PROVINCE OF BRITISH COLUMBIA ORDER OF THE LIEUTENANT GOVERNOR IN COUNCIL Order in Council No. , Approved and Ordered Lieutenant Governor Executive Council Chambers, Victoria Minister of Municipal Affairs and Housing Presiding Member of the Executive Council (This

Authority under which Order is made: Act and section: Local Government Act, R.S.B.C. 2015, c. 1, ss. 30 and Other: OIC 595/1980 O10386337 On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the supplementary Letters Patent issued on March 13, 1980, by Order in Council 595/1980, are amended as set out in the attached Schedule. 227 May 4, 2020

SCHEDULE The supplementary Letters Patent issued on March 13, 1980, by Order in Council 595/1980, are amended by striking out everything between “ shall be apportioned between the City of Prince Rupert and the Village of Port Edward in the following manner:” and “AND THAT the area of the City of Prince Rupert be extended ” and substituting the following: (

a) Of the tax revenue received for the taxation year, the City of Prince Rupert must pay $1 to the Village of Port Edward on or before August 1, 2020. (

b) Of the tax revenue received for each taxation year subsequent to 2020, the City of Prince Rupert must, on or before August of the taxation year, pay to the Village of Port Edward the amount that is equal to the sum of $550 and the greater of the following: (i) 4% of the tax revenue received for the taxation year; (ii) the percentage of the tax revenue received for the taxation y ear that is equal to the ratio of the population of the Village of Port Edward to the com bined populations of the City of Prince Rupert and th e Village of Port Edward; AND THAT, on or before April of each taxation year subsequent to 2020, the City of Prince Rupert must notify the Village of Port Edward, in writing, of the amount of the tax revenue the City of Prince Rupert estimates will be paid to the Village of Port Edward for the taxation year, which amount must be based on the tax rates the City of Prince Rupert intends to establish for that taxation year; AND THAT, after each census of popula tion is published by Statistics Canada, the City of Prince Rupert must prepare a report containing the following information: (

a) for each calendar year of the 5-year period up to and including the calendar year in which the census is taken, the report must contain the following: (

i) the populations of the City of Prince Rupert and the Village of Port Edward as developed b y the director under the Statistics Act; (ii) the assessments of the land and improvements as set out in the revised asse ssment roll, as defined in the Assessment Act, in the extensio n area; (iii) the property tax rates established by the City of Prince Rupert for the purpose of raising municipal revenue for the year; (iv) the amount of tax revenue received by the City of Prince Rupert from the extension area and the amount of that tax revenue paid to th e Village of Port Edward, as reported in an audited financial statement of the City of Prince Rupert applicable to the year; (

b) for each year referred to in paragraph (a), the report mu st contain the following i nformation if, for the year, the information is publicly available or has been provided to the City of Prince Rupert in circumstance s that do not pr ohibit the City of Prince Rupert from disclosing the information: (

i) the volume of rail cars passing through the Village of Port Edward in the year, as reported by the Prince Rupert Port Authority or the Canadian National Railway Company; (ii) the volume of all cargo, by type, exported in the year from each export terminal in the extension area, as reported by the Prince Rupert Port Authority; (iii) the data, if any, about air qua lity, including data relating to odour and dust, and about noise, light emissions and vibrations at each terminal within the extension area, as reported by the operator of a terminal or the Prince Rupert Port Authority; (

c) the report must contain an estimate or prediction of any of the information described in paragraphs (a) (

i) to (iv) or (b) (

i) to (iii), and an estimate or prediction of any change in that information, that the City of Prince Rupert references, or relies on, in a publicly-available report or plan of the City of Prince Rupert; AND THAT, in the year immediately afte r the census of population is taken, the City of Prince Rupert must provide the report, for the purposes of review, to (

a) the municipal councils of the City of Prince Rupert and the Village of Port Edward, and (

b) the inspector of municipalities appointed under

section of the Local Government Act; AND THAT the Letters Patent of the City of Prince Rupert, as amended, be deemed to be further amended accordingly.
