On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Cannabis Licensing Regulation, B.C. Reg. 202/2018, is amended as set out in the attached Appendix.

Appendix

Section 4 (

b) of the Cannabis Licensing Regulation, B.C. Reg. 202/2018, is repealed and the following substituted:

(

b) if approved by the general manager, to either of the following:

(

i) a licensee who holds another retail store licence;

(ii) an applicant for a retail store licence.

Section 9 (2) and (3) is repealed and the following substituted:

(2) A retail store licensee must not sell, under a retail store licence, cannabis that the licensee purchased from the government unless

(

a) the retail store licence was identified by the licensee under subsection (1), or

(

b) the cannabis is sold under another retail store licence held by the licensee.

Section 21.1 is renumbered as

section 10.01 in Division 2 of

Part

Section 10.01 is amended by adding the following paragraph:

(

f) a person who purchased cannabis under

section 4 (b) (ii).

5 The following

section is added to Division 2 of

Part 2:

Prescribed person – sale

10.02 For the purposes of

section 15 (

d) of the Act, a prescribed person is a licensee

(

a) whose licence authorizes the sale of cannabis, and

(

b) who, as an applicant for that licence, purchased the cannabis under

section 4 (b) (ii) of this regulation.

Section 24 (3) is amended by adding the following paragraph:

(b.2) records for transfers of cannabis between retail stores under retail store licences held by the same licensee; .
