B.C. Reg. 348/2004, deposited July 23, 2004, pursuant to the FINANCIAL ADMINISTRATION ACT [Section 19] and the WATER ACT [Sections 26 and 45]. Order in Council 825/2004, approved and ordered July 22, 2004.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that

section 13 of the Water Regulation, B.C. Reg. 204/88, is amended

(

a) in

section 1 by adding the following definition:

"Act" means the Water Act ; , and

(

b) in

section 13 by adding the following subsection:

(3) Remission is authorized of a fee payable in respect of

(

a) an approval as defined in the Act, or

(

b) a permit issued under

section 26 of the Act given to the holder of an approval as defined in the Act, authorizing the flooding of Crown land or the construction, maintenance or operation on the land of works authorized under the approval,

if the approval is granted or the permit is issued by the Oil and Gas Commission under

section 17 of the Oil and Gas Commission Act .
