An Act to Amend the Economic Development Act Loi modifiant la

Loi sur le développement économique Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1

Section 12 of the Economic Development Act, chap- ter E-1.11 of the Acts of New Brunswick, 1975, is amended 1 L’article 12 de la

chapitre E-1.11 des Lois du Nouveau- Brunswick de 1975, est modifié (

a) by renumbering the

section as subsection 12(1);

b) in subsection (1)

i) by repealing paragraph (

d) and substituting the following: (

i) par l’abrogation de l’alinéa d) et son rempla- cement par ce qui suit : (

d) respecting annual charges and the terms and con- ditions applicable to annual charges;

d) concernant les charges annuelles ainsi que les mo- dalités et conditions qui leur sont applicables; (ii) by repealing paragraph (d.1); (ii) par l’abrogation de l’alinéa d.1); (iii) by repealing paragraph (d.2) and substitut- ing the following: (iii) par l’abrogation de l’alinéa d.2) et son rem- placement par ce qui suit : (d.2) respecting an adjustment, deferment, reduction or waiver by the Minister of the annual charges referred to in paragraph (

d) and alterations by the Minister of the terms and conditions referred to in paragraph (d); d.2) concernant un ajustement, un report, une réduc- tion ou une renonciation par le Ministre des charges annuelles visées à l’alinéa d) et les modifications par le Ministre des modalités et conditions visées à l’alinéa d); (

c) by adding after subsection (1) the following:

12(2) A regulation made under paragraph (1)(

d) or (d. 2) may be retroactive to February 15, 2003, or to any date after February 15, 2003. 12(2) Un règlement établi en vertu de l’alinéa

Section 14 of the Act is amended 2 L’article 14 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 14(1) Any person who receives financial assistance un- der this Act shall pay to the Minister an annual charge in accordance with the terms and conditions prescribed by regulation. 14(1) Toute personne qui reçoit une aide financière en application de la présente loi doit verser au Ministre une somme au

titre de charges annuelles selon les modalités et conditions établies par règlement. (

b) in subsection (2), by striking out “service fees” and substituting “annual charges”.

TRANSITIONAL PROVISION DISPOSITION TRANSITOIRE 3 Any reference to “service fee” in any agreement or other instrument or document that was valid and of full force and effect immediately before the commencement of this
