Definition

1 In this Regulation,

(a) "Act" means the Emergency 911 Act;

(b) "Minister" means the Minister responsible for the Act.

Application of regulation

2 This Regulation applies for the purpose of making grants referred

to in

section 6 of the Act.

Delegation

3 The Minister may delegate in writing any power, duty or function

under this Regulation to any employee of the Government.

Eligibility criteria

4 Any person owning or operating a public safety answering point is

eligible to apply for a grant.

Applications for grants

5 An application for a grant must be made in a manner and form

satisfactory to the Minister.

Conditions

6 The following conditions apply to a grant:

(

a) that the recipient

(

i) use the grant only for the purpose for which it is made,

(ii) account to the Minister, in the manner required by the

Minister, for the way in which the grant is spent in

whole or in part,

(iii) permit a representative of the Minister or the Auditor

General to examine any books or records that the

Minister or the Auditor General considers necessary to

determine how the grant has been or is being spent, and

(iv) provide to the Minister, on request, any information the

Minister considers necessary for the purpose of

determining whether or not the recipient has complied

or is complying with the conditions of the grant;

(

b) any other conditions imposed by the Minister.

Variation

7 The Minister may vary

(

a) the eligibility requirements for a grant,

(

b) the purpose of a grant, or

(

c) a condition on which a grant is made.

Repayment of grant

8(1) A recipient of a grant shall repay a grant or part of a grant

(

a) that the recipient receives for which the recipient is not

eligible,

(

b) where the recipient provided false, inaccurate or misleading

information to obtain the grant, or

(

c) where the recipient fails to comply with a condition on which

the grant or part of the grant is made.

(2) A recipient of a grant shall repay any unused portion of the grant.

(3) A grant or part of a grant that is required to be repaid under this

section constitutes a debt due to the Government and is recoverable by

the Minister in an action in debt against the recipient of the grant.

Payment

9 The Minister may provide for the payment of any grant in a lump

sum or by way of instalments and may determine the time or times at

which the grant is to be paid.

Agreements

10 The Minister may enter into an agreement with respect to the

recipient of a grant in respect of any matter relating to the grant.

Refusal to provide grant

11 The Minister may refuse to make a grant under this Regulation to

an applicant who

(

a) makes or has made a false or misleading statement in an

application under this Regulation or in any other document

required by the Minister or who furnishes or has furnished

the Minister or the Government of Alberta or the

information that, in the opinion of the Minister, materially

affects the applicant's eligibility to receive a grant under this

Regulation, or

(

b) if the Minister, in the Minister's sole discretion, considers it

appropriate to refuse to make the grant.

Expiry

12 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be

repassed in its present or an amended form following a review, this

Regulation expires on March 31, 2021.

Coming into force

13 This Regulation comes into force on the coming into force of the

Act.

DEISNGATION AND TRANSFER OF RESPONSIBILITY

AMENDMENT REGULATION

on February 12, 2014 pursuant to sections 17 and 18 of the Government Organization

Act.

1 The Designation and Transfer of Responsibility

Regulation (AR 80/2012) is amended by this Regulation.

Section 10 is amended by adding the following after

subsection (5):

(6) Notwithstanding

section 12.1(3), the responsibility for that part

of the public service associated with the parts of the appropriations

transferred under subsection (6.1), is transferred to the Minister of

Human Services.

(6.1) Notwithstanding

section 12.1(5), the responsibility for the

administration of the unexpended balance of the following parts of

the 2013-14 Government appropriation for Human Services is

transferred from the Minister of Jobs, Skills, Training and Labour to

the Minister of Human Services:

(

a) program 1, Ministry Support Services, the portion of

elements 1.4 to 1.7 related to supports directly provided to

the elements and portions of the elements of program 2,

Employment, transferred by clause (b);

(

b) program 2, Employment:

(

i) the portion of element 2.12, Basic Skills and Academic

Upgrading, related to tuition-based support for labour

market skills training;

(ii) the portion of element 2.15, Training for Work, related

to tuition-based support for labour market skills

training;

(iii) element 2.17, Workforce Partnerships, except the

portion related to initiatives that have a business or

industry focus.

Section 12.1 is amended by adding the following after

subsection (5):

(6) The responsibility for that part of the public service associated

with the parts of the appropriations transferred under subsection (7),

is transferred to the Minister of Jobs, Skills, Training and Labour.

(7) The responsibility for the administration of the unexpended

balance of the following portions of element 2.1, Program Planning

and Delivery, of Program 2, Employment, of the 2013-14

Government appropriation for Human Services is transferred to the

Minister of Jobs, Skills, Training and Labour:

(

a) the portion directly related to providing program planning

and delivery for the portion of element 2.11, Career

Development Services, related to the Adult Learning

Information System;

(

b) the portion directly related to providing program planning

and delivery for element 2.14, Summer Temporary

Employment and Other Employment Programs;

(

c) the portion directly related to providing program planning

and delivery for element 2.16, Settlement and Integration;

(

d) the portion directly related to providing program planning

and delivery for the portion of element 2.17, Workforce

Partnerships, related to initiatives that have a business and

industry focus;

(

e) the portion directly related to providing program planning

and delivery for element 2.18, Aboriginal Development

Partnerships.
