These regulations may be cited as the Nurses Regulations .

Definitions

(1) In these regulations

(a)

"Act" means the Nurses Act ;

(b)

"approved employer" means

(

i) the Provincial Health Authority, or

(ii)

another person or body approved by the college;

(c)

"emergency licence" means

(

i) an emergency licensed practical nurse licence issued under subsection 17(2),

(ii)

an emergency registered nurse licence issued under subsection 17(3),

(iii)

an emergency registered psychiatric nurse licence issued under subsection 17(4), or

(iv)

an emergency nurse practitioner licence issued under subsection 17(5);

(d)

"employer sponsor" means

an approved employer, or a representative of an approved employer, who provides undertakings or confirmations, satisfactory to the college, respecting certain aspects of a person's employment with the approved employer;

(e)

"licensing year" means the 12-month period beginning on a date set by the board;

(f)

"Provincial Health Authority" means the Provincial Health Authority established under the Provincial Health Authority Act ;

(g)

"temporary licence" means

(

i) a temporary licensed practical nurse licence issued under

section 12,

(ii)

a temporary registered nurse licence issued under

section 13,

(iii)

a temporary registered psychiatric nurse licence issued under

section 14, or

(iv)

a temporary nurse practitioner licence issued under

section 15; and

(h)

"virtual care" means

the practice of nursing or the practice of psychiatric nursing using any means of communication, where the person providing the nursing or psychiatric nursing care and that person's patient are

not in the same location.

(2) In the Act and these regulations

"year" means 12 months.

PART I

LICENCE REQUIREMENTS

Licence requirements licensed practical nurse

(1) In addition to the requirements in subsection 14(2) of the Act, a person applying for a licensed practical nurse licence shall

provide proof, satisfactory to the college, that the person

(

a) has successfully completed the educational requirements and examinations

for a licensed practical nurse licence, required under paragraph 14(2)(

b) of the Act, within the 3-year period immediately preceding the person's application for a licence;

(

b) has practised, or will have practised, as a licensed practical nurse for

(

i) a minimum of 450 hours in the 2-year period immediately preceding the licensing year for which the person is applying for a licence, or

(ii)

a minimum of 1125 hours in the 5-year period immediately preceding the licensing year for which the person is applying for a licence;

(

c) has successfully completed a refresher program for licensed practical nurses, approved by the board, within the 3-year period immediately preceding the person's application for a licence;

(

d) is enrolled and participating in a baccalaureate, graduate or doctoral program in nursing or in a health-related discipline, satisfactory to the college, and at the date of admission to the program was eligible for a licensed practical nurse licence.

(2) For the purposes of paragraph (1)(b), a person may include hours in which the person engaged in education, research, administration, management, policy and regulation relevant to the practice of nursing.

Licence requirements registered nurse

(1)In addition to the requirements in subsection 14(2) of the Act, a person applying for a registered nurse licence shall provide proof, satisfactory to the college, that the person

(

a) has successfully completed the educational requirements and examinations

for a registered nurse licence, required under paragraph 14(2)(

b) of the Act, within the 3-year period immediately preceding the person's application for a licence;

(

b) has practised, or will have practised, as a registered nurse for

(

i) a minimum of 450 hours in the 2-year period immediately preceding the licensing year for which the person is applying for a licence, or

(ii)

a minimum of 1125 hours in the 5-year period immediately preceding the licensing year for which the person is applying for a licence;

(

c) has successfully completed a refresher program for registered nurses, approved by the board, within the 3-year period immediately preceding the person's application for a licence; or

(

d) is enrolled and participating in a baccalaureate, graduate or doctoral program in nursing or in a health-related discipline, satisfactory to the college, and at the date of admission to the program was eligible for a registered nurse licence .

(2) For the purposes of paragraph (1)(b), a person may include hours in which the person engaged in education, research, administration, management, policy and regulation relevant to the practice of nursing.

Licence requirements registered psychiatric nurse

(1) In addition to the requirements in subsection 14(2) of the Act, a person applying for a registered psychiatric nurse licence shall provide proof, satisfactory to the college, that the person

(

a) has successfully completed the educational requirements and examinations

for a registered psychiatric nurse licence, required under paragraph 14(2)(

b) of the Act, within the 3-year period immediately preceding the person's application for a licence;

(

b) has practised, or will have practised, as a registered psychiatric nurse for

(

i) a minimum of 450 hours in the 2-year period immediately preceding the licensing year for which the person is applying for a licence , or

(ii)

a minimum of 1125 hours in the 5-year period immediately preceding the licensing year for which the person is applying for a licence;

(

c) has successfully completed a refresher program for registered psychiatric nurses, approved by the board, within the 3-year period immediately preceding the person's application for a licence; or

(

d) is enrolled and participating in a baccalaureate, graduate or doctoral program in psychiatric nursing or in a health-related discipline, satisfactory to the college, and at the date of admission to the program was eligible for a registered psychiatric nurse licence.

(2) For the purposes of paragraph (1)(b), the person may include hours in which the person engaged in education, research, administration, management, policy and regulation relevant to the practice of psychiatric nursing.

Licence requirements nurse practitioner

(1)In addition to the requirements in subsection 14(2) of the Act, a registered nurse applying for a nurse practitioner licence shall provide proof, satisfactory to the college, that the registered nurse

(

a) has successfully completed the educational requirements and examinations

for a nurse practitioner licence, required under paragraph 14(2)(

b) of the Act, within the 3-year period immediately preceding the application for a licence;

(

b) has practised, or will have practised, as a nurse practitioner for a minimum of 900 hours in the 3-year period immediately preceding the licensing year for which the person is applying for a licence;

(

c) has successfully completed a refresher program for nurse practitioners, approved by the board, within the 3-year period immediately preceding the application for a licence; or

(

d) is enrolled and participating in a baccalaureate, graduate or doctoral program in nursing or in a health-related discipline, satisfactory to the college, and at the date of admission to the program was eligible for a nurse practitioner licence.

(2) For the purposes of paragraph (1)(b), a registered nurse may include hours in which the registered nurse engaged in education, research, administration, management, policy and regulation relevant to the practice of nursing as a nurse practitioner.

Other licence requirements

In addition to the requirements in subsection 14(2) of the Act and in

section 3, 4, 5 or 6, as applicable, a person applying for a licence shall

(

a) provide identification documents, including photo identification, satisfactory to the college;

(b)

(

c) provide evidence, satisfactory to the college, that the person is of good character

; and

(

d) provide other documentation requested by the college.

Authority to prescribe

(1) A registered nurse licence may include the authority to prescribe where the registered nurse who is applying for authority to prescribe provides the following:

(

a) proof, satisfactory to the college, of the successful completion of a registered nurse prescribing education program approved by the board;

(

b) confirmation, satisfactory to the college, from an employer sponsor that

(

i) the registered nurse is employed by an approved employer, and

(ii)

the employer sponsor supports the addition of the authority to prescribe to the registered nurse's licence, for the purposes of employment with the approved employer in a designated practice setting; and

(

c) a declaration from the registered nurse stating that the registered nurse will only prescribe in accordance with the standards established by the board.

(2) A registered psychiatric nurse licence may include the authority to prescribe where the registered psychiatric nurse who is applying for authority to prescribe provides the following:

(

a) proof, satisfactory to the college,

of the successful completion of a registered psychiatric nurse prescribing education program approved by the board;

(

b) confirmation, satisfactory to the college, from an employer sponsor that

(

i) the registered psychiatric nurse is employed by an approved employer, and

(ii)

the employer sponsor supports the addition of the authority to prescribe to the registered psychiatric nurse's licence, for the purposes of employment with the approved employer in a designated practice setting; and

(

c) a declaration from the registered psychiatric nurse stating that the registered psychiatric nurse will only prescribe in accordance with the standards established by the board.

Failure of examination

The board

(

a) shall determine the number of times a person may write the licensing examination for each type of licence; and

(b)

Licence term and renewal

(1)A licence may be issued for a term of not more than one year and is valid from the date the licence is issued or renewed to the last day of the licensing year, unless suspended or revoked earlier.

(2) The college may renew a licence where the registrant

(

a) submits a completed application for renewal in the form approved by the college;

(

b) provides proof, satisfactory to the college, that the registrant continues to have professional liability insurance coverage in a form and amount satisfactory to the college;

(

c) provides proof, satisfactory to the college, that the registrant has complied with the continuing professional development requirements as approved by the board;

(

d) provides proof, satisfactory to the college, that the registrant's licence or registration in another jurisdiction has not been revoked, suspended or restricted or has conditions attached by reasons of disciplinary measures in another jurisdiction, where the registrant is currently, or was previously, licensed or registered in another jurisdiction;

(

e) where requested by the college, provides proof, satisfactory to the college, that the registrant has complied with all terms, conditions and restrictions set out in the licence;

(

f) provides proof, satisfactory to the college, that the registrant continues to satisfy the requirements in subsection 3(1), 4(1), 5(1) or 6(1), as applicable;

(

g) provides evidence, satisfactory to the college, that the person is of good character; and

(

h) pays

(

i) the licensing fee set by the board, and

(ii)

any outstanding amounts that are owed to the college.

(3) Notwithstanding paragraph (2)(d), the college may renew the licence of a registrant whose licence or registration in another jurisdiction has been revoked, suspended or restricted or has conditions attached by reasons of disciplinary measures in the other jurisdiction where

(

a) the registrant provides details of any revocation or suspension of or restriction or conditions on the persons licence or registration in the other jurisdiction;

(

b) the college is satisfied, after consideration of the details provided under paragraph (a), that the registrant is entitled to have the registrant's licence renewed; and

(

c) the registrant satisfies the other requirements in this section.

(4) Notwithstanding paragraph (2)(f), a registrant to whom paragraph 3(1)(d), 4(1)(d), 5(1)(

d) or 6(1)(

d) applies shall not be entitled to a renewal of the registrant's licence where the registrant is enrolled and participating in a program referred to in paragraph 3(1)(d), 4(1)(d), 5(1)(

d) or 6(1)(d), as applicable, for more than 5 years.

(5) Where a registered nurse licence or a registered psychiatric nurse licence includes authority to prescribe, the registered nurse or registered psychiatric nurse shall, in addition to the other renewal requirements, provide confirmation, satisfactory to the college, that

(

a) the registered nurse or registered psychiatric nurse continues to be employed by an approved employer;

(

b) the registered nurse's or registered psychiatric nurse's employer sponsor continues to support the addition of the authority to prescribe to the registered nurse's or registered psychiatric nurse's licence; and

(

c) the registered nurse or registered psychiatric nurse will only prescribe in accordance with the standards established by the board.

(6) Upon renewal of a registrant's licence, the college may attach or amend

(

a) the terms, conditions or restrictions on the licence; and

(

b) the scope of practice of the registrant.

(7) At any time after the date of expiry of a licence, the registrar may notify any person, entity or organization that the registrar considers appropriate, that

(

a) a licensed practical nurse's licence is expired

and that the licensed practical nurse is not entitled to engage in the practice of nursing;

(

b) a registered nurse's licence is expired

and that the registered nurse is not entitled to engage in the practice of

nursing;

(

c) a registered psychiatric nurse's licence is expired and that the registered psychiatric nurse is not entitled to engage in the practice of psychiatric nursing; or

(

d) a nurse practitioner's licence is expired

and that the nurse practitioner is not entitled to engage in the practice of nursing.

Exemptions

(1)Notwithstanding any other provisions in the Act and these regulations, a person who is licensed to engage in the practice of nursing or the practice of psychiatric nursing in another province or territory of Canada is exempt from the requirement to be licensed under the Act to engage in the practice of nursing or the practice of psychiatric nursing in the province where one of the following applies:

(

a) the college is notified of the person's intention to practice in the province and is satisfied that

(

i) the person's licence

in the other province or territory is equivalent to a licence

issued under

section 14 of the Act, and

(ii)

the person satisfies the following criteria:

(

A) the person is permitted to practise in the intended scope of practice in the province or territory where the person is licensed,

(

B) the person carries professional liability insurance which meets the requirements of the college for the person's intended practice of nursing or practice of psychiatric nursing in the province,

(

C) the person

(

I) limits the person's practice of nursing or practice of psychiatric nursing in the province to virtual care for a maximum of 90 days in a year, and

(II)

is not located in the province when providing the virtual care, and

(

D) the person has no outstanding disciplinary matters; or

(

b) the person

( i

is providing nursing or psychiatric nursing care as a member of the Canadian Armed Forces, an employee of the Department of National Defence, or as a person providing nursing or psychiatric nursing services under a contract or subcontract with the Canadian Armed Forces,

(ii)

limits the person's practice of nursing or practice of psychiatric nursing to the person's responsibilities as a member of the Canadian Armed Forces, an employee of the Department of National Defence, or the duties outlined in the person's contract or sub-contract with the Canadian Armed Forces, and

(iii)

satisfies the criteria in clauses (a)(ii)(

A) and (B).

(2) A person who is licensed to engage in the practice of nursing or the practice of psychiatric nursing in another jurisdiction is exempt from the requirement to be licensed under the Act to engage in the practice of nursing or the practice of psychiatric nursing in the province where one of the following applies:

(

a) the person is engaging in either of the following activities for a maximum of 28 consecutive days and for a maximum cumulative period of 90 days in a year:

( i

providing or participating in continuing professional development that does not involve direct patient care, or

(ii)

providing education or training that does not involve direct patient care; or

(

b) the person

( i

is providing either of the following services for a maximum of 28 consecutive days and for a maximum cumulative period of 90 days in a year:

(

A) nursing or psychiatric nursing consultative services, or

(

B) nursing or psychiatric nursing care for a person who is temporarily in the province,

(ii)

satisfies the criteria in clauses (1)(a)(ii)(

A) and (B), and

(iii)

does not have any outstanding disciplinary matters.

PART II

TEMPORARY AND EMERGENCY LICENCES

Temporary licensed practical nurse licence

(1) The college may issue a temporary licensed practical nurse licence to

(

a) a person who has not written, or is awaiting the results of, the required licensing examination for a licensed practical nurse licence, where the person satisfies all other licensing requirements for a licensed practical nurse licence under the Act and these regulations;

(

b) a person who has completed the educational requirements and examinations required for a licensed practical nurse licence under paragraph 14(2)(

b) of the Act, but does not satisfy any of the requirements in subsection 3(1), where the person

( i

satisfies all other licensing requirements for a licensed practical nurse licence under the Act and these regulations, and

(ii)

provides confirmation, satisfactory to the college, from an employer sponsor that

(

A) the person will be employed by an approved employer, and

(

B) the employer sponsor undertakes to provide supervision for the person, satisfactory to the college, during the period of employment with the approved employer; or

(

c) a person who received basic nursing education outside Canada that did not include all the education or training required by the board for a licensed practical nurse licence, where the person

(

i) is in the process of completing the additional education and training required by the board, and

(ii)

the person satisfies all other licensing requirements for a licensed practical nurse licence under the Act and these regulations.

(2) Where the college issues a temporary licensed practical nurse licence

under subsection (1), the board shall set the requirements that the person is required to satisfy to be issued a licensed practical nurse licence , and the period in which the requirements shall be satisfied.

(3) Where a person who is issued a temporary licensed practical nurse licence

successfully completes the requirements set by the board within the time set by the board, the college may issue a licensed practical nurse licence

to the person.

(4) Where a person who is issued a temporary licensed practical nurse licence

does not successfully complete the requirements set by the board within the time set by the board, the person's temporary licensed practical nurse licence

shall expire and shall not be further extended or renewed.

Temporary registered nurse licence

(1)The college may issue a temporary registered nurse licence to

(

a) a person who has not written, or is awaiting the results of, the required licensing examination for a registered nurse licence, where the person satisfies all other licensing requirements for a registered nurse licence under the Act and these regulations;

(

b) a person who has completed the educational requirements and examinations required for a registered nurse licence under paragraph 14(2)(

b) of the Act, but does not satisfy any of the requirements in subsection 4(1), where the person

(

i) satisfies all other licensing requirements for a registered nurse licence under the Act and these regulations, and

(ii)

provides confirmation, satisfactory to the college, from an employer sponsor that

(

A) the person will be employed by an approved employer, and

(

B) the employer sponsor undertakes to provide supervision for the person, satisfactory to the college, during the period of employment with the approved employer; or

(

c) a person who received basic nursing education outside Canada that did not include all the education or training required by the board for a registered nurse licence where the person

(

i) is in the process of completing the additional education and training required by the board, and

(ii)

the person satisfies all other licensing requirements for a registered nurse licence under the Act and these regulations.

(2) Where the college issues a temporary registered nurse licence

under subsection (1), the board shall set the requirements that the person is required to satisfy to be issued a registered nurse licence , and the period in which the requirements shall be satisfied.

(3) Where a person who is issued a temporary registered nurse licence

successfully completes the requirements set by the board within the time set by the board, the college may issue a registered nurse licence

to the person.

(4) Where a person who is issued a temporary registered nurse licence

does not successfully complete the requirements set by the board within the time set by the board, the person's temporary registered nurse licence

shall expire and shall not be further extended or renewed.

Temporary registered psychiatric nurse licence

(1)The college may issue a temporary registered psychiatric nurse licence to

(

a) a person who has not written, or is awaiting the results of, the required licensing examination for a registered psychiatric nurse licence, where the person satisfies all other licensing requirements for a registered psychiatric nurse licence under the Act and these regulations;

(

b) a person who has completed the educational requirements and examinations required for a registered psychiatric nurse licence under paragraph 14(2)(

b) of the Act, but does not satisfy any of the requirements in subsection 5(1), where the person

(

i) satisfies all other licensing requirements for a registered psychiatric nurse licence under the Act and these regulations, and

(ii)

provides confirmation, satisfactory to the college, from an employer sponsor that

(

A) the person will be employed by an approved employer, and

(

B) the employer sponsor undertakes to provide supervision for the person, satisfactory to the college, during the period of employment with the approved employer; or

(

c) a person who received basic psychiatric nursing education outside Canada that did not include all the education or training required by the board for a registered psychiatric nurse licence where the person

(

i) is in the process of completing the additional education and training required by the board, and

(ii)

satisfies all other licensing requirements for a registered psychiatric nurse licence under the Act and these regulations.

(2) Where the college issues a temporary registered psychiatric nurse

licence

under subsection (1), the board shall set the requirements that the person is required to satisfy to be issued a registered psychiatric nurse licence , and the period in which the requirements shall be satisfied.

(3) Where a person who is issued a temporary registered psychiatric nurse licence

successfully completes the requirements set by the board within the time set by the board, the college may issue a registered psychiatric nurse licence

to the person.

(4) Where a person who is issued a temporary registered psychiatric nurse licence

does not successfully complete the requirements set by the board within the time set by the board, the person's temporary registered psychiatric nurse licence

shall expire and shall not be further extended or renewed.

Temporary nurse practitioner licence

(1)The college may issue a temporary nurse practitioner licence to

(

a) a registered nurse who has not written, or is awaiting the results of, the required licensing examination for a nurse practitioner licence, where the registered nurse satisfies all other licensing requirements for a nurse practitioner licence under the Act and these regulations; or

(

b) a registered nurse who has completed the educational requirements and examinations required for a nurse practitioner licence under paragraph 14(2)(

b) of the Act, but does not satisfy any of the requirements in subsection 6(1), where the registered nurse

(

i) satisfies all other licensing requirements for a nurse practitioner licence under the Act and these regulations, and

(ii)

provides confirmation, satisfactory to the college, from an employer sponsor that

(

A) the person will be employed by an approved employer, and

(

B) the employer sponsor undertakes to provide supervision for the person, satisfactory to the college, during the period of employment with the approved employer.

(2) here the college issues a temporary nurse practitioner licence

under subsection (1), the board shall set requirements that the

registered nurse

is required to satisfy to be issued a nurse practitioner licence , and the period in which the requirements shall be satisfied.

(3) Where a

registered nurse

who is issued a temporary nurse practitioner licence

successfully completes the requirements set by the board within the time set by the board, the college may issue a nurse practitioner licence

to the registered nurse.

(4) Where a

registered nurse

who is issued a temporary nurse practitioner licence

does not successfully complete the requirements set by the board within the time set by the board, the registered nurse's temporary nurse practitioner licence

shall expire and shall not be further extended or renewed.

Temporary licence term and renewal

A temporary licence may be

(

a) issued for a term of not more than one year and is valid for the period set out in the licence, unless suspended or revoked earlier; and

(

b) renewed for additional terms, but a person shall not hold a temporary licence for more than 2 years from the date the temporary licence was first issued.

Emergency licences

(1) Where the registrar or the board determines that there is an immediate need for nursing services or psychiatric nursing services due to an actual or potential threat to public safety, health or welfare or where the minister or the federal Minister of Health makes a request, the registrar may issue an emergency licence.

(2) A person may be issued an emergency licensed practical nurse licence

for a period

determined by the registrar or the board where the person provides proof, satisfactory to the registrar or the board, that the person

(

a) is licensed or registered to engage in the practice of nursing in another jurisdiction in Canada;

(

b) previously held a licensed practical nurse licence; or

(

c) has successfully completed a nursing education program, satisfactory to the board, in Canada, not more than one year before applying for an emergency licence, and has either

(

i) not written the required licensing examination for a licensed practical nurse licence, or

(ii)

has successfully completed the examination referred to in subparagraph (

i) but has never held a licensed practical nurse licence.

(3) A person may be issued an emergency registered nurse licence

for a period

determined by the registrar or the board where the person provides proof, satisfactory to the registrar or the board, that the person

(

a) is licensed or registered to engage in the practice of nursing in another jurisdiction in Canada;

(

b) previously held a registered nurse licence; or

(

c) has successfully completed a nursing education program, satisfactory to the board, in Canada, not more than one year before applying for an emergency licence, and has either

(

i) not written the required licensing examination for a registered nurse licence, or

(ii)

has successfully completed the examination referred to in subparagraph (

i) but has never held a registered nurse licence.

(4) A person may be issued an emergency registered psychiatric nurse licence for a period determined by the registrar or the board where the person provides proof, satisfactory to the registrar or the board, that the person

(

a) is licensed or registered to engage in the practice of psychiatric nursing in another jurisdiction in Canada;

(

b) previously held a registered psychiatric nurse licence; or

(

c) has successfully completed a psychiatric nursing education program, satisfactory to the board, in Canada, not more than one year before applying for an emergency licence, and has either

(

i) not written the required licensing examination for a registered psychiatric nurse licence, or

(ii)

has successfully completed the examination referred to in subparagraph (

i) but has never held a registered psychiatric nurse licence.

(5) A person may be issued an emergency nurse practitioner licence for a period determined by the registrar or the board where the person provides proof, satisfactory to the registrar or the board, that the person

(

a) is licensed or registered to practice as a nurse practitioner in another jurisdiction in Canada;

(

b) previously held a nurse practitioner licence; or

(

c) has successfully completed a nurse practitioner education program, satisfactory to the board, in Canada, not more than one year before applying for an emergency licence, and has either

(

i) not written the required licensing examination for a nurse practitioner licence, or

(ii)

has successfully completed the examination referred to in subparagraph (

i) but has never held a nurse practitioner licence.

(6) In addition to the requirements in subsection (2), (3), (4) or (5), as applicable, a person shall satisfy the following requirements in order to

be issued an emergency licence:

(

a) provide proof, satisfactory to the registrar or the board, that the persons licence or registration in another jurisdiction has not been revoked, suspended or restricted or has conditions attached by reasons of disciplinary or other regulatory measures in another jurisdiction;

(

b) provide proof of identification as required by the registrar or the board; and

(

c) satisfy any other requirements that the registrar or the board may determine are necessary and practicable in the circumstances.

(7) An emergency licence may be renewed as considered necessary by the registrar or the board.

(8) The registrar or the board may impose terms, conditions or restrictions on an emergency licence.

(9) The registrar or the board may terminate an emergency licence at any time.

PART III

SCOPE OF PRACTICE

Authority of registered nurses and registered psychiatric nurses who have authority to prescribe

A registered nurse or registered psychiatric nurse whose licence includes authority to prescribe may, in accordance with the standards established by the board,

(

a) prescribe a drug;

(

b) order laboratory or other tests; and

(

c) make referrals to other health professions, including medical practitioners licensed under the Medical Act, 2011.

Authority of nurse practitioners

(1)A nurse practitioner may, in accordance with the standards established by the board,

(

a) prescribe a drug;

(

b) order diagnostic imaging; and

(

c) order laboratory or other tests.

(2) The board may establish categories of nurse practitioners and the standards and scope of practice for each category.

Alternative dispute resolution

(1)Where the complaints authorization committee refers an allegation to the registrar for alternative dispute resolution, the alternative dispute resolution shall be conducted in accordance with the policy established by the board.

(2) Alternative dispute resolution shall not be conducted unless the complainant and respondent consent to it in writing.

(3) The registrar may appoint those other persons the registrar considers necessary to assist in the alternative dispute resolution process.

(4) Where the allegation is not resolved through alternative dispute resolution or where, in the opinion of the registrar, the allegation is unsuitable for alternative dispute resolution, the registrar shall refer the allegation back to the complaints authorization committee.

Approved education programs

(1) The board shall approve education programs for licensed practical nurses, registered nurses, registered psychiatric nurses and nurse practitioners in accordance with subsection (2).

(2) An education program shall only be approved by the board where the program meets the standards and criteria established by the board, including the provision of clinical, laboratory and theoretical experience necessary to

(

a) meet standards of practice for each type of registrant; and

(

b) achieve the boards required competencies for each type of registrant.

Transitional licensed practical nurse licence

(1) Notwithstanding subsection 3(1), a person who does not satisfy a requirement in subsection 3(1) may be issued a licensed practical nurse licence

where the person

(

a) applies

for a licensed practical nurse licence

before April 15, 2028;

(

b) provides proof,

satisfactory to the college,

that the person has successfully completed the educational requirements and examinations required for a licensed practical nurse licence

under paragraph 14(2)(

b) of the Act or a refresher course for licensed practical nurses approved by the board, within the 5-year period immediately preceding the person's application for a licence ; and

(

c) satisfies all other licensing requirements for a licensed practical nurse licence under the Act and these regulations

(2) Notwithstanding paragraph 10(2)(f), a person who does not satisfy a requirement in subsection 3(1) may be entitled to a renewal of the person's licensed practical nurse licence

where the person

(

a) applies for the renewal of the licensed practical nurse licence

before April 15, 2028;

(

b) provides proof, satisfactory to the college, that the person satisfies the requirements in paragraph 22(1)(b); and

(

c) satisfies the other requirements in subsection 10(2).
