OIC Text: The Governor in Council on the report and recommendation of the Minister of Health dated June 8, 2001, pursuant to

Section 61 of

Chapter 208 of the Revised Statutes of Nova Scotia, 1989, the Hospitals Act, is pleased to: (

a) reappoint Dr. Patrick Flynn of Halifax, Halifax Regional Municipality, as a member of the Review Board for all facilities under the Hospitals Act for a one year term commencing July 1, 2001, and ending June 30, 2002; (

b) reappoint Elaine Gibson of Portuguese Cove, Halifax Regional Municipality, as a member of the Review Board for all facilities under the Hospitals Act for a term commencing July 1, 2001, and ending December 31, 2001; (

c) determine that the Province shall defend, negotiate or settle claims or charges made against Dr. Patrick Flynn and/or Elaine Gibson and indemnify him or her from personal liability provided, however, the Province is satisfied that the claim arises out of his or her activities in relation to the appointment and is not based on fraud or criminal activity and provided that the Province will be in control of a case which it defends; (

d) appoint the following persons as members of the Review Board for all facilities under the Hospitals Act each for a term of three years commencing July 1, 2001, and ending June 30, 2004: Dr. Therese O'Neill of Dartmouth, Halifax Regional Municipality; and E.A. Nelson Blackburn, Q.C., of Bedford, Halifax Regional Municipality; (

e) determine that the Province shall defend, negotiate or settle claims or charges made against Dr. Therese O'Neill and/or E.A. Nelson Blackburn and indemnify him or her from personal liability provided, however the Province is satisfied that the claim arises out of his or her activities in relation to the appointment and is not based on fraud or criminal activity and provided that the Province will be in control of a case which it defends.
