I, Barry Penner, Minister of Environment, order that, effective July 2, 2008,
(
a) the Closed Areas Regulation, B.C. Reg. 76/84, is amended as set out in the attached Appendix 1,
(
b) the Management Unit Regulation, B.C. Reg. 64/96, is amended as set out in the attached Appendix 2,
(
c) the Motor Vehicle Prohibition Regulation, B.C. Reg. 196/99, is amended as set out in the attached Appendix 3,
(
d) the Wildlife Act Commercial Activities Regulation, B.C. Reg. 338/82, is amended as set out in the attached Appendix 4,
(
e) the Hunting Regulation, B.C. Reg. 190/84, is amended as set out in the attached Appendix 5, and
(
f) the Limited Entry Hunting Regulation, B.C. Reg. 134/93, is amended as set out in the attached Appendix 6.

Appendix 1
Section 32 of
Schedule 5 of the Closed Areas Regulation, B.C. Reg. 76/84, is amended by striking out
"northern boundary of the right of way of the B.C. Hydro powerline; thence westerly along said right of way boundary to the point of intersection with the natural boundary of the Jordan River"
and substituting
"northern boundary of the right of way of the B.C. Hydro powerline; thence westerly along said right of way boundary to the point of intersection with Young Lake Road, then generally North and perpendicular to said right of way for a distance of 800 m, then generally west paralleling said right of way to the point of intersection with the East bank of Tugwell Creek, then generally South following the East bank of Tugwell Creek to the intersection with the North boundary of the right of way of said powerline, then generally westerly along said right of way to the point of intersection with the natural boundary of the Jordan River".
Appendix 2
1 The Management Unit Regulation, B.C. Reg. 64/96, is amended by repealing the map titled "South Western British Columbia" and substituting the attached map.
Appendix 3
1 The Motor Vehicle Prohibition Regulation, B.C. Reg. 196/99, is amended
(
a) in

5.1 The open season for hunting mule (black-tailed) deer bucks and white-tailed deer bucks with bow and arrow only in M.U.s 7-2 to 7-18, 7-23 to 7-30 and 7-37 to 7-41 is September 1 to September 9. ,

c) in
section 11 (3)
(
i) by striking out "7-51, 7-53 and 7-54" and substituting "and 7-51 to 7-54", and

c) of the Act , there is no open season on bull elk from September 1 to October 31 in Zone A of M.U. 7-20 as described in the Limited Entry Hunting Regulation,
Schedule II as shown on map 2008/2009 Elk Zone A of 7-20 unless the bull elk has at least one branched antler with at least 3 tines (points).
(13) For the purpose of
section 26 (1) (
c) of the Act , there is no open season on bull elk from September 1 to October 31 in M.U.s 7-22, 7-43 and 7-44, or those portions of M.U.s 7-20, 7-21, 7-45 and 7-46 located outside Zone A of M.U. 7-20 as described in the Limited Entry Hunting Regulation,
Schedule II as shown on map 2008/2009 Elk Zone A of 7-20, unless the bull elk has at least one branched antler with at least 6 tines (points). ,
(
e) in
section 12 by striking out "and Canada geese" and substituting ", Canada geese and cackling geese",
(
f) in
section 26 by repealing subsection (1) and substituting:
(1) Despite
Part 1 of
Schedule 7, and for the purposes of
section 26 (1) (
c) of the Act , a person may hunt antlerless elk in Zone A of M.U. 7-20, as described in the Limited Entry Hunting Regulation,
Schedule II as shown on map 2008/2009 Elk Zone A of 7-20 from September 15 to October 31. ,

g) in
section 27 by adding the following subsections:
(4) Despite
Part 1 of
Schedule 7, and for the purposes of
section 26 (1) (
c) of the Act , a person may hunt antlerless mule deer on private property and Crown land within 2 000 m of private property in M.U.s 7-02 to 7-05, 7-07 to 7-10, 7-12 to 7-15, 7-17 and 7-24 from November 10 to November 20.
(5) Despite
Part 1 of
Schedule 7, and for the purposes of
section 26 (1) (
c) of the Act , a person may hunt antlerless mule deer in Zone A of M.U. 7-20, as described in the Limited Entry Hunting Regulation,
Schedule II as shown on map 2008/2009 Elk Zone A of 7-20 from November 1 to November 30. , and
(
h) by adding the following section:
Antlerless white-tailed deer
(1) Despite
Part 1 of
Schedule 7, and for the purposes of
section 26 (1) (
c) of the Act , a person may hunt antlerless white-tailed deer on private property and Crown land within 2 000 m of private property in M.U.s 7-02 to 7-05, 7-07 to 7-10, 7-12 to 7-15, 7-17 and 7-24 from November 10 to November 20.
(2) Despite
Part 1 of
Schedule 7, and for the purposes of
section 26 (1) (
c) of the Act , a person may hunt antlerless white-tailed deer in Zone A of M.U. 7-20, as described in the Limited Entry Hunting Regulation,
Schedule II as shown on map 2008/2009 Elk Zone A of 7-20 from November 1 to November 30.
Part 3 of
Schedule 7 is amended in
section 1
(
a) by repealing subsection (1),
(
b) in subsection (1.2) by striking out "is 2" and substituting "is 1", and
(
c) by adding the following subsections:
(2.2) The bag limit for antlerless white-tailed deer in M.U.s 7-19 to 7-22, 7-31 to 7-36 and 7-42 to 7-58 is one.
(6) The bag limit for mule deer bucks in M.U.s 7-2 to 7-18, 7-23 to 7-30 and 7-37 to 7-41 is 1.
(7) The bag limit for mule deer bucks in M.U.s 7-19 to 7-22, 7-31 to 7-36 and 7-42 to 7-58 is 1.
(8) The aggregate bag limit for deer in M.U.s 7-19 to 7-22, 7-31 to 7-36 and 7-42 to 7-58 is 3.
(9) The aggregate bag limit for deer in M.U.s 7-2 to 7-58 is 3.
Part 1 of
Schedule 8 is repealed and the attached
Part 1 of
Schedule 8 is substituted.
