Statute: Public Highways Act Expropriation Act

OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated July 27, 2000, pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, and

Section 80 of

Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to: (

a) extinguish the right of the public to use that portion of the public highway system containing 23,838 square feet and 16,618 square feet for a total of 40,456 square feet, more or less, situate at or near Simms Settlement, Lunenburg County, and more particularly described in

Schedule "A" as shown outlined in red on

Schedule "B" which schedules are attached to and form part of the report and recommendation; (

b) convey the said land to Mark Westhaver and Mary Margaret Westhaver of Hubbards, Lunenburg County, for the price of $2,060.00; and (

c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.
