Definition

1 In this regulation, "Act" means The Highway Traffic Act .

Administrative penalty amounts

2 The following administrative penalty amounts are prescribed for the purpose of subsection 263.1.1(1) of the Act:

(

a) clause 263.1.1(1)⁠(a) (refusal to comply with demand)

$700;

(

b) subclause 263.1.1(1)⁠(b)⁠(i) (calibrated screening device registering a WARN), subclause 263.1.1(1)⁠(b)⁠(iii) (BAC equal to or over .05 but under .08), subclause 263.1.1(1)⁠(b)⁠(iv) (calibrated screening device indicating presence of alcohol) or subclause 263.1.1(1)⁠(b)⁠(v) (alcohol present in blood but BAC under .05):

(

i) if the suspension and disqualification order giving rise to the penalty is the first suspension and disqualification order that has been served on the person under

section 263.1 of the Act in the 10-year period ending when the order is served

$400,

(ii) if the suspension and disqualification order giving rise to the penalty is the second suspension and disqualification order that has been served on the person under

section 263.1 of the Act in the 10-year period ending when the order is served

$500,

(iii) if the suspension and disqualification order giving rise to the penalty is the third suspension and disqualification order or more that has been served on the person under

section 263.1 of the Act in the 10-year period ending when the order is served

$600;

(

c) subclause 263.1.1(1)⁠(b)⁠(ii) (calibrated screening device registering a FAIL)

$700.

Montant des sanctions administratives

2 Pour l'application du paragraphe 263.1.1(1) du Code , le montant de la sanction administrative qu'une personne est tenue de payer est indiqué ci-dessous :

a) pour une sanction imposée en application de l'alinéa a) de ce paragraphe

700 $;

b) pour une sanction imposée en application de l'alinéa b) de ce paragraphe à l'égard d'un motif prévu aux alinéas 263.1(2)f), f.2),

i) ou

j) du Code lorsque l'ordre de suspension et d'interdiction ayant donné lieu à la sanction est :

(

i) le premier à lui être signifié en application de l'article 263.1 du Code au cours de la période de 10 ans se terminant au moment de la signification

400 $,

(ii) le deuxième à lui être signifié en application de l'article 263.1 du Code au cours de la période de 10 ans se terminant au moment de la signification

500 $,

(iii) au moins le troisième à lui être signifié en application de l'article 263.1 du Code au cours de la période de 10 ans se terminant au moment de la signification

600 $;

c) pour une sanction imposée en application de l'alinéa b) de ce paragraphe à l'égard d'un motif prévu à l'alinéa 263.1(2)f.1) du Code

700 $.

Designation of administrator

3 For the purposes of subsection 263.1.1(6) of the Act, The Manitoba Public Insurance Corporation is designated as the administrator.

Coming into force

4 This regulation comes into force on December 16, 2019, or the day it is registered under The Statutes and Regulations Act , whichever is later.
