Bill 264 Mr. Ashton BILL 264 1978 THE SHERWOOD PARK-EDMONTON TOLL ROAD ACT ( Assented to , 1978) HER MAJESTY, by and with the advice and c'Onsent of the Legislative Assembly 'Of Alberta, enacts as f'Oll'Ows: 1..

In this Act, (a) "B'Oard" means the Sherwood Park C'Ommercial Develop ment Board established pursuant t'O this Act; (b) "Fund" means the Sherwo'Od Park C'Ommercial Develop ment Fund established by this Act; (c ) "'Minister" means the Minister 'Of Transp'OI1tati'On; (d) "mot'Or vehicle" means a device in, up'On 'Or by which a person 'Or thing may be transp'Orted 'Or drawn up'On a free way and which is pr'Opelled by any p'Ower, 'OtheT thnn muscular power, except aircraft; (e) "Sherw'Ood Park-Edmont'On t'Oll road" means th'Ose high ways c'Onnecting the Hamlet 'Of Sherw'O'Od Park and the City 'Of Edm'Onton which are designated as "Highways 14, 16 and 16A". 2. ( 1 ) The Minister shall by regulati'On establish a t'Oll to be paid by every person 'Operating a vehicle in a westerly directi'On 'On a Sherw'O'Od Park-Edm'Ont'On t'Oll road.

(2) A toll established pursuant t'O subsecti'On (1) may be in creased 'Or decreased by regulati'On.

(3) The Minister may establish different t'Olls f'Or different types 'Of m'Ot'Or vehicles and may by regulati'On exempt defined classes 'Of vehides fr'Om the payment 'Of t'Olls. 3. ( 1 ) There is hereby established the Sherwo'Od Park Com mercial Devel'Opment Fund.

(2) The am'Ount 'Of m'Oney c'Ollected as t'Olls less the c'Ost 'Of c'Ollecting the t'Olls shall, fr'Om time '1'0 time, be paid by the Minis ter int'O the Fund.

4. I ( 1) The Minister of Business Development and Tourism shall establish the Sherwood Park Commercial Development Board within 180 days of the commencement of this Act.

(2) The Minister shall, with respect to the Board es~ablished under this

section (

a) appoint or provide for the manner of appointment of rtIe members of the Board; (

b) preS'cnoe the term O'f office of any member; (

c) designate a chairman, vice chairman and secretary; and (

d) authorize, fix and provide for the payment of remunera tion and expenses to its members out of money appropria ted to that purpose by the Legislature.

(3) The Board may make rules of procedure governing the calling of its meetings and the conduct of business at its meeJ1:ings. 5. ( 1) The Minister O'f Business Development and Tourism may make loans or grants from the money in the Fund for the en couragement or enhancement of commercial development in the Hamlet of Sherwood Park.

(2) The Board shall advise the Minister Df Business Develop ment and Tourism as to the use of the money in the Fund, for the encouragement and enhancement of commercial development in the Hamlet of SherwoDd Park.

(3) The Minister of Business Development and Tourism may receive repO'rts and recommendations for the Board, and may re quire the Board to study and report to him Dn any matter relating to the use of the Fund. ( 4) The Minister of Business Development and Tourism may by regulation define areas near to the Hamlet of Sherwood Park which for the purposes of this se'ction shall be deemed to' be a part of the Hamlet of Sherwood Park.

(5) The Minister shall consult the Board before making any loan or grant from the Fund. 6. This Act come'S into force on a date to' be fixed by PrO'clama tion. 2
