed for a period of not fewer than 50 days in a school year.

Section substituted: Municipal taxes payable before commercial operations commence 4 The amount of municipal taxes payable with respect to the Bear Head L.N.G. Plant before the municipal taxation year in which commercial operations commence at the plant is based on the commercial rate of taxation multiplied by the assessed value of the plant and the property where the plant is located, commencing July 1, 2014. 2 Clause 5(2)(

Whereas the purpose of the Petroleum Products Pricing Regulations is to ensure just and reasonable prices for specified petroleum products taking into consideration the objectives of preserving the availability of such products in rural areas, stabilizing prices of such products and minimizing the variances in prices of such products across the Province; And

whereas the Nova Scotia Utility and Review Board (“Board”) considered the manner in which it would proceed to set petroleum prices in its decision, 2006 NSUARB 108, issued on October 16, 2006; And

whereas the Board revised the retail margin and transportation allowance effective January 6, 2012, in its decision, 2011 NSUARB 181, issued on November 23, 2011; And

whereas the Board revised the wholesale margin effective January 4, 2013, in its decision 2012 NSUARB 213, issued on December 12, 2012; And

whereas the average of the average of the daily high and low reported product prices (in Canadian cents) for the week ended June 25, 2014, are: Grade 1 Regular gasoline 84.2¢ per litre Ultra-low-sulfur diesel oil 86.4¢ per litre

Now therefore the Board prescribes the benchmark prices for petroleum products to be: Gasoline: Grade 1 84.2¢ per litre Grade 2 87.2¢ per litre Grade 3 90.2¢ per litre Ultra-low-sulfur diesel oil 86.4¢ per litre And

now therefore the Board has determined, based on historical data regarding price changes and to achieve revenue neutrality, it is appropriate to apply, and the Board so orders, forward averaging corrections of: Gasoline: Nil Ultra-low-sulfur diesel oil: plus 0.3¢ per litre And
