An Act to Amend the Assessment Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1 The Assessment Act,

chapter A-14 of the Re- vised Statutes, 1973, is amended by adding after

section 4 the following: 4.1(1) The following

definitions apply in this sec- tion. “exemption” means an exemption from the cal- culation or levy of provincial taxes or rates. ( ex- onération) “low rental housing accommodation” means low rental housing accommodation provided to low- income individuals and families. Loi sur l’évaluation not be calculated or levied on real property, or that portion of real property, that is assessed in the name of a not-for-profit housing organization and used for low rental housing accommodation. 4.1(3) Notwithstanding subsection 3(1), and not- withstanding subsection 5(1) of the Real Property Tax Act, if the portion of real property for which an exemption has already been approved under subsec- tion (2) is increased or reduced and if the portion so increased or reduced is used for low rental housing accommodation and is still assessed in the name of the same not-for-profit housing organization, then, subject to subsection (23) and the approval of the Director, provincial taxes or rates shall not be calcu- lated or levied on the portion of real property so used. 4.1(4) Notwithstanding subsection 3(1), and not- withstanding subsection 5(1) of the Real Property Tax Act, if, on January 1 of the year before the year for which an exemption was approved under sub- section (2) or (3), there was new construction on the portion of real property for which the exemption was approved and if the portion of real property was assessed on that January 1 in the name of the same not-for-profit housing organization, then, subject to subsection (23) and the approval of the Director, provincial taxes or rates shall not be calculated or levied on the new construction for the year before the year for which the exemption was approved un- der subsection (2) or (3). 4.1(5) Subsection (4) does not apply to new con- struction on January 1, 2004. 4.1(6) A not-for-profit housing organization may apply to the Minister, on a form provided by the Minister, (

a) for the purposes of subsection (2) or (3), to determine if it meets the criteria prescribed by regulation and if it provides low rental housing accommodation, or sont pas calculés ou prélevés sur des biens réels ou sur la

partie des biens réels qui sert ainsi. 4.1(4) Nonobstant le paragraphe 3(1), et nonobs- tant le paragraphe 5(1) de la

Loi sur l’impôt foncier, si, le 1 er janvier de l’année avant l’année pour la- quelle une exonération a été approuvée en vertu du paragraphe (2) ou (3), il y avait une nouvelle cons- truction sur la

partie des biens réels pour laquelle l’exonération a été approuvée et si la

partie des biens réels était évaluée ce 1 er janvier au nom de la même organisation de logement à but non lucratif, alors, sous réserve du paragraphe (23) et de l’appro- bation du directeur, les taxes ou taux provinciaux ne sont pas calculés ou prélevés sur la nouvelle cons- truction pour l’année avant l’année pour laquelle l’exonération a été approuvée en vertu du paragra- phe (2) ou (3). 4.1(5) Le paragraphe (4) ne s’applique pas à une nouvelle construction le 1 er janvier 2004. 4.1(6) Une organisation de logement à but non lu- cratif peut, au moyen de la formule fournie par le ministre, demander au ministre :

a) aux fins du paragraphe (2) ou (3), de déter- miner si elle répond aux critères prescrits par rè- glement et si elle fournit des logements à loyer modique;

b) for the purposes of subsection (4), to deter- mine if, on the January 1 referred to in subsection (4), it met the criteria prescribed by regulation. 4.1(7) The Minister shall approve the application and send a copy of the approval to the Director if (

a) for the purposes of subsection (2) or (3), the Minister determines that the not-for-profit hous- ing organization meets the criteria referred to in subsection (6) and that the not-for-profit housing organization provides low rental housing accom- modation, or (

b) for the purposes of subsection (4), the Min- ister determines that, on the January 1 referred to in subsection (4), the not-for-profit housing orga- nization met the criteria referred to in subsection (6). 4.1(8) For the purposes of subsection (2) or (3), an approval of the Minister for any year must be granted in the preceding year on or before the date prescribed by regulation. 4.1(9) Notwithstanding subsection (8), for the purposes of subsection (2), the deadline for an ap- proval of the Minister for 2005 is December 31, 2005. 4.1(10) For the purposes of subsection (4), an ap- proval of the Minister must be granted in the year for which the exemption was approved under sub- section (2) or (3) and on or before the date pre- scribed by regulation. 4.1(11) The Director’s decision to approve or to refuse to approve an exemption under subsection (2) or (3) and the Director’s determination of the portion of the total assessment attributable to the portion of real property that is used for low rental housing accommodation shall be made on the basis of the Minister’s approval under paragraph (7)(

a) and on the basis of such other information as the Di- rector requires.

b) aux fins du paragraphe (4), si le ministre dé- termine que, le 1 er janvier visé au paragraphe (4), l’organisation de logement à but non lucratif ré- pondait aux critères visés au paragraphe (6). 4.1(8) Aux fins du paragraphe (2) ou (3), une ap- probation du ministre pour une année donnée est ac- cordée dans l’année qui précède, à la date prescrite par règlement ou avant cette date. 4.1(9) Nonobstant le paragraphe (8), aux fins du paragraphe (2), la date limite pour une approbation du ministre pour 2005 est le 31 décembre 2005. 4.1(10) Aux fins du paragraphe (4), une approba- tion du ministre est accordée dans l’année pour la- quelle l’exonération a été approuvée en vertu du pa- ragraphe (2) ou (3), à la date prescrite par règlement ou avant cette date. 4.1(11) La décision du directeur d’approuver ou de refuser d’approuver une exonération en vertu du paragraphe (2) ou (3) et la détermination par le directeur de la fraction de l’évaluation totale cor- respondant à la

partie des biens réels qui sert de lo- gement à loyer modique sont fondées sur l’approba- tion du ministre conformément à l’alinéa

(7) a) ainsi que sur les autres renseignements que le directeur requiert.

Loi sur l’évaluation 4.1(12) The Director’s decision to approve or to refuse to approve an exemption under subsection (4) and the Director’s determination of the portion of the total assessment attributable to the new con- struction shall be made on the basis of the Minister’s approval under paragraph (7)(

b) and on the basis of such other information as the Director requires. 4.1(13) For the purposes of subsections (2) and (3), the determination of the portion of the total as- sessment attributable to the portion of real property that is used for low rental housing accommodation is in the sole discretion of the Director. 4.1(14) For the purposes of subsection (4), the de- termination of the portion of the total assessment at- tributable to the new construction is in the sole dis- cretion of the Director. 4.1(15) A not-for-profit housing organization shall notify the Minister and the Director immedi- ately if there is a change in the size or use of the real property or portion of real property for which an ex- emption was approved under subsection (2) or (3) or if the not-for-profit housing organization no longer meets the criteria referred to in subsection (6). 4.1(16) A decision of the Director to approve an exemption under subsection (2), (3) or (4) has effect from January 1 of the year for which the exemption is approved, and any changes required to be made in the assessment and tax roll as a result of the exemp- tion shall be made as soon as possible after the de- cision is made. 4.1(17) A decision of the Director to approve an exemption under subsection (2) or (3) has effect un- til and including December 31 of the year in which (

partie des biens réels qui sert de lo- gement à loyer modique est à la seule discrétion du directeur. 4.1(14) Aux fins du paragraphe (4), la détermina- tion de la fraction de l’évaluation totale correspon- dant à la nouvelle construction est à la seule discré- tion du directeur. 4.1(15) Une organisation de logement à but non lucratif doit aviser immédiatement le ministre et le directeur s’il y a un changement dans la grandeur ou dans l’utilisation des biens réels ou de la

partie des biens réels pour lesquels une exonération a été ap- prouvée en vertu du paragraphe (2) ou (3), ou si l’or- ganisation de logement à but non lucratif ne répond plus aux critères visés au paragraphe (6). 4.1(16) La décision du directeur d’approuver une exonération en vertu du paragraphe (2), (3) ou (4) prend effet à partir du 1 er janvier de l’année pour la- quelle l’exonération est approuvée, et tout change- ment requis au rôle d’évaluation et d’impôt en con- séquence de l’exonération se fait aussitôt que possible après que la décision est rendue. 4.1(17) La décision du directeur d’approuver une exonération en vertu du paragraphe (2) ou (3) est en vigueur jusqu’au 31 décembre inclusivement de l’année au cours de laquelle un des événements sui- vants se produit :

a) il y a un changement dans la grandeur ou dans l’utilisation des biens réels ou de la

partie des biens réels;

b) the not-for-profit housing organization no longer meets the criteria referred to in subsection (6), or (

c) the real property or portion of real property is no longer assessed in the name of the not-for- profit housing organization. 4.1(18) The Minister’s decision to approve or to refuse to approve an application under subsection (6) is final and may not be questioned or reviewed in any court. 4.1(19) The Director’s decision to approve or to refuse to approve an exemption under subsection (2), (3) or (4) is final and may not be questioned or reviewed in any court. 4.1(20) The Director’s determination of the por- tion of the total assessment attributable to the por- tion of real property for which an exemption is ap- proved under subsection (2) or (3) is final and may not be questioned or reviewed in any court. 4.1(21) The Director’s determination of the por- tion of the total assessment attributable to the new construction for which an exemption is approved under subsection (4) is final and may not be ques- tioned or reviewed in any court. 4.1(22) Sections 25, 27, 28 and 37 do not apply to (

a) the Director’s decision to approve or to refuse to approve an exemption under subsection (2), (3) or (4), (

b) the Director’s determination of the portion of the total assessment attributable to the portion of real property for which an exemption is ap- proved under subsection (2) or (3), or (

c) the Director’s determination of the portion of the total assessment attributable to the new

a) à la décision du directeur d’approuver ou de refuser d’approuver une exonération en vertu du paragraphe (2), (3) ou (4);

b) à la détermination par le directeur de la frac- tion de l’évaluation totale correspondant à la par- tie des biens réels pour laquelle une exonération est approuvée en vertu du paragraphe (2) ou (3);

c) à la détermination par le directeur de la frac- tion de l’évaluation totale correspondant à la

section does not apply to real prop- erty prescribed by regulation. 4.1(24) A person who fails to notify the Minister or the Director under subsection (15) commits an offence punishable under

Part II of the Provincial Offences Procedure Act as a category F offence. 2

Section 40 of the Act is amended (

a) in subsection (1) by adding after para- graph (e.5) the following: (e.51) prescribing criteria for the purposes of subsection 4.1(6); (e.52) prescribing real property for the pur- poses of subsection 4.1(23); (

b) by adding after subsection (1.23) the fol- lowing: 40(1.24) A regulation made under paragraph (1)(e.51) or (e.52) may be retroactive in its opera- tion to January 1, 2005, or to any date after January 1, 2005. 3 This Act comes into force on January 1, 2005. nouvelle construction pour laquelle une exonéra- tion est approuvée en vertu du paragraphe (4). 4.1(23) Le présent
