ENVIRONMENTAL MANAGEMENT AMENDMENT ACT, 2022

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

CLAUSE 1: [Environmental Management Act,

section 107.1]

applies provisions of the Offence Act to searches under

section 107.03 (3) and authorizes detention of things seized during those searches for an initial period of up to a year;

applies restrictions on returning pollutants, environmental hazards and contaminated things to things seized during searches under

section 107.03 (3).

Section 107.1 of the Environmental Management Act, S.B.C. 2003, c. 53, is amended

(

a) in subsection (1) by striking out " anything seized by a conservation officer under

section 107.02 or 107.03 (2) " and substituting " anything seized by a conservation officer under

section 107.02 or 107.03 ", and

(

b) in subsection (3) by striking out " anything seized in a search under

section 107.02 or 107.03 (2) " and substituting " anything seized in a search under

section 107.02 or 107.03 ".

Commencement

2 This Act comes into force on the date of Royal Assent.
