An Act to Amend the Consumer Product Warranty and Liability Act Loi modifiant la

Loi sur la responsabilité et les garanties relatives aux produits de consommation Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1 Subsection 27(1) of the Consumer Product Warranty and Liability Act,

chapter C-18.1 of the Acts of New Brunswick, 1978, is repealed and the following is sub- stituted: 1 Le paragraphe 27(1) de la

Loi sur la responsabilité et les garanties relatives aux produits de consommation,

chapitre 18.1 des Lois du Nouveau-Brunswick de 1978, est abrogé et remplacé par ce qui suit : 27(1) A supplier of a consumer product that is unrea- sonably dangerous to person or property because of a defect in design, materials or workmanship is liable to any person who suffers a consumer loss in the Province be- cause of the defect, if the loss was reasonably foreseeable at the time of the supply as liable to result from the defect and 27(1) Le fournisseur d’un produit de consommation qui est démesurément dangereux pour les personnes ou les biens en raison d’un vice de conception, de matière ou de fabrication répond du préjudice de consommation que su- bit une personne dans la province du fait de ce vice s’il en était le résultat prévisible au moment où il a fourni le pro- duit et s’il a fourni le produit, selon le cas : (

a) the supplier has supplied the consumer product in the Province;

a) à l’intérieur de la province; (

b) the supplier has supplied the consumer product outside the Province but has done something in the Province that contributes to the consumer loss suffered in the Province;

b) à l’extérieur de la province mais est intervenu dans la province de manière à y mener à un préjudice de consommation; (

c) the supplier has supplied the consumer product outside the Province but the defect arose in whole or in part because of the supplier’s failure to comply with any mandatory federal standards in relation to health or safety, or the defect caused the consumer product to fail to comply with any such standards; or

d) the supplier has supplied the consumer product outside the Province but at the time of the supply it was reasonably foreseeable that the product would be used or consumed in the Province.

Section 1 The existing provision is as follows:

Article 1 La disposition actuelle se lit comme suit : 27(1) A supplier of a consumer product that is unreasonably dan- gerous to person or property because of a defect in design, materials or workmanship is liable to any person who suffers a consumer loss in the Province because of the defect, if the loss was reasonably foreseeable at the time of his supply as liable to result from the defect and 27(1) Le fournisseur d’un produit de consommation qui est déme- surément dangereux pour les personnes ou les biens en raison d’un vice de conception, de matière ou de fabrication répond du préjudice de consommation que subit une personne dans la province du fait de ce vice s’il en était le résultat prévisible au moment de la conclusion du contrat et s’il a fourni le produit (

a) he has supplied the consumer product in the Province;
