of this Order in respect of the annexed land are transferred to and become

payable to The Town of Brooks together with any lawful penalties and costs

levied in respect of those taxes, and the Town of Brooks upon collecting

those taxes, penalties or costs must pay them to the County of Newell No.

4, and

3 makes the Order in Appendix C.

DETAILED DESCRIPTION OF THE LANDS SEPARATED FROM THE COUNTY OF NEWELL NO. 4 AND ANNEXED TO THE TOWN OF BROOKS

All that portion of the northwest quarter of

section thirty-one (31),

township eighteen (18), range fourteen (14), west of the fourth meridian

which lie to the south of the southerly limit of the railway right-of-way

on Plan RY11.

The southwest quarter of

section 31, township eighteen (18), range fourteen

(14), west of the fourth meridian.

All that portion of the southeast quarter of

section thirty-one (31),

township eighteen (18), range fourteen (14), west of the fourth meridian,

not within the Town of Brooks.

The northwest quarter of

section thirty (30), township eighteen (18), range

fourteen (14) west of the fourth meridian.

The northeast quarter of

section thirty (30), township eighteen (18), range

fourteen (14), west of the fourth meridian.

All government road allowances adjoining the above described lands.

APPENDIX C

1 In this Appendix,

(a) "agricultural land" means any portion of the annexed land and

the assessable improvements to it having an agricultural designation under

the County of Newell No. 4 Land Use Bylaw on December 30, 1997;

(b) "annexed land" means the land described in Appendix A and shown

on the sketch in Appendix B.

2 Subject to sections 3 to 6, the assessor for the Town of Brooks must

assess for the purpose of taxation in 1998 the annexed land and the

assessable improvements to it on the same basis as the assessment of other

property in the Town of Brooks.

3(1) For the purpose of property taxes in the period 1998 to 2002

inclusive, agricultural land must be assessed on the same basis as if it

had remained within the County of Newell No. 4 and, subject to subsection

(2), the tax rate that applies to the agricultural land must be the same as

the tax rate that applies to similar property in the Town of Brooks.

(2) The difference between the tax rate that applies to land having an

agricultural designation in the County of Newell No. 4 and the tax rate

that applies to similar property in the Town of Brooks must be phased in

over the five-year period from 1998 to 2002 inclusive, at a cumulative rate

of 20% per annum of the difference between the two tax rates.

4(1) For the purpose of property taxes in the period 2003 to 2012

inclusive, agricultural land must be assessed on the same basis as if it

had remained within the County of Newell No. 4.

(2) The tax rate for the agricultural land must be the same as the tax

rate for similar property in the Town of Brooks.

5(1) For the purpose of property taxes in the period 2013 to 2017

inclusive, agricultural land must, subject to subsection (2), be assessed

on the same basis as the assessment of other property in the Town of

Brooks.

(2) The difference between the assessment that applies to land having an

agricultural designation in the County of Newell No. 4 and the assessment

of similar property in the Town of Brooks must be phased in over the

five-year period from 2013 to 2017 inclusive, at a cumulative rate of 20%

per annum of the difference between the two assessments.

(3) The tax rate for the agricultural land must be the same as the tax

rate for similar property in the Town of Brooks.

6(1) Sections 3 to 5 cease to apply to a parcel of agricultural land in

the first complete taxation year immediately following the taxation year in

which the event in subsection (2)(a), (b), (c), or (

d) occurs.

(2) Subsection (1) applies to a parcel of agricultural land if any of the

following occur after December 31, 1997 at the request of, or on behalf of

the landowner:

(

a) the parcel is the subject of a subdivision or separation of

title, whether by registered plan of subdivision, by instrument or by any

other method whereby a new parcel of land, including the residual parcel,

is created;

(

b) the designation of the parcel is changed from "DC" - Direct

Control District to another designation pursuant to the Town of Brooks Land

Use Bylaw;

(

c) the parcel is the subject of a development permit, issued for a

new land use or development pursuant to the Town of Brooks Land Use Bylaw;

(

d) municipal water or sewer services provided by the Town of Brooks

are extended to a new or existing development located on the parcel.

7 After sections 3 to 5 cease to apply to a parcel of agricultural land

in a taxation year, the land and the assessable improvements on it must be

assessed, for the purposes of property taxes in that year, on the same

basis as the assessment of other property in the Town of Brooks.

Interpretation

1 In this Ministerial Order

a) "Westlock Ward" means the geographical area comprising the

jurisdiction of The Westlock Roman Catholic Separate School District No.

110 which is currently a ward of The Holy Trinity Roman Catholic Regional

Division No. 36 ("Holy Trinity"),

b) "Whitecourt Ward" means the geographical area comprising the

jurisdiction of The Whitecourt Roman Catholic Separate School District No.

94 which is currently a ward of Holy Trinity, and

c) "Slave Lake Ward" means the geographical area comprising the

jurisdiction of The Slave Lake Roman Catholic Separate School District No.

155 which is currently a ward of Holy Trinity.

Living Waters Establishment Order

2 Pursuant to sections 208.2, 208.3 and 217(4) of the School Act, The

Living Waters Catholic Regional Division No. 42 ("Living Waters") is

established and the board of trustees of Living Waters is established under

the name of "The Board of Trustees of Living Waters Catholic Regional

Division No. 42" (the "Living Waters Board") and the members of the Living

Waters Board are a corporation.

3 Living Waters consists of:

a) The Sundance Catholic Separate Regional Division No. 10

("Sundance");

b) Whitecourt Ward;

c) Slave Lake Ward.

4 In accordance with

section 208.4 of the School Act Living Waters

consists of four wards as follows:

a) the geographical area comprising the jurisdiction of The Hinton

Roman Catholic Separate School District No. 155;

b) the geographical area comprising the jurisdiction of The Edson

Roman Catholic Separate School District No. 153;

c) Whitecourt Ward;

5 Pursuant to

section 208.2 of the School Act, the following

individuals are appointed as first trustees of the Living Waters Board and

hold office until the first organizational meeting of the geographical area

comprising the jurisdiction of the Living Waters Board held after the first

general election after Living Waters is established:

6 The first meeting of the Living Waters Board shall be held within

8 Pursuant to

section 208.5 of the School Act, The Board of Trustees of

Sundance Catholic Regional Division No. 10 is dissolved and all its assets

and liabilities are transferred to the Living Waters Board. The assets and

liabilities of Whitecourt Ward and Slave Lake Ward are transferred in

accordance with

section 16 of this Order.

Evergreen Establishment Order

9 Pursuant to sections 208.2, 208.3 and 217(4) of the School Act, The

Evergreen Catholic Separate Regional Division No. 2 ("New Evergreen") is

established and the board of trustees of New Evergreen is established under

the name of "The Board of Trustees of Evergreen Catholic Separate Regional

Division No. 2" (the "New Evergreen Board") and the members of the New

Evergreen Board are a corporation.

10 New Evergreen consists of

a) Westlock Ward, and

b) The Evergreen Catholic Separate Regional Division No. 2

established June 10, 1994 by Ministerial Order No. 041/94 ("Old

Evergreen").

11 In accordance with

section 208.4 of the School Act the New Evergreen

consists of three wards as follows:

a) Westlock Ward;

b) the geographical area comprising the jurisdiction of The Spruce

Grove Roman Catholic Separate School District No. 128;

c) the geographical area comprising the jurisdiction of The Stony

Plain Roman Catholic Separate School District No. 151.

12 Pursuant to

section 208.2 of the School Act, the following

individuals are appointed as first trustees of the New Evergreen Board and

hold office until the first organizational meeting of the New Evergreen

Board held after the first general election after New Evergreen is

established:

a) Mary Bell;

b) Caren Mueller;

c) Gerald Bernakevitch;

13 The first meeting of the New Evergreen Board shall be held within

15 Pursuant to

section 208.5 of the School Act, The Board of Trustees of

Evergreen Catholic Separate Regional Division No. 2 established on June 10,

1994 by Ministerial Order No. 041/94 (the "Old Evergreen Board") is

dissolved and all its assets and liabilities are transferred to the New

Evergreen Board. The assets and liabilities of Westlock Ward are

transferred in accordance with

section 16 of this Order.

Holy Trinity Repeal Order

16 Pursuant to

section 208.5 of the School Act, The Board of Trustees of

Holy Trinity is dissolved and all assets and liabilities of Holy Trinity

are transferred to the New Evergreen Board and the Living Waters Board and

divided as to the proportions agreed upon by those boards or as otherwise

set out in

a) the regional agreement between the Old Evergreen Board and The

Board of Trustees of The Holy Trinity Roman Catholic Regional Division No.

36, and

b) the regional agreement between The Board of Trustees of The

Sundance Catholic Separate Regional Division No. 10 and The Board of

Trustees of The Holy Trinity Roman Catholic Regional Division No. 36.

17 Ministerial Order No. 058/94, dated July 15, 1994, Ministerial Order

No. 041/94, dated June 10, 1994 and Ministerial Order No. 001/97 dated

January 15, 1997 are repealed by this Order.

18 This Order comes into force on April 1, 1998.

section 295 of the Insurance Act, that

owner's policy and other approved policies effective June 1, 1998.

Section B Accident Benefits

By repealing Subsection 2(

A) and Subsection 2(

B) and substituting the

following:

SUBSECTION 2(

A) SUPPLEMENTED BENEFITS RESPECTING ACCIDENTS OCCURRING

OUTSIDE ALBERTA IN A NO-FAULT JURISDICTION

(1) In this Subsection 2(A)

(a) "accident" means an event resulting in bodily injury caused by

an automobile or by the use of an automobile or by the load of an

automobile, including damage caused by a trailer;

(b) "applicable laws" means, with respect to a no-fault

jurisdiction, the laws in force from time to time governing the system of

no-fault automobile insurance in that jurisdiction;

(c) "insured person" means an individual who is a resident of

Alberta and who

(

i) is an occupant of the described automobile or of a newly

acquired or temporary substitute automobile as defined in this policy,

(ii) is an occupant of an automobile and is

(

A) the named insured, or a spouse of the named insured

living in the same dwelling premises as the named insured, or

(

B) a dependent relative of an individual referred to

in paragraph (

A) living in the same dwelling premises as the named insured,

(iii) while a pedestrian, is struck by the described automobile

or a newly acquired or temporary substitute automobile as defined in this

policy,

(iv) while a pedestrian, is struck by an automobile and is

(

A) the named insured, or a spouse of the named insured

living in the same dwelling premises as the named insured, or

(

B) a dependent relative of an individual referred to

in paragraph (

A) living in the same dwelling premises as the named insured,

(

v) is the occupant of an automobile or a pedestrian struck

by an automobile and is

(

A) an employee or partner of the named insured who is

provided with the regular use of the described automobile, or a spouse of

the employee living in the same dwelling premises as the employee or a

spouse of the partner living in the same dwelling premises as the partner,

(

B) a dependent relative of an individual referred to

in paragraph (

A) living in the same dwelling premises as that individual,

(vi) is

(

A) the occupant of an automobile, or

(

B) a pedestrian struck by an automobile

driven by an individual described in any of subclauses

(

i) through (v),

but does not include an individual who is, at the time of

an accident in Quebec, the owner or occupant of an automobile registered in

Quebec;

(d) "no-fault jurisdiction" means the Province of Quebec, Ontario,

Manitoba or Saskatchewan;

(e) "pedestrian" means an individual who is not an occupant of an

automobile;

(f) "resident of Alberta" means an individual who

(

i) is authorized by law to be or to remain in Canada and is

living and ordinarily present in Alberta, and

(ii) meets the criteria for non-residency in the no-fault

jurisdiction established by the applicable laws of the no-fault

jurisdiction.

(2) The definition of "insured person" under the heading Special

Provisions, Definition, and Exclusions of

Section B does not apply to this

Subsection.

(3) Where an insured person suffers personal injury as a result of an

accident occurring in a no-fault jurisdiction, the insurer agrees to pay to

the insured person the amount that would be payable under the applicable

laws of the no-fault jurisdiction as if the insured person were a resident

of the no-fault jurisdiction.

(4) For the purposes of calculating an amount payable under (3) in

respect of an accident occurring in Quebec, references in the Automobile

Insurance Act (Quebec) to other statutes or regulations of Quebec used to

calculate an amount payable under (3) shall be read as references to

corresponding Alberta statutes or regulations or federal statutes or

regulations that apply in Alberta.

(5) In any claim or action in Alberta arising out of an accident in

Alberta, the insurer agrees not to exercise its right of subrogation

against a resident of Manitoba or Saskatchewan in respect of

Section B -

Accident Benefits paid to a resident of Alberta under this policy.

(6) No exclusion or limitation in

Section B or in the General Provisions,

Definitions and Exclusions and the Statutory Conditions of this policy may

be raised by the insurer in respect of a claim by an insured under (3).
