B.C. Reg. 59/2003, deposited February 20, 2003, pursuant to the GAMING CONTROL ACT [Sections 17 (2), 104, 105 and 122]. Order in Council 162/2003, approved and ordered February 19, 2003.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective April 1, 2003,

(a) sections 14 (2) to (4), 15 to 17, 110 and 111 of the Gaming Control Act , S.B.C. 2002, c. 14, are brought into force by this regulation,

(

b) the Horse Racing Tax Regulation, B.C. Reg. 46/2000, is repealed,

(

c) the Gaming Control Regulation, B.C. Reg. 208/2002, is amended as set out in the attached Schedule, and

(

d) the Interest Rate under Various Statutes Regulation, B.C. Reg. 386/92, is amended in

section 1 by striking out " Horse Racing Tax Act ," and substituting " Gaming Control Act ,". — R. COLEMAN, Minister of Public Safety and Solicitor General; G. CAMPBELL, Presiding Member of the Executive Council.

Schedule

1 The Gaming Control Regulation, B.C. Reg. 208/2002, is amended by adding the following Part:

Part 11 — Horse Race Betting Fees

Prescribed organizations and prescribed proportions

41 For the purposes of

section 14 (2) (

c) of the Act, the following organizations are prescribed to receive payments each month in the following proportions:

(

a) Hastings Entertainment Inc., on behalf of the thoroughbred racing industry, the total amount paid by thoroughbred racetracks in British Columbia to the lottery corporation under

section 17 (1) (

c) of the Act, less any deductions required under

section 14 (2) (

a) and (

b) of the Act;

(

b) the B.C. Standardbred Breeders Society, on behalf of the standardbred racing industry, the total amount paid by standardbred racetracks in British Columbia to the lottery corporation under

section 17 (1) (

c) of the Act, less any deductions required under

section 14 (2) (

a) and (

b) of the Act;

(

c) TBC Teletheatre BC, on behalf of both the thoroughbred and standardbred racing industries, the total amount paid by TBC Teletheatre BC to the lottery corporation under

section 17 (1) (

c) of the Act, less any deductions required under

section 14 (2) (

a) of the Act.

Reporting obligations of operators

42 Operators collecting horse race betting fees must, under

section 17 (1) (

c) of the Act, pay the fees collected to the British Columbia Lottery Corporation on or before the last day of the first week of each month for each preceding month, together with a report of all money deposited, bets made and fees collected for that period.
