whereas the Nova Scotia Utility and Review Board (“Board”) considered the manner in which it would proceed to set petroleum product prices in its decision, 2006 NSUARB 108, issued on October 16, 2006; And

whereas the Board revised the retail margin and transportation allowance effective January 6, 2012, in its decision, 2011 NSUARB 181, issued on November 23, 2011; And

whereas the Board revised the wholesale margin effective January 4, 2013, in its decision, 2012 NSUARB 213, issued on December 12, 2012; And

whereas the average of the average of the daily high and low reported product prices (in Canadian cents) for the week ended January 13, 2016, are: Grade 1 Regular gasoline 42.2¢ per litre Ultra-low-sulfur diesel oil 36.4¢ per litre

Schedule “A” Regulations Respecting Fees for Laboratory Services made under

Section 195 of

Chapter 6 of the Revised Statutes of Nova Scotia 1989, the Agriculture and Marketing Act Citation 1 These regulations may be cited as the Laboratory Services Fees Regulations.

Definitions 2 In these regulations, “Department laboratory” means a laboratory operated by the Department, and includes all of the following: (

i) analytic services laboratory, (ii) animal health services laboratory, (iii) dairy services laboratory. “livestock animal” means any of the following: (

i) cattle, (ii) sheep, (iii) goats, (iv) poultry, (

v) rabbits raised for meat production, (vi) llamas, (vii) alpacas, (viii) fur-bearing animals from a fur farm licensed under the Fur Industry Act, (ix) deer farm animals from a deer farm licensed under the Wildlife Act, (

x) wildlife from a game farm licensed under the Wildlife Act; “regular hours of operation” means the period between 8:30 a.m. to 4:30 p.m., Monday to Friday, excluding holidays, during which the Department laboratory is open. “related animals” means carcasses of livestock animals that (

i) were of the same general age and exhibited the same disease symptoms, and (ii) are submitted for testing services by an owner on the same day. 238 © NS Office of the Registrar of Regulations. Web version.

(1) The fees for tests carried out, on request, either immediately or outside regular hours of operation are as follows: (

a) for a test carried out immediately, but within the regular hours of operation, 2 times the fee set out in these regulations for the test; (

b) for a test carried out outside the regular hours of operation, the fee set out in these regulations for the test, plus an additional fee of $126.00. Fees for tests not listed 13 If a test is required that is not identified in these regulations, the fee for the test is based on the cost of labour and materials to perform the test. Fees for registered farms 14 Despite Sections 6, 7, and 8, a fee payable under any of those Sections by a farm business or a farm operation that holds a valid farm registration number under the Farm Registration Act is 50% of the fee prescribed. Fees for referred testing 15

(1) The Department may refer testing to a laboratory not operated by the Department.

(2) The fee for testing that is carried out by a laboratory referred under subsection (1) is the sum of all of the following: (

a) the actual cost of the test; (

b) a handling fee of $4.00; (

c) shipping costs. N.S. Schedule “A” Amendment to the Reporting of Notifiable Diseases and Conditions Regulations made by the Governor in Council under Sections 74 and 106 of

Chapter 4 of the Acts of 2004, the Health Protection Act 1 Subsection 2(4) of the Reporting of Notifiable Diseases and Conditions Regulations , N.S. Reg. 195/2005, made by the Governor in Council by Order in Council 2005-457 dated October 14, 2005, is repealed and the following subsection substituted:

(4) For the purpose of subsection 31(5) of the Act, “an illness is serious and is occurring at a higher rate than is normal” refers to any of the following: (

a) a disease occurring more frequently than would normally be expected or in a rare or unusual form; (

b) an unusual disease cluster; (

c) a disease outbreak; (

a) amend the Minimum Wage Order (General), N.S. Reg. 5/99, made by the Governor in Council by Order in Council 1999-56 dated February 17, 1999, to specify the means by which the projected annual Consumer Price Index is determined and remove spent provisions in the manner set forth in

Schedule “A” attached to and forming part of the report and recommendation; (

b) amend the Minimum Wage Order (Construction and Property Maintenance) , N.S. Reg. 202/2003, made by the Governor in Council by Order in Council 2003-507 dated November 28, 2003, to specify the means by which the projected annual Consumer Price Index is determined and remove spent provisions in the manner set forth in

Schedule “B” attached to and forming part of the report and recommendation; and (

c) amend the Minimum Wage Order (Logging and Forest Operations), N.S. Reg. 5/99, made by the Governor in Council by Order in Council 1999-56 dated February 17, 1999, to specify the means by which the projected annual Consumer Price Index is determined and remove spent provisions in the manner set forth in

b) adding the following definition immediately following the definition of “inexperienced employee’: “projected annual Consumer Price Index” means the estimate of the annual Consumer Price Index for a given year calculated by adding the Consumer Price Index values for the months of January through November in the year preceding the year for which the estimate is to be determined and dividing the sum by 11. 2 (1) Subsections 6(1) and (2) of the regulations are repealed. (2) Subsection 6(3) of the regulations is amended by striking out “April 1, 2013, and on and after every April 1 thereafter,” and substituting “every April 1”. 3 Subsection 6A(1) of the regulations is amended by striking out “subsection 6(2) or (3)” and substituting “subsection 6(3)”. 4 Subsection 8(3) of the regulations is amended by striking out “board or lodging” and substituting “board and lodging”.

Whereas the purpose of the Petroleum Products Pricing Regulations is to ensure just and reasonable prices for specified petroleum products taking into consideration the objectives of preserving the availability of such products in rural areas, stabilizing prices of such products and minimizing the variances in prices of such products across the Province; And

whereas the Nova Scotia Utility and Review Board (“Board”) considered the manner in which it would proceed to set petroleum product prices in its decision, 2006 NSUARB 108, issued on October 16, 2006; And

whereas the Board revised the retail margin and transportation allowance effective January 6, 2012, in its decision, 2011 NSUARB 181, issued on November 23, 2011; And

whereas the Board revised the wholesale margin effective January 4, 2013, in its decision, 2012 NSUARB 213, issued on December 12, 2012; And

whereas the average of the average of the daily high and low reported product prices (in Canadian cents) for the week ended January 20, 2016, are: Grade 1 Regular gasoline 41.1¢ per litre Ultra-low-sulfur diesel oil 34.6¢ per litre

Now therefore the Board prescribes the benchmark prices for petroleum products to be: Gasoline: Grade 1 41.1¢ per litre Grade 2 44.1¢ per litre Grade 3 47.1¢ per litre Ultra-low-sulfur diesel oil 34.6¢ per litre And

now therefore the Board has determined, based on historical data regarding price changes and to achieve revenue neutrality, it is appropriate to apply, and the Board so orders, forward averaging corrections of: Gasoline: minus 1.1¢ per litre Ultra-low-sulfur diesel oil: minus 1.9¢ per litre And

whereas a winter blending adjustment of plus 9.0¢ per litre is required for ultra-low-sulfur diesel oil; And

now therefore the Board prescribes the prices for petroleum products as set forth in
