B.C. Reg. 239/2001, deposited October 12, 2001, pursuant to the MOTOR DEALER ACT [Section 8.1]. Order in Council 904/2001, approved and ordered October 11, 2001.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective March 1, 2002, the Motor Dealer Act Regulation, B.C. Reg. 447/78, is amended by adding the following section:

Cost of Consumer Credit Disclosure Act powers

(1) For the purposes of

section 8.1 (2) of the Act, sections 44 to 46, 48, 49 and 53 of the Cost of Consumer Credit Disclosure Act are prescribed.

(2) Without limiting any other rights and powers of the registrar under the Act, the registrar may, in relation to the provisions referred to in subsection (1), exercise the rights and powers referred to in sections 4 (5), 5, 7 (1), 25 (3), 27 (1) to (3), 28 (1) and 31 of the Act and the rights and powers of the director under sections 63 to 67 and 71 (1) to (3) of the Consumer Protection Act.

(3) Sections 6, 7 (2), 8, 25 (1) and (2), 26, 27 (4) and (5), 28 (2) to (4), 29, 30, 33, 35 (1), except paragraphs (

a) and (b), and (

c) to (

e) and (2) to (4), 36 and 37 of the Act apply to the exercise by the registrar of any of the rights or powers referred to in subsection (2).

(4) Nothing in this

section precludes the application of sections 50 and 52 and 54 of the Cost of Consumer Credit Disclosure Act in relation to any matter in relation to which the registrar exercises any of the rights and powers referred to in subsection (2).

(5) Sections 68 to 70, 71 (4) and 72 to 74 of the Consumer Protection Act apply to the exercise by the registrar of any of the rights or powers referred to in subsection (2).
