chapter L-10 of the Revised Statutes, 1973, is amended by adding after

Part III the following: 1 La

PARTIE III.1 TAXE 131.3(1) In this

section 131.3(1) Dans le présent

article “licensee” means the person named as the licensee in any of the following licences at any time after February 28, 1998, and before February 27, 2004: (

a) a lounge licence; (

b) a dining-room licence; (

c) a special facility licence; (

d) a club licence; (

e) a catering licence; (

f) a special events licence; or (

g) an in-house brewery licence; « acheteur » désigne toute personne qui, au Nouveau- Brunswick, à tout moment après le 28 février 1998 et avant le 27 février 2004,

a) a acheté de la boisson alcoolique pour son propre usage ou sa propre consommation ou pour l’usage ou la consommation d’autres personnes à ses propres frais, ou

b) a acheté de la boisson alcoolique pour le compte d’un commettant ou à

titre de représentant d’un com- mettant qui acquérait cette boisson alcoolique pour son propre usage ou sa propre consommation ou pour l’usage ou la consommation d’autres personnes aux frais du commettant; « province » désigne Sa Majesté la Reine du chef de la province du Nouveau-Brunswick; 1

“permittee” means the person named as the permittee in a special occasion (resale) permit at any time after Feb- ruary 28, 1998, and before February 27, 2004; “Province” means Her Majesty the Queen in right of the Province of New Brunswick; “purchaser” means any person who, within New Bruns- wick, at any time after February 28, 1998, and before February 27, 2004, (

a) purchased liquor for his or her own use or con- sumption or for the use or consumption by other persons at his or her expense, or (

b) purchased liquor on behalf of or as an agent for a principal who was acquiring such liquor for use or con- sumption by the principal or by other persons at the expense of the principal. « titulaire d’un permis » désigne la personne dont le nom figure comme titulaire sur un permis pour occasions spéciales (revente) à tout moment après le 28 février 1998 et avant le 27 février 2004; « titulaire d’une licence » désigne la personne dont le nom figure comme titulaire sur une des licences suivantes à tout moment après le 28 février 1998 et avant le 27 fé- vrier 2004 :

g) licence de brasserie-maison. 131.3(2) Every purchaser shall pay to the Province for the purpose of raising revenue for Provincial purposes a tax in respect of the use or consumption of all liquor pur- chased by him or her in the licensed premises of a licensee or permittee at any time after February 28, 1998, and be- fore February 27, 2004, computed at the rate of 5% of the purchase price. 131.3(2) Tout acheteur doit payer à la province, afin de créer un revenu pour des objets provinciaux, une taxe sur l’usage ou la consommation de toute boisson alcoolique qu’il a achetée dans l’établissement titulaire d’une licence du titulaire d’une licence ou du titulaire d’un permis à tout moment après le 28 février 1998 et avant le 27 fé- vrier 2004, calculée au taux de 5 % du prix d’achat. 131.3(3) The tax shall be in addition to every other tax paid by the purchaser in respect of the purchase of the li- quor. 131.3(3) La taxe est en sus de toute autre taxe payée par l’acheteur à l’égard de l’achat de la boisson alcoolique. 131.3(4) A purchaser shall be deemed to have paid the tax at the time he or she purchased the liquor. 131.3(4) Un acheteur est réputé avoir payé la taxe au moment où il a acheté la boisson alcoolique. 131.3(5) At any time after February 28, 1998, and before February 27, 2004, a licensee or permittee shall be deemed to have been an agent of the Province for the purpose of collecting the tax and shall be deemed to have collected the tax from the purchaser at the time the purchaser pur- chased the liquor and to have remitted the tax to the Province. 131.3(5) À tout moment après le 28 février 1998 et avant le 27 février 2004, le titulaire d’une licence ou le titulaire d’un permis est réputé avoir été un représentant de la pro- vince pour la perception de la taxe et est réputé avoir perçu la taxe de l’acheteur au moment où l’acheteur a acheté la boisson alcoolique et avoir remis la taxe à la province. 131.3(6) No allowance or commission is payable to li- censees or permittees for their services in collecting and remitting the tax. 131.3(6) Aucune indemnité ou commission n’est versée aux titulaires d’une licence ou aux titulaires d’un permis pour leurs services relatifs à la perception et à la remise de la taxe.

131.3(7) Where, at any time after February 28, 1998, and before February 27, 2004, money was collected or purported to have been collected as user charges pursuant to New Brunswick Regulation 89-167 under this Act, the money shall by this

section be conclusively deemed to have been collected and retained by the Province, without compensation, as payment for the tax notwithstanding any judgment obtained by any person for recovery of any of the money, whether the judgment is obtained before, on or after the enactment of this section. 131.3(7) Lorsque, à tout moment après le 28 fé- vrier 1998 et avant le 27 février 2004, des sommes ont été perçues ou étaient censées avoir été perçues à

article ou à la date de son édiction. 131.3(8) The Taxpayer Protection Act does not apply to the tax imposed under this section. 131.3(8) La

Section 1 of this Act shall be deemed to have come into force on March 1, 1998, and is retroactive to the extent necessary to give it effect on and after that date. 3 L’article 1 de la présente loi est réputé être entré en vigueur le 1er mars 1998 et son effet est rétroactif dans la mesure où cela est nécessaire pour qu’il s’applique à cette date et après cette date.
