OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Infrastructure Renewal dated August 18, 2009, and pursuant to
Section 11 of
Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act, is pleased to: (
a) authorize the disposal of certain lands containing 30,789 square feet, more or less, situate at or near Lower Sackville, County of Halifax and more particularly described in
Schedule "A" as shown crosshatched in red on
Schedule "B" which Schedules are attached to and form part of the Report and Recommendation; (
b) authorize the conveyance of the land to Fultz Corner Restoration Society, for the nominal consideration of $1.00 subject to the following conditions: (
i) in the event that said Society ceases to function as a non profit historical society or any form thereof, the lands shall revert back to Her Majesty the Queen in the Right of the Province of Nova Scotia represented in this behalf by the Minister of Transportation and Infrastructure Renewal at a cost of $1.00; (ii) the Province retains the right to approve or disapprove all enlargements to the present facility; (iii) the Society will ensure the said lands to be free from any and all commercial ventures; and (iv) the Society shall ensure that the said lands remain free from encumbrances, liens, or charges of any kind; and (
c) authorize the Minister of Transportation and Infrastructure Renewal to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the lands hereinabove described.
