Reg. 99/2001 Made: July 30, 2001 Filed: August 1, 2001 Alcohol Rehabilitation Programs Regulations Order in Council 2001-373 made July 30, 2001 Regulations made by the Governor in Council pursuant to subsection 67(13 and 68(3) of the Motor Vehicle Act The Governor in Council on the report and recommendation of the Minister of Service Nova Scotia and Municipal Relations dated July 11, 2001, and pursuant to subsections 67(13) and 68(3) of

Chapter 293 of the Revised Statutes of Nova Scotia, 1989, the Motor Vehicle Act, is pleased to (

a) repeal the Alcohol Rehabilitation Program Regulations, 1984 made by the Governor in Council by Order in Council 84-1028 dated August 28, 1984; and (

b) make new regulations respecting alcohol re habilitation programs in the form set forth in

Schedule “A” attached to and forming part of the report and recommendation, effective on and after August 1, 2001.

Schedule “A” Regulations Respecting Alcohol Rehabilitation Programs made pursuant to subsections 67(13) and 68(3) of

Chapter 293 of the Revised Statutes of Nova Scotia, 1989, the Motor Vehicle Act Citation 1 These regulations may be referred to as the Alcohol Rehabilitation Programs Regulations. Alcohol rehabilitation program 2 For the purpose of

Section 67 of the Act, “alcohol rehabilitation program” means a program that is conducted, directed or promoted by a district health authority established under the Health Authorities Act for a person whose driver’s license has been revoked for an alcohol related driving offence or suspended under

Section 279A of the Act. Evidence of participation and rehabilitation 3( 1 ) Every applicant for reinstatement of a driver’s license who is required by the Registrar pursuant to subsection 67(11) of the Act to participate in an alcohol rehabilitation program shall provide the Registrar with evidence of participation in an alcohol rehabilitation program and of satisfactory rehabilitation before consideration will be given to the application.

(2) Evidence of satisfactory rehabilitation required by subsection (1) may be provided by the district health authority that conducted, directed or promoted the alcohol rehabilitation program attended by the applicant. Costs 4 A participant in an alcohol rehabilitation program shall pay costs in an amount of $365.00.

Section 26 of

Chapter 9 of the Acts of 2001, the Order of Nova Scotia Act, it is enacted as follows: 26 This Act comes into force on such day as the Governor in Council orders and declares by proclamation. AND

WHEREAS it is deemed expedient that

Part II Regulations NOW KNOW YE THAT WE, by and with the advice of the Executive Council of Nova Scotia, do by this Our Proclamation order and declare that

Chapter 9 of the Acts of 2001, the Order of Nova Scotia Act, come into force on and not before August 2, 2001, of which all persons concerned are to take notice and govern themselves accordingly. IN TESTIMONY WHEREOF We have caused these our Letters to be made Patent and the Great Seal of Nova Scotia to be hereunto affixed. WITNESS, Our Trusty and Well Beloved Her Honour the Honourable Myra A. Freeman, Lieutenant Governor of the Province of Nova Scotia.
