Pursuant to

section 80 of the Real Estate Act , the Superintendent of Real Estate orders that the attached regulation is made. — W. A. CLARK, Superintendent of Real Estate.

INDIVIDUAL EXEMPTION REGULATION No. 137

Angus Enterprises Ltd.

1 An offer for sale or lease, the sale or lease and any assistance in the selling or leasing of the subdivided land that comprises the land described as:

Parcel Identifier 002-148-641

That Part of Lot 9 shown as Parcel A on Plan B4366

District Lot 139

Osoyoos Division Yale District

Plan 800; and

Parcel Identifier 002-148-684

That Part of Lot 9 shown as Parcel B on Plan B4366

District Lot 139

Osoyoos Division Yale District

Plan 800,

by or on behalf of Angus Enterprises Ltd., is exempt from all of the provisions of

Part 2 of the

Real Estate Act on condition that

(

a) Angus Enterprises Ltd. will advertise for sale or lease or otherwise market the lots for commercial purposes only,

(

b) the land is used for commercial purposes only, and

(

c) Angus Enterprises Ltd. will notify all purchasers or lessees at the time of an offer for sale or lease that the offering is exempt from the provisions of

Part 2 of the

Real Estate Act and that they will not receive a prospectus or a disclosure statement under the

Real Estate Act and will not have the benefit of any rights or protections afforded by

Part 2 of that Act.
