On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Compensation and Disaster Financial Assistance Regulation, B.C. Reg. 124/95, is amended as set out in the attached Appendix.

Appendix

Section 19 of the Compensation and Disaster Financial Assistance Regulation, B.C. Reg. 124/95, is amended

(

a) in subsection (3) by striking out " notify the Provincial Emergency Program that assistance will be sought. " and substituting " submit an application for assistance to the Provincial Emergency Program, along with all available documentation in support of the claim, including invoices for any essential goods or services acquired before the application was submitted. ",

(

b) by repealing subsections (4) and (5) and substituting the following:

(4) On receipt of an application under subsection (3), the Provincial Emergency Program must determine whether an applicant and the expenses claimed by the applicant are eligible for disaster financial assistance and must,

(

a) if the applicant is eligible and has eligible expenses, send the application, and the related documentation described in subsection (3), to the appointed adjuster, or

(

b) if the applicant is not eligible or does not have eligible expenses, notify the applicant of that determination. ,

(

c) in subsection (6) by striking out " subsection (5) must determine the amount of assistance the adjuster considers appropriate under this regulation and must notify the claimant of that determination " and substituting " subsection (4) (

a) must determine the amount of assistance the adjuster considers appropriate under this regulation and must notify the Provincial Emergency Program regarding the amount of assistance that the adjuster recommends ", and

(

d) by repealing subsections (7) and (8) and substituting the following:

(8) After receiving a notice from an adjuster under subsection (6), the Provincial Emergency Program must review the adjuster’s recommendation and must notify the applicant, in writing, of the results of that review and, if some or all of the claim has been accepted by the Provincial Emergency Program, of the amount of assistance that is to be provided to the applicant.

Section 33 is amended by repealing subsection (4) (a).

Section 35 is amended

(

a) by renumbering the

section as

section 35 (1), and

(

b) by adding the following subsection:

(2) For the purposes of this Part,

section 19 continues to apply as it read immediately before the date this subsection comes into force.
