An Act to Amend the Workers’ Compensation Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section 38.11 of the Workers’ Compensation Act,

chapter W-13 of the Revised Statutes, 1973, is amended (

a) by repealing subsection (4) and substitut- ing the following: 38.11(4) The Commission shall not pay compen- sation to a worker in respect of the period of time re- ferred to in subsection (3) except as provided for in subsection (5), (6), (7), (8), or (8.1). (

b) by adding after subsection (8) the follow- ing: 38.11(8.1) Where a peace officer or firefighter is injured in the course of his or her employment the Commission shall pay compensation in respect of the period of time referred to in subsection (3) un- less compensation is paid under subsection (5), (6), or (7). a) par l’abrogation du paragraphe (4) et son remplacement par ce qui suit: 38.11(4) La Commission ne peut pas indemniser un travailleur à l’égard de la période de temps à la- quelle il est référé au paragraphe (3) sauf tel que sti- pulé au paragraphe (5), (6), (7), (8) ou (8.1).

b) par l’adjonction suivant le paragraphe (8) de ce qui suit: 38.11(8.1) Lorsqu’un agent de la paix ou un pom- pier se blesse dans l’exercice de ses fonctions, la Commission doit l’indemniser dans le délai à la- quelle il est référé au paragraphe (3) à moins qu’il soit indemnisé en vertu du paragraphe (5), (6) ou (7).
