WHEREAS the Minister of Northern Affairs, for and on behalf of the Community of Warren Landing desires to provide for the closing of a Public Road and part of a Public Reserve, both of Plan No. 6430 P.L.T.O. (N. DIV.) as herein after described;
CONSIDÉRANT QUE le ministre des Affaires du Nord, au nom de la communauté de Warren Landing, veut prévoir la fermeture d'une voie publique et d'une
partie d'une réserve publique portée au plan n° 6430 B.T.F.P. (div.
N) ainsi qu'il est décrit ci-après.
AND
WHEREAS The Northern Affairs Act , being
Chapter N100 of the C.C.S.M. provides in part, as follows:
CONSIDÉRANT QUE la
Loi sur les Affaires du Nord ,
chapitre N100 de la Codification permanente des lois du Manitoba , prévoit notamment ce qui suit :
" 5(1) . . . the minister has the powers, rights, privileges and duties that a municipality has within its boundaries and the minister shall exercise and perform these powers, rights, privileges and duties;
« 5(1) [...] le ministre exerce [...] les pouvoirs, les droits, les privilèges et les devoirs que possède une municipalité à l'intérieur de ses limites;
5(5) . . . where the exercise or performance of the powers, rights, privileges or duties referred to . . . require the passing of a bylaw . . . the minister may make the bylaw . . . for or on behalf of the residents of Northern Manitoba, a community . . . and;
« 5(5) [...] lorsque l'exercice des pouvoirs, des droits, des privilèges et des devoirs mentionnés [...] nécessite l'adoption d'un arrêté municipal [...], le ministre peut le faire pour le compte des résidents du Nord, d'une communauté ou d'une communauté constituée ou en leur nom;
5(6) The bylaw . . . may be made to apply to the whole or any part of the Northern Manitoba . . . as the case may be . . . ."
« 5(6) Les arrêtés municipaux [...] peuvent s'appliquer à tout ou
partie du Nord de la province [...] selon le cas [...]. »;
AND
WHEREAS The Municipal Act , being
Chapter M225 of the C.C.S.M. provides in part, as follows:
CONSIDÉRANT QUE la
Loi sur les municipalités ,
chapitre M225 de la Codification permanente des lois du Manitoba , prévoit notamment ce qui suit ;
" 209(1) Subject to subsections (2) and (3), the council of a municipality may pass bylaws
(a) ........;
(b) ........; and
(
c) for closing any highway, . . . .";
« 209(1)
Sous réserve des paragraphes (2) et (3), un conseil municipal peut adopter des arrêtés portant sur :

AND
WHEREAS The Planning Act , being
Chapter P80 of the C.C.S.M. provides as follows:
CONSIDÉRANT QUE la
Loi sur l'aménagement du territoire ,
chapitre P80 de la Codification permanente des lois du Manitoba , prévoit ce qui suit :
" 76(3) Lands designated as public reserves, whether in the name of the municipality or the Crown, may be closed by bylaw of the municipality, subject to its approval by the minister;
« 76(3) Le bien-fonds réservé à
titre de réserve publique, que ce soit au nom de la municipalité ou au nom de la Couronne, peut être fermé par arrêté municipal, sous réserve de l'approbation du ministre.
99 The minister responsible for this Part and for those sections of this Act that apply in Northern Manitoba shall be the minister responsible for The Northern Affairs Act ;
« 99 Le ministre responsable de la présente
partie ainsi que des articles de la présente loi qui s'appliquent au Nord du Manitoba est le ministre responsable de la
Loi sur les Affaires du Nord .
101(1) The following provisions of the Act apply, mutatis mutandis, to Northern Manitoba:
(
l) Sections 75 to 79 inclusive .......";

AND
WHEREAS it is deemed advisable and in the best interest for the Community of Warren Landing to close a public road shown outlined on "Schedule A" and a portion of Public Reserve as shown outlined and hatched on "Schedule B" attached thereto and forming part of this bylaw for land planning purposes;
CONSIDÉRANT QU'il est jugé opportun et dans l'intérêt de la communauté de Warren Landing de fermer, à des fins d'aménagement du territoire, une voie publique ainsi qu'il est indiqué par une bordure à l'annexe A et une
partie de la réserve publique ainsi qu'il est indiqué par une bordure et des hachures à l'annexe B jointes aux présentes et faisant
partie du présent arrêté.
NOW THEREFORE the Minister of Northern Affairs enacts as follows:
1 This bylaw shall provide for the closing of a Public Road and a portion of Public Reserve, Plan No. 6430 P.L.T.O. (N. DIV.), legally described as follows:
All that portion of Stanley Road, Plan No. 6430 P.L.T.O. (N. DIV.) lying to the south-west of the straight production south-westerly of the north-western limit of Lot 5 of the said plan.
All that portion of Public Reserve, Plan No. 6430 P.L.T.O. (N. DIV.) lying to the south of the straight production south-easterly to the water's edge of Nelson River of the north-eastern limit of Lot 6 of the said plan.

PAR CONSÉQUENT, le ministre des Affaires du Nord édicte ce qui suit :
1 Le présent arrêté prévoit la fermeture d'une voie publique et d'une
partie de réserve publique portées au plan n° 6430 B.T.F.P. (div.
N) et décrites comme suit :
« La
partie du chemin Stanley, porté au plan n° 6430 B.T.F.P. (div. N), située au sud-ouest du prolongement en ligne droite vers le sud-ouest de la limite nord-ouest du lot 5 dudit plan.
« La
partie de la réserve publique, portée au plan n° 6430 B.T.F.P. (div. N), située au sud du prolongement en ligne droite vers le sud-est de la limite nord-est du lot 6 dudit plan jusqu'à la ligne d'eau du fleuve Nelson. »
