AMENDMENT REGULATION

1 The Board of Reference Fees Regulation (AR 93/98) is

amended in

section 5 by striking out "October 31, 2013" and

substituting "August 31, 2015".

2 The Special School Tax Levy Plebiscite Regulation

(AR 94/98) is amended in

section 5 by striking out "October

31, 2013" and substituting "August 31, 2015".

Marketing of Agricultural Products Act

ALBERTA PORK PRODUCERS' PLAN AMENDMENT REGULATION

section 23 of the Marketing of Agricultural

Products Act.

1 The Alberta Pork Producers' Plan Regulation

(AR 219/2001) is amended by this Regulation.

Section 1 is amended

(

a) in subsection (1)

(

i) by repealing clause (g);

(ii) in clause (

j) by striking out "a hog" and

substituting "swine";

(iii) In clauses (

k) and (

l) by striking out "hogs"

wherever it appears and substituting "swine";

(iv) by repealing clause (

m) and substituting the

following:

(m) "producer" means

(

i) a person who owns swine or intends to own

swine and is engaged or intends to be

engaged in the production of swine

personally or for other persons;

(ii) a person who owns swine or intends to own

swine that are produced or are intended to be

produced for that person by another producer

or producers;

(iii) a person who takes possession of swine from

a producer under any security for a debt;

(iv) a person who under any arrangement,

including a contractual arrangement, is

entitled directly or indirectly to a share of

swine raised by a producer or any portion of

the revenue derived from the sale of the

swine;

(

v) in clause (o)(

i) by striking out "a hog" and

substituting "swine";

(vi) by adding the following after clause (o):

(p) "swine" means any member of the species Sus

scrofa that is commonly known as a domestic pig

or farmed wild boar.

(

b) in subsection (2) by striking out "hogs" and

substituting "swine".

Section 2 is amended by striking out "Hogs" and

substituting "Swine".

Section 5(

b) is amended by striking out "hogs" and

substituting "swine".

Section 6 is amended

(

a) by striking out "hog" wherever it appears and

substituting "swine";

(

b) by striking out "hogs" wherever it appears and

substituting "swine".

Section 8(b)(

v) is amended by striking out ", licensed

processor".

Section 8.1(2)(

b) is amended by striking out "hogs" and

substituting "swine".

Section 9 is amended

(

a) in clauses (

a) and (

b) by striking out "hogs"

wherever it appears and substituting "swine";

(

b) by repealing clauses (c), (

d) and (e);

(

c) in clause (f)(ii) by striking out "and licence fees, as the

case may be";

(

d) in clause (

g) by striking out "hogs" and substituting

"swine";

(

e) in clause (

h) by striking out ", licence fees".

Section 10 is amended by striking out "and licence fees".

Section 12 is repealed and the following is substituted:

Remuneration

12 The remuneration to be paid to the Chairperson of the

Corporation and Directors may be fixed from time to time by the

board of Directors.

Section 13 is repealed and the following is substituted:

Appointment of auditor

13 The auditor for the Corporation is to be appointed or selected, as

the case may be, from time to time in accordance with a motion

passed at an annual Commission meeting or a special Commission

meeting.

Section 16(

b) is amended by striking out ", the Directors

and the delegates" and substituting "and the Directors".

13 The heading after

section 21 is amended by striking out

"and Delegates".

Section 23 is repealed.

Section 25 is amended

(

a) by striking out "or a delegate" after "a Director";

(

b) in clause (b)

(

i) by striking out "Regional Director or a delegate" and

substituting "a Regional Director";

(ii) by striking out "Regional Director and delegates, as

the case may be" and substituting "Regional

Director".

Section 26 is amended

(

a) by striking out "or delegate" wherever it appears;

(

b) by striking out "hog" wherever it appears and

substituting "swine".

Section 27(1) and (3) are repealed.

Section 28 is amended by striking out "or a delegate".

Section 29 is amended

(

a) by repealing subsection (2);

(

b) in subsection (3) by striking out "or a delegate".

20 The heading after

section 29 is amended by striking out

"General".

Section 34(

c) is repealed.

22 The heading after

section 34 is amended by striking out

"Directors and Delegates Meetings" and substituting

"Commission Meetings".

Section 35 is repealed and the following is substituted:

Commission meetings

35(1) In each year there must be an annual commission meeting of

all the registered producers in Alberta.

(2) The annual commission meeting of the registered producers

must be held not later than 15 months following the date of the

conclusion of the last annual commission meeting of the registered

producers.

Section 36 is amended

(

a) in subsection (1)

(

i) by striking out "meetings of Directors and delegates"

and substituting "commission meetings";

(ii) in clause (b)(ii) by striking out "at least 1/3 of the

Directors and delegates" and substituting "not less

than 10% of the registered producers";

(

b) by repealing subsection (2).

Section 38 is repealed and the following is substituted:

Notice of meeting

38 The Commission shall notify the eligible producers of the

annual or special commission meeting at least 14 days before that

meeting is to be held specifying the date, time and place of the

meeting.

Section 39 is repealed and the following is substituted.

Quorum

39 The quorum for an annual or a special commission meeting of

the registered producers is 20 registered producers.

Section 40 is amended

(

a) by striking out "or a delegate" wherever it appears;

(

b) by repealing subsection (3);

(

c) in subsection (5) by striking out "or delegate".

Section 41 is amended

(

a) by striking out "or a delegate" wherever it appears;

(

b) in subsection (1)(

c) by striking out "or delegate";

(

c) in subsection (2)(

a) by striking out "delegate or";

(

d) in subsection (3(

b) by striking out "or as a delegate".

Section 42 is amended

(

a) in subsection (1) by striking out "and delegates";

(

b) by repealing subsection (2) and substituting the

following:

(2) Subject to

section 43.1, at each regional annual meeting,

each registered producer, on presenting the producer registration

card, is to receive one ballot for the purpose of voting for

(

a) the candidates for the positions of Regional Directors,

and

(

b) the candidates for the positions of Director at large.

(

c) in subsection (8)(

d) by striking out "hogs" and

substituting "swine".

Section 43 is amended

(

a) by repealing subsection (1)(b);

(

b) in subsection (2)(

a) by striking out "or any delegate".

Section 43.1(1) is amended by striking out "and 2

delegates" wherever it occurs.

Section 43.2 is amended by striking out "or a delegate"

wherever it appears.

Section 44 is amended

(

a) by striking out "and at least one delegate" wherever it

occurs;

(

b) in subsection (3) by striking out "or delegate".

Section 44.1 is amended by striking out "delegate,".

Section 45(2) is repealed.

Section 46 is amended by striking out "a Regional

Director, a Director at large or a delegate" and substituting "a

Regional Director or a Director at large".

Section 51 is repealed.
