B.C. Reg. 193/2006, deposited June 23, 2006, pursuant to the EMPLOYMENT AND ASSISTANCE STATUTES AMENDMENT ACT, 2006 [Section 15], the EMPLOYMENT AND ASSISTANCE ACT [Section 35] and the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [Section 26]. Order in Council 466/2006, approved and ordered June 23, 2006.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that,

(

a) effective July 1, 2006, sections 1, 2, 5, 6, 7 (b), 8, 9, 12, 13 and 14 (

b) of the

Employment and Income Assistance Statutes Amendment Act, 2006, S.B.C. 2006, c. 22, are brought into force, and

(

b) effective September 30, 2006,

(

i) sections 3, 4, 7 (a), 10, 11 and 14 (

a) of the Employment and Income Assistance Statutes Amendment Act, 2006 , S.B.C. 2006, c. 22, are brought into force,

(ii) the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended as set out in sections 1 to 3 of the attached Schedule, and

(iii) the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended as set out in sections 4 to 6 of the attached Schedule.

Schedule

Employment and Assistance Regulation

1 The Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended by adding the following section:

Consequences for providing inaccurate or incomplete information

32.1 If the minister determines under

section 15.1 (1) of the Act that the minister may take action under

section 15.1 (2) of the Act in relation to a family unit, the income assistance or hardship assistance provided to or for the family unit may be reduced by $25 for

(

a) a first determination, for the next 3 calendar months for which income assistance or hardship assistance is provided to or for the family unit, starting with the first calendar month

(

i) following the calendar month in which the minister made the determination, and

(ii) for which income assistance or hardship assistance is provided to or for the family unit,

(

b) a second determination, for the next 6 calendar months for which income assistance or hardship assistance is provided to or for the family unit, starting with the first calendar month

(

i) following the calendar month in which the minister made the determination, and

(ii) for which income assistance or hardship assistance is provided to or for the family unit, and

(

c) a third or subsequent determination, for the next 12 calendar months for which income assistance or hardship assistance is provided to or for the family unit, starting with the first calendar month

(

i) following the calendar month in which the minister made the determination, and

(ii) for which income assistance or hardship assistance is provided to or for the family unit.

Section 37 is amended

(

a) in paragraphs (

a) and (

e) by striking out "either made an

acknowledgement or" and by adding "includes" after "judgment

given against them, and",

(

b) in paragraphs (a) (

i) and (iii), (b) (

i) and (iii), (c) (

i) and

(iii), (d) (

i) and (iii) and (e) (

i) and (iii) by striking out "acknowledgment

or",

(

c) in paragraphs (a) (ii), (b) (ii), (c) (ii), (d) (ii) and (e) (ii)

by striking out "acknowledgement or", and

(

d) in paragraphs (b), (

c) and (

d) by striking out "made an

acknowledgement or" and by adding "includes" after "judgement

given against him or her, and".

Section 38 is amended

(

a) in subsection (3) by striking out everything after "3

benefit months" and substituting "if a court gives judgment in

favour of the government in an action for debt against an applicant or a

recipient in the family unit for money obtained under a former Act or the

Disability Benefits Program Act to which he or she was not entitled, unless

the money was paid in error.", and

(

b) in subsection (4) by striking out ", an acknowledgment

made".

Employment and Assistance for Persons

with Disabilities Regulation

4 The Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended by adding the following section:

Consequences for providing inaccurate or incomplete information

28.1 If the minister determines under

section 14.1 (1) of the Act that the minister may take action under

section 14.1 (2) of the Act in relation to a family unit, the disability assistance or hardship assistance provided to or for the family unit may be reduced by $25 for

(

a) a first determination, for the next 3 calendar months for which disability assistance or hardship assistance is provided to or for the family unit, starting with the first calendar month

(

i) following the calendar month in which the minister made the determination, and

(ii) for which disability assistance or hardship assistance is provided to or for the family unit,

(

b) a second determination, for the next 6 calendar months for which disability assistance or hardship assistance is provided to or for the family unit, starting with the first calendar month

(

i) following the calendar month in which the minister made the determination, and

(ii) for which disability assistance or hardship assistance is provided to or for the family unit, and

(

c) a third or subsequent determination, for the next 12 calendar months for which disability assistance or hardship assistance is provided to or for the family unit, starting with the first calendar month

(

i) following the calendar month in which the minister made the determination, and

(ii) for which disability assistance or hardship assistance is provided to or for the family unit.

Section 33 is amended

(

a) in paragraphs (

a) and (

e) by striking out "made an

acknowledgement or" and by adding "includes" after "judgement

given against them, and",

(

b) in paragraphs (a) (

i) and (iii), (b) (

i) and (iii), (c) (

i) and

(iii), (d) (

i) and (iii) and (e) (

i) and (iii) by striking out "acknowledgment

or",

(

c) in paragraphs (a) (ii), (b) (ii), (c) (ii), (d) (ii) and (e) (ii)

by striking out "acknowledgement or", and

(

d) in paragraphs (b), (

c) and (

d) by striking out "made an

acknowledgement or" and by adding "includes" after "judgement

given against him or her, and".

Section 34 is amended

(

a) in subsection (3) by striking out everything after "3
