EXPLANATORY NOTES

General: The purpose of this Bill is to bring before

the House of Assembly matters in the statute law that require legislative

correction as a result of amendments or enactments made in previous

sessions. The amendments have been brought to the

attention of the Minister of Justice and Public Safety and are technical

amendments not involving matters of policy. Each amendment is explained by

reference to the clause of the Bill by which it is proposed.

Clause 1 of the Bill is the short

title.

Clause 2 of the Bill would amend

section

2 of the Arts Council Act to correct

an error in the order of the

definitions in that section.

Clause 3 of the Bill would amend

section 30 of the Auditor General Act

to correct an incorrect reference to another Act. The error arose when the Public Tender Act was replaced by the Public Procurement Act .

Clause 4 of the Bill would amend subsection

15.2(1) and

section 21.1 of the Child and

Youth Advocate Act to correct the name of a department.

Clause 5 of the Bill would amend

section 2 of the Coast of Bays Regional

Service Board Order to add words that were inadvertently omitted from that

section.

Clause 6 of the Bill would amend

subsections 3(1), 3(2), 14(4), 15(2) and 51(3) of the Condominium Act, 2009 to correct incorrect references to another

Act. The errors arose when the Registration of Deeds Act was replaced

by the Registration of Deeds Act, 2009 .

Clause 7 of the Bill would amend

paragraph 17.1(1)(

b) of the Energy

Corporation Act to correct a typographical error. The reference to "entitites" is

corrected to "entities".

Clause 8 of the Bill would amend

subsections 16(1) to (4) of the Expropriation

Act to correct incorrect references to another Act. The errors arose when the Registration of Deeds Act was replaced

by the Registration of Deeds Act, 2009 .

Clause 9 of the Bill would amend

subsection 9(6) of the Family Law Act

to correct an incorrect reference to another Act. The error arose when the Registration of Deeds Act was replaced by the Registration of Deeds Act, 2009 .

Clause 10 of the Bill would amend

subsection 4(4) of the Fisheries Act

to correct an error in cross-referencing.

Clause 11 of the Bill would amend

subsections 70(6), 70(7) and 70(8) of the Forestry

Act to correct incorrect references to another Act. The errors arose when the Registration of Deeds Act was replaced

by the Registration of Deeds Act, 2009 .

Clause 12(1) of the Bill would amend

subsection 154(2) of the Highway Traffic

Act to correct a typographical error.

The reference to "insure" is corrected to "ensure".

Clause 12(2) of the Bill would amend

subsection 174.1(1) of the Highway

Traffic Act to correct an incorrect reference to another Act. The error arose when the Medical Act, 2005 was replaced by the Medical Act, 2011.

Clause 12(3) of the Bill would amend

subsection 176.1(6) of the Highway

Traffic Act to correct a typographical error. The reference to

"Lieutenant-Governor" is corrected to "Lieutenant-Governor in

Council".

Clause 12(4) of the Bill would amend

paragraph 178(5)(

b) of the Highway

Traffic Act to correct an incorrect reference to another Act. The error arose when the Medical Act, 2005 was replaced by the Medical Act, 2011.

Clause 12(5) of the Bill would amend

paragraph 178.1(4)(

a) of the Highway

Traffic Act to correct an incorrect reference to another Act. The error arose when the Medical Act, 2005 was replaced by the Medical Act, 2011.

Clause 13 of the Bill would repeal

subsection 4(2) of the House of Assembly

Act . The quorum of the House of

Assembly is established in the Standing Orders so this

section is unnecessary.

Clause 14 of the Bill would amend

subsection 48(2) of the House of Assembly

Accountability, Integrity and Administration Act to correct an incorrect

reference to another Act. The error

arose when the Public Tender Act was

replaced by the Public Procurement Act .

Clause 15 of the Bill would amend

paragraph 27(1)(

c) of the

Interpretation

Act to correct an incorrect reference to another Act. The error arose when the Court of Appeal Act was enacted.

Clause 16(1) of the Bill would amend

section 43.13 of the Labour Standards Act

to correct a typographical error. The

reference to "section" is corrected to "Part".

Clause 16(2) of the Bill would amend

subsection 75(1) of the Labour Standards

Act to correct an incorrect reference to another Act. The error arose when the

Summary Proceedings Act was replaced by the Provincial Offences Act.

Clause 17 of the Bill would amend

paragraphs 2(1)(

k) and (

l) and

section 21 of the Mechanics' Lien Act to correct incorrect references to another

Act. The error arose when the Registration of Deeds Act was replaced

by the Registration of Deeds Act, 2009 .

Clause 18 of the Bill would amend

section

64 of the Mineral Regulations to

correct an incorrect reference to another Act.

The error arose when the Registration

of Deeds Act was replaced by the Registration

of Deeds Act, 2009 .

Clause 19 of the Bill would amend

subsections 35(1) and (3) of the Mineral

Holdings Impost Act to correct incorrect references to another Act. The errors arose when the Registration of Deeds Act was replaced

by the Registration of Deeds Act, 2009 .

Clause 20(1) of the Bill would amend

subsection 42(5) of the Occupational

Health and Safety Regulations, 2012 to correct an incorrect reference to a

term. The error arose when the Workplace Hazardous Materials Information

System (WHMIS) Regulations were replaced by the Workplace Hazardous Materials Information System (WHMIS) Regulations,

2018 .

Clause 20(2) of the Bill would amend

paragraph 443(3)(

a) of the Occupational

Health and Safety Regulations, 2012 to correct an incorrect reference to a

regulation. The error arose when the Workplace Hazardous Materials Information

System (WHMIS) Regulations were replaced by the Workplace Hazardous Materials Information System (WHMIS) Regulations,

2018 .

Clause 21 of the Bill would repeal

the Office of Speaker Vacancy Act . The provisions of this Act are addressed in

the House of Assembly Act and the

Standing Orders so this Act is unnecessary.

Clause 22(1) of the Bill would amend

paragraph 2(1)(

c) of the Offshore Area

Corporate Income Tax Act to correct an incorrect reference to

an Act. The error arose when the Canada-Newfoundland Atlantic Accord Implementation Act ( Canada ) was amended.

Clause 22(2) of the Bill would amend

paragraph 2(1)(

g) of the Offshore Area

Corporate Income Tax Act to correct an incorrect reference to

an Act. The error arose when the Income Tax Act was replaced by the Income Tax Act, 2000 .

Clauses 22(3) and (4) of the Bill

would amend subsection 5(4) and

section 21 of the Offshore Area Corporate Income Tax Act to correct incorrect

references to sections of

an Act. The

errors arose when the Income Tax Act was

replaced by the Income Tax Act, 2000 .

Clause 23 of the Bill amends

subsection 78(1) of the Pension Benefits

Act, 1997 to correct a typographical error.

The reference to "Lieutenant-Governor" is corrected to

"Lieutenant-Governor in Council".

Clause 24 would amend paragraph

90(1)(

m) of the Personal Health

Information Act to correct an error in cross-referencing.

Clause 25 of the Bill would amend

subsections 37(6) and 38(6) of the Personal

Property Security Act to correct an incorrect reference to another

Act. The error arose when the Registration of Deeds Act was replaced

by the Registration of Deeds Act, 2009 .

Clause 26 of the Bill would amend paragraph

2(m), subsections 62(2) and 63(2) and

section 65 of the Personal Property Security Regulations to correct incorrect

references to another Act. The errors arose

when the Registration of Deeds Act was

replaced by the Registration of Deeds

Act, 2009 .

Clause 27(1) of the Bill would amend

paragraph 35(4)(

b) of the Petroleum and

Natural Gas Act to correct an incorrect reference to another Act. The error arose when the Registration of Deeds Act was replaced by the Registration of Deeds Act, 2009 .

Clause 27(2) of the Bill would amend

paragraph 35(4)(

d) of the Petroleum and

Natural Gas Act to correct an incorrect reference to

an Act. The error arose when the Canada-Newfoundland Atlantic Accord Implementation Act ( Canada ) was amended.

Clause 28 of the Bill would amend

subsections 28(3), 28(4) and 28(5) of the Pippy

Park Commission Act to correct incorrect references to another Act. The errors arose when the Registration of Deeds Act was replaced

by the Registration of Deeds Act, 2009 .

Clause 29 of the Bill would repeal

section 6.1 of the Provincial Parks

Regulations because it is spent.

Clause 30(1) would amend

Schedule C

of the Public Service Commission Act to

correct an error in the name of

an Act.

Clause 30(2) of the Bill would amend

Schedule C of the Public Service

Commission Act to correct an incorrect reference to another Act. The error arose when the Medical Care Insurance Act, 1999 was replaced by the Medical Care and Hospital Insurance Act .

Clause 31 of the Bill would amend

paragraph 6(

d) of the Status of the

Artist Act to correct an incorrect reference to another Act. The error arose when the Public Tender Act was replaced by the Public Procurement Act .

Clause 32 of the Bill would amend

subparagraphs 2(i)(ii) and 2(k)(iv) of the Works,

Services and Transportation Act to correct incorrect references to another

Act. The errors arose when the Public Tender Act was replaced by the Public Procurement Act .

Clause 33 of the Bill would repeal a

number of obsolete or spent Acts or regulations.

Be it enacted by the Lieutenant-Governor and

House of Assembly in Legislative Session convened, as follows:

Short title

1. This

Act may be cited as the Attorney General

Statutes Amendment Act, 2019.

2. Paragraphs 2(

g) and (

h) of the Arts Council Act are repealed and the

following substituted :

(g) "promotion or marketing of works"

includes attending auditions, seeking sponsorship, agents or engagements and

similar activities appropriate to the nature of an artist's work; and

(h) "public or peer recognition"

includes

(

i) honours,

(ii) awards,

(iii) professional prizes,

(iv) scholarships,

(

v) honourable mentions,

(vi) appointments to adjudication committees or

peer juries, and

(vii) invitations to participate in group

exhibitions or performances.
