OIC Text: The Governor in Council on the report and recommendation of the Minister of Education dated February 28, 2008, and pursuant to

Section 88 of

Chapter 1 of the Acts of 1995-96, the Education Act, is pleased to amend Order in Council 2003-286, dated June 27, 2003, and with the acceptance of Executive Council on February 28, 2008, of amendments to the school capital construction program, by: (

a) amending

Schedule "N" attached to Order in Council 2003-286, dated June 27, 2003, to remove from the approved Additions and Alterations list the addition and alterations project approved for Lakeview Consolidated School, Halifax Regional School Board, in the amount of $4,700,000, and an addition and alterations project approved for Yarmouth Memorial High School, Tri-County Regional School Board, in the amount of $3,650,000; (

b) approving the construction of a new Lakeview Consolidated School for the Halifax Regional School Board, scheduled for completion in September 2010, at a total cost not to exceed $10,500,000; (

c) authorizing the allocation of funding in the amount of $10,500,000 to cover costs of this project to be allocated in fiscal years 2008-09, 2009-10, 2010-11 and 2011-12; the total costs will subsequently be funded through the Tangible Capital Asset allocation of the Department of Education in subsequent years in the estimated amounts of $700,000 for the 2008-09 fiscal year, $6,203,000 for the 2009-10 fiscal year, $3,264,200 for the 2010-11 fiscal year, and $332,800 for the 2011-12 fiscal year; (

d) approving the construction of a new Yarmouth Memorial High School for the Tri-County Regional School Board, scheduled for completion in September 2011, at a total cost not to exceed $24,869,000; (

e) authorizing the allocation of funding in the amount of $24,869,000 to cover costs of this project to be allocated in fiscal years 2008-09, 2009-10, 2010-11, 2011-12 and 2012-13; the total costs will subsequently be funded through the Tangible Capital Asset allocation of the Department of Education in subsequent years in the estimated amounts of $200,000 for the 2008-09 fiscal year, $1,102,000 for the 2009-10 fiscal year, $15,170,000 for the 2010-11 fiscal year, $8,354,000 for the fiscal year 2011-12, and $43,000 for the 2012-13 fiscal year; (

f) authorizing the Minister of Transportation and Infrastructure Renewal to do whatever is necessary to acquire the land and buildings for the new school construction and additions and alterations, referred to in clauses (

b) to (e), in the name of Her Majesty the Queen in Right of the Province of Nova Scotia, and authorizing the Minister of Transportation and Infrastructure Renewal to tender for the necessary work to design and construct the buildings and acquire the equipment necessary for the schools as approved; (

g) authorizing the Minister of Transportation and Infrastructure Renewal to hold the buildings, equipment and land for the construction of the schools in clauses (

b) to (

e) in the name of Her Majesty the Queen in Right of the Province of Nova Scotia while the projects are in progress; (

h) upon completion of the construction of the schools in clauses (

b) to (

e) to the satisfaction of the Minister of Transportation and Infrastructure Renewal and the Minister of Education, the buildings, equipment and land for the school shall be conveyed by Her Majesty the Queen in Right of the Province of Nova Scotia, as represented by the Minister of Transportation and Infrastructure Renewal, to the school boards referred to in clauses (

b) to (e); and (

i) authorize the Minister of Education and the Minister of Transportation and Infrastructure Renewal to execute such instruments as may be necessary for the purpose of this Order and authorize both or either of them to enter into an agreement with the school boards referred to in clauses (

b) to (

e) to attain the purposes of this Order.
