Section 136 of the Electricity Act,

chapter 7 of the Acts of New Brunswick, 2013, is amended 1 L’article 136 de la

a) by repealing subsection (1) and substituting the following:

b) by adding after subsection (1) the following:

Community solar program Programme d’énergie solaire communautaire 136.1(1) The following

definitions apply in this sec ‐ tion. 136.1(1) Les définitions qui suivent s’appliquent au présent article. “community solar program” means a program estab ‐ lished under subsection (2) that permits an eligible entity to generate electricity from solar energy for the eligible entity’s use and, if there is an excess of electricity gener ‐ ated, to sell the excess to the Corporation at a rate pre ‐ scribed by regulation. (programme d’énergie solaire communautaire) “eligible entity” means (

a) a band as defined under the Indian Act (Canada) that is located in the Province, (

b) a local government as defined under the Local Governance Act, (

c) a regional service commission established under the Regional Service Delivery Act, or (

d) a partnership or limited partnership between or among any of the entities listed in paragraphs (

a) to (c). (entité admissible) “project owner” means the eligible entity or group of eligible entities that owns and operates a facility that generates electricity under the community solar program. (propriétaire-exploitant) « entité admissible » Selon le cas :

(project owner) 136.1(2) The Minister shall establish and maintain a community solar program that permits an eligible entity to generate electricity from solar energy for the eligible entity’s use and to sell any excess electricity to the Cor ‐ poration in accordance with the conditions and require ‐ ments and at the rate prescribed by regulation. 136.1(2) Le ministre établit et maintient un pro ‐ gramme d’énergie solaire communautaire qui permet à toute entité admissible de produire, à son propre usage, de l’électricité à partir de l’énergie solaire et de vendre tout excédent à la Société conformément aux conditions et exigences ainsi qu’au tarif prescrits par règlement. 136.1(3) Upon receipt of an application under the community solar program, the Minister shall approve or deny the application within the time and in the manner prescribed by regulation. 136.1(3) Saisi d’une demande présentée sous le régime du programme d’énergie solaire communautaire, le mi ‐ nistre accepte ou rejette la demande dans les délais et suivant les modalités prescrits par règlement. 136.1(4) When the Minister approves an application under the community solar program, the rate at which the Corporation must purchase the electricity from the project owner is the rate prescribed by regulation. 136.1(4) Lorsque le ministre accepte une demande présentée sous le régime du programme d’énergie solaire communautaire, le tarif auquel la Société doit acheter l’électricité du propriétaire-exploitant est celui prescrit par règlement.

136.1(5) The Minister shall develop a power purchase agreement, in accordance with the requirements prescri ‐ bed by regulation, and file it with the Board for review and approval. 136.1(5) Le ministre élabore, conformément aux exi ‐ gences prescrites par règlement, un accord d’achat d’énergie et le dépose à la Commission pour examen et approbation. 136.1(6) The Minister may issue a power purchase agreement to an approved project owner, and the Corpo ‐ ration is bound by the terms of the agreement. 136.1(6) Le ministre peut délivrer un accord d’achat d’énergie à un propriétaire-exploitant agréé, auquel cas la Société est liée par l’accord. 136.1(7) The Lieutenant-Governor in Council may make regulations 136.1(7) Le lieutenant-gouverneur en conseil peut, par règlement : (

a) establishing a community solar program cap;

b) prescribing program requirements and condi ‐ tions;

c) prescribing project limitations, including estab ‐ lishing the maximum generator nameplate capacity for projects under the community solar program;

d) establishing an application window and applica ‐ tion requirements, review dates and processes for project owners;

e) prescribing the form and content of and terms and conditions required in a power purchase agree ‐ ment, including how fees are charged and calculated;

e) prescrire la forme et le contenu de l’accord d’achat d’énergie ainsi que les conditions requises, et déterminer les modalités de facturation et de calcul des droits; (

f) respecting the sale of excess electricity from so ‐ lar energy to the Corporation, including setting a rate;

f) réglementer la vente de l’excédent en électricité provenant de l’énergie solaire à la Société et fixer le tarif; (

g) prescribing duties of the Corporation with re ‐ spect to the community solar program;

g) prescrire des obligations à la Société relativement au programme d’énergie solaire communautaire; (

h) prescribing costs and fees;

h) fixer des frais et des droits à payer; (

i) respecting any other matter the Lieutenant- Governor in Council considers necessary or advisable for the proper administration of the community solar program.
