On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective September 1, 2019, the Medical and Health Care Services Regulation, B.C. Reg. 426/97, is amended as set out in the attached Schedule.

Schedule

Section 1 of the Medical and Health Care Services Regulation, B.C. Reg. 426/97, is amended by adding the following definition:

"international student" means a person admitted to Canada as a student who

(

a) possesses a valid study permit issued under the Immigration and Refugee Protection Act (Canada) for a period of 6 or more months,

(

b) continues to retain such valid authorization,

(

c) meets the criterion under paragraph (

b) of the definition of "resident" in the Act, and

(

d) either

(

i) meets the criterion under paragraph (

c) of the definition of "resident" in the Act, or

(ii) arrived in British Columbia after June 30 of the calendar year; .

Section 2 is amended

(

a) by repealing paragraph (

a) and substituting the following:

(

a) an international student; ,

(

b) by repealing paragraph (b) (

i) and substituting the following:

(

i) possesses a valid work permit issued under the Immigration and Refugee Protection Act (Canada) for a period of 6 or more months, , and

(

c) in paragraph (

i) by striking out " paragraphs (

a) to (g) " and substituting " paragraphs (

b) to (g) ".

Section 7.6 is amended in the definition of "qualifying spouse" by repealing paragraph (

b) and substituting the following:

(

b) is not a minor, a dependent post-secondary student or an international student.

Section 8 is repealed and the following substituted:

General premium rate for beneficiaries

8 For the purposes of

section 8 of the Act and subject to this Part, the premium rate for a beneficiary who

(

a) is not an international student is $37.50 per month,

(

b) is an international student and who is a minor or a dependent post-secondary student is $37.50 per month or part of a month, if enrolment as an international student is only for part of a month, and

(

c) is an international student to whom paragraph (

b) does not apply is $75 per month or part of a month, if enrolment as an international student is only for part of a month.

Section 10.1 is repealed and the following substituted:

No premiums payable by minors or certain students

10.1 No premiums are payable by a beneficiary who

(

a) is a minor or a dependent post-secondary student, and

(

b) is not an international student.
