Ministerial Order No. 019/2022

(Irrigation Districts Act)

Irrigation District Amalgamation

WHEREAS a petition was made on December 17, 2021, under

section 75(

c) of the

Irrigation Districts Act, RS.A. 2000, c. I-11 (the "Act") for the amalgamation of

St. Mary River Irrigation District and Taber Irrigation District into one irrigation

district to be known as "St. Mary River Irrigation District";

WHEREAS, in accordance with

section 167(2) of the Act, the Irrigation Council

conducted a hearing in respect of the petition on March 21, 2022;

WHEREAS, pursuant to

section 172(1)(

d) of the Act, the Irrigation Council made a

recommendation to the Minister to grant the petition, as set out in a Notice of

Recommendation dated April 11, 2022;

WHEREAS

section 78(7) of the Act authorizes the Minister, on reviewing the

Council's recommendation, to grant the petition and make an order accordingly; and

WHEREAS

section 28 of the Act requires the Minister to appoint the first board of a

district formed under

Part 4 of the Act;

WHEREFORE, I, Nate Horner, Minister of Agriculture, Forestry and Rural Economic

Development, pursuant to

section 28,

section 78(7), and

section 79 of the Irrigation

Districts Act, make the following Ministerial Order:

1. St. Mary River Irrigation District ("SMRID") and Taber Irrigation District

("TID") are amalgamated into one irrigation district to be known as "St. Mary

River Irrigation District" (referred to in this Ministerial Order as the

"Amalgamated Irrigation District").

2. The address of the head office of the board of the Amalgamated Irrigation

District is 525, 40 Street South, Lethbridge, AB, T1J 4M1.

3. The expansion limit of the Amalgamated Irrigation District is set at

504,200 acres.

4. The parcels constituting the Amalgamated Irrigation District are the parcels that

constitute SMRID and the parcels that constitute TID as of the day before the

date this Ministerial Order comes into effect.

5. The following individuals are appointed as the first board of directors of the

Amalgamated Irrigation District, each for a term to expire one year from the date

this Ministerial Order comes into effect:

Brian Ober,

6. George Lohues and Cory Nelson are designated as Chair and Vice Chair of the

8. Any rights, property, obligations, or liabilities held by or valid against SMRID or

TID are transferred to the Amalgamated Irrigation District, or are valid against

the Amalgamated Irrigation District, as the case may be.

9. This Ministerial Order comes into effect on the first day of the month following

the date of this Ministerial Order.
