An Act to Amend the Order of New Brunswick Act Loi modifiant la Loi créant l’Ordre du Nouveau-Brunswick Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1

Section of the Order of New Brunswick Act, chap- ter O- 5.01 of the Acts of New Brunswick, 2000, is amended L’article de la Loi créant l’Ordre du Nouveau- Brunswick,

chapitre O- 5.01 des Lois du Nouveau- Brunswick de 2000, est modifié (

a) in subsection (1)

a) au paragraphe (1) (

i) by repealing paragraph (

a) and substituting the following: (

i) par l’abrogation de l’alinéa a) et son rempla- cement par ce qui suit : (

a) a non-voting chairperson, who is either the Chief Justice of New Brunswick or the Chief Justice of The Court of Queen’s Bench of New Brunswick, alternating with each other for terms of three years,

a) d’un président sans droit de vote, qui est soit le juge en chef du Nouveau-Brunswick ou le juge en chef de la Cour du Banc de la Reine du Nouveau-Brunswick, sié- geant en alternance pour des mandats de trois ans, (ii) in paragraph (

b) by repealing subsection (3) and substituting the following:

section the following: 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 14 : Absence of chairperson Absence du président 14.1(1) If the chairperson is absent or unable to act, the alternating Chief Justice shall act on behalf of the chair- person. 14.1(1) En cas d’absence ou d’incapacité du président, l’autre juge en chef assume la présidence. 14.1(2) If neither Chief Justice is able to act as chair- person, the members of the council shall elect from among themselves a member to act as chairperson. 14.1(2) Si ni l’un ni l’autre des juges en chef ne peut assumer la présidence, les membres du conseil élisent en leur sein un membre à cette fin. 14.1(3) A member who is elected chairperson may vote on any matter before the council. 14.1(3) Le membre qui est élu président peut voter sur toute question dont le conseil est saisi. 3 Notwithstanding the order in which the Chief Justice of New Brunswick and the Chief Justice of The Court of Queen’s Bench of New Brunswick appear in paragraph 14(1)(

a) of the Order of New Brunswick Act, the Chief Justice of The Court of Queen’s Bench of New Bruns- wick shall serve as the next chairperson of the Order of New Brunswick Advisory Council as of January 31, 2010. 3
