RESERVIST LEAVE (MINISTERIAL) REGULATION

Entitlement to reservist leave

1(1) A reservist is entitled to reservist leave without pay under

section

53.2(1)(

d) of the Employment Standards Code to take

part in Canadian

Forces operations and activities in respect of the XXI Olympic Winter

Games and X Paralympic Winter Games, commonly referred to as the

2010 Olympic and Paralympic Winter Games.

(2) Operations and activities referred to subsection (1) include pre-

deployment and post-deployment operations and activities.

Expiry

2 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be

repassed in its present or an amended form following a review, this

Regulation expires on June 30, 2010.

Part 1 is repealed.

Section 5 is amended by striking out ", swampers".

Section 15 is amended by striking out "March 31, 2010"

and substituting "March 31, 2015".

6 Sections 2, 3 and 4 come into force on April 1, 2010.

Definitions

1 In this Regulation,

(a) "Act" means the Local Authorities Election Act;

(b) "Form 8" means Form 8 of

Schedule 1 under the Local

Authorities Election Forms Regulation (AR 106/2007);

(c) "returning officer" means the returning officer for the City of

Calgary.

Modification of election procedure

2(1) The system for the conduct and procedure of an election or a vote

under the Act is modified for use by the City of Calgary to the extent

provided as follows:

(

a) a card having only the same contents as Form 8 is to be

created for every elector enumerated in an enumeration

conducted pursuant to bylaw no. 8M86 of the City of Calgary

or any successor to that bylaw;

(

b) on election day the cards for each voting station must be kept

by a deputy for that station;

(

c) on election day an elector attending at a voting station must

obtain his or her card and then present the card to the deputy

issuing ballots;

(

d) corrections to information on a card must be initialled by the

elector;

(

e) if no card has been created for an elector or the card cannot

be located, the deputy must create a card for that elector that

has the same information as contained in Form 8;

(

f) the deputy may only issue a ballot if the elector makes the

statement referred to in

section 53(1)(

b) of the Act and the

elector signs the card;

(

g) immediately after issuing the ballot the deputy must complete

the card.

(2) The cards marked in accordance with subsection (1) constitute the

voting register.

Section 52 identification

3 Instead of identification referred to in

section 52 of the Act, the

returning officer may, on proof of identity satisfactory to the returning

officer, issue photo identification to an enumerator and that photo

identification shall, for the purposes of

section 52, be treated as if it

were identification provided by the City of Calgary.

Blind electors

Section 78(5) of the Act does not apply in the case of an elector

who is blind, and the following applies instead:

(

a) the deputy shall provide at advance voting stations on an

as-required basis blind voter templates that will allow the

elector to vote entirely unassisted;

(

b) the returning officer shall ensure that advertisements for

advance voting stations contain statements that blind voter

templates will be available only at advance voting stations

and will not be available on election day.

Modification respecting special ballots

Section 77.1(2) of the Act is modified for use by the City of

Calgary to allow for applications for a special ballot to be made

through a publicly accessible secure website maintained by the City of

Calgary.

Modification respecting copies of voter register

6 Sections 90, 92, 93, 94, 101 and 102(1) of the Act are modified for

use by the City of Calgary to the extent provided as follows:

(

a) the presiding deputy shall not make a copy of the voting

registers referred to in

section 90(2) of the Act or deliver that

copy to the returning officer under

section 94(1) of the Act;

(

b) at the completion of the counting of the ballots, the presiding

deputy shall

(

i) make a packet of the voting register cards referred to in

section 2(2) on which an objection has been noted under

section 54 of the Act, if any, separate from the packet

made under

section 91(1)(

f) of the Act that contains the

rest of the voting register,

(ii) seal the packet and mark it on the outside with the

information referred to in

section 92 of the Act, and

(iii) place the packet in the ballot box before it is closed and

sealed under

section 93 of the Act;

(

c) commencing the day after election day, if a person makes a

request to view the copy of the voting register on which

objections have been noted in accordance with

section 90(3)

of the Act, the returning officer shall

(

i) break the seal of the presiding deputy on the ballot box

and open the ballot box,

(ii) open the packet containing the voting register cards on

which objections have been noted and make a copy of

each card,

(iii) seal the packet with the returning officer's seal and

return it to the ballot box, and

(iv) close the ballot box and seal it with the returning

officer's seal;

(

d) the copy of the voting register cards made under clause (

c) shall be shown to the person who made the request and to

any subsequent person who requests to view the copy in

accordance with

section 90(3) of the Act;

(

e) the secretary shall destroy the packet made under clause (

b) along with the copies made under clause (

c) in accordance

with

section 101 of the Act.

Repeal

7 The Calgary Election Regulation (AR 31/2004) is repealed.

Expiry

8 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be

repassed in its present or an amended form following a review, this

Regulation expires on October 31, 2012.

EDMONTON ELECTION AMENDMENT REGULATION

Interpretation

1 The

definitions in the Permit Regulation (AR 204/2007) apply to

this Regulation.

Purpose

2 The certifications of competencies issued under this Regulation are

for the purpose of obtaining a permit under the Permit Regulation

(AR 204/2007).

Private sewage installer

3(1) The Administrator may issue or renew a private sewage installer

certificate of competency to a person who has

(

a) training in private sewage systems or in water and sewer

service piping, satisfactory to the Administrator, and

(

b) paid the appropriate fee.

(2) The Administrator shall

(

a) state the type of private sewage system or water and sewer

service piping for which the holder of the certificate may

obtain a permit based on the training of the holder of the

certificate, and

(

b) state the term of the certificate of competency.

Master electrician

4(1) The Administrator may issue or renew a master electrician

certificate to a person who

(

a) holds a trade certificate as an electrician under the

Apprenticeship and Industry Training Act,

(

b) for a minimum of 3 years has held

(

i) a trade certificate as an electrician under the

Apprenticeship and Industry Training Act,

(ii) a provincial journeyman electrician certificate of

proficiency issued by a province other than Alberta, or

(iii) a restricted master electrician certificate and has been

actively engaged in electrical contracting and meets the

qualifications for a trade certificate as an electrician

under the Apprenticeship and Industry Training Act,

(

c) has paid the appropriate fee, and

(

d) has attained 75% in the master electrician examination as

approved by the Administrator.

(2) The Administrator may issue or renew a master electrician

certificate of competency to a person who

(

a) satisfies the Administrator that they hold an equivalent

certificate of competency from a jurisdiction outside of

Alberta,

(

b) has paid the appropriate fee, and

(

c) has attained 75% in the master electrician jurisprudence

examination as approved by the Administrator.

(3) For a certificate of competency issued under subsection (2), the

Administrator may state the maximum voltage between conductors and

the maximum ampacity of the electrical systems for which the holder

of the certificate may obtain a permit based on the equivalent

authorization of the certificate of competency from outside of Alberta.

(4) The term of a master electrician certificate is

(

a) one year from the date of issue, or

(

b) for a period of not less than one year as specified by the

Administrator.

(5) An examination fee may be refunded if, for any reason satisfactory

to the Administrator, a person is unable to take the examination after

having paid the examination fee.

Restricted master electrician, rural wireman - grandfathering

5(1) The Administrator may renew a restricted master electrician

certificate of competency or a rural wireman certificate of competency

originally issued or renewed under the Certification and Permit

Regulation (AR 168/2002).

(2) In the case of a restricted master electrician certificate, the holder

of the certificate may obtain a permit with respect to electrical

installations of not more than 300 volts between conductors with an

ampacity of not more than 200 amperes.

(3) In the case of a rural wireman certificate, the Administrator shall

state the areas of Alberta where the rural wireman is permitted to

perform electrical work, but the Administrator may adjust these areas

at any time.

(4) The term of the certificate of competency is

(

a) one year from the date of issue, or

(

b) for a period of not less than one year as specified by the

Administrator.

ID card

6(1) The Administrator shall issue an identification card to a holder of

a certificate of competency under this Regulation identifying the status

of the holder in a form satisfactory to the Administrator.

(2) In the case of an ID card with respect to a rural wireman's

certificate of competency, the card must indicate the area in which the

holder may do electrical work.

Certificates to be displayed

7 The holder of a certificate of competency issued under this

Regulation shall

(

a) prominently display it at the holder's place of business or

employment, or

(

b) have it available to be produced immediately on the request

of the Administrator or a safety codes officer.

Duplicate certificates

8 The Administrator may issue a duplicate certificate of competency

under this Regulation if the Administrator is satisfied that the original

has been lost, destroyed or mutilated or the name of the certificate

holder has been legally changed.

Consequential amendment

9 The Permit Regulation (AR 204/2007) is amended in

section 9(1)(

a) by adding "within the scope of the master

electrician's certification" after "system".

Repeal

10 The Certification and Permit Regulation (AR 168/2002) is

repealed.

Expiry

11 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be

repassed in its present or an amended form following a review, this

Regulation expires on October 31, 2014.
