Citation

1 These regulations may be cited as the “Highway 104 Western Alignment Regulations”.

Definitions

1A

(1) In these regulations,

“Act” means the Highway 104 Western Alignment Act .

(2) In the Act,

“class of vehicle” means any of the following classes:

(

i) Class A, which consists of trucks, buses, school buses, farm tractors,

truck tractors, trailers, semi-trailers, pole trailers and any other

vehicle not described in Class B or C,

(ii) Class B, which consists of passenger cars, taxicabs, vans without

commercial licenses and motorcycles,

(iii) Class C, which consists of recreation vehicles, motorhomes with any

number of axles, travel trailer and passenger car combinations and

travel trailer and 2 axle truck combinations,

(iv) Class D, which consists of any vehicle described in Class A, B or C

with Nova Scotia registered licence plates,

(

v) Class E, which consists of any vehicle described in Class A with

commercial licence plates registered to any state of the United States

of America.

Delineation and further definition of “Western Alignment”

2 “Western Alignment” is delineated and further defined to mean the right-of-way shown

on plans identified by NSDOT File No. 64902 entitled “Western Alignment TCH 104 -

Thomson to Colchester County Line” (Sheets 1-27) and NSDOT File No. 64625 entitled

“HWY 104 Western Alignment - County Line to Masstown” (Sheets 1-26), the highway

on the right-of-way, the bridges, overpasses, culverts and structures forming part of the

highway and the toll booth, weigh stations, service facilities and maintenance facilities

located on the right-of-way and serving the highway.

Prohibition respecting non-payment of toll

(1) No person shall operate a vehicle within the Western Alignment unless the toll for

doing so has been paid or unless the person and the Corporation have entered into

an agreement for the payment of the toll.

(2) A person who operates a vehicle within the Western Alignment without having

paid the toll for doing so or without having entered into an agreement referred to in

Section 1 is guilty of an offence and is liable on

summary conviction to a

minimum fine of $50.00.

(3) Subsections (1) and (2) do not apply to Class D vehicles.

Class E toll rate

4 The toll for a Class E vehicle being operated within the Western Alignment is twice the

toll imposed for a Class A vehicle.
