B.C. Reg. 362/2003, deposited October 24, 2003, pursuant to the ADOPTION ACT [Section 91 (2)]. Order in Council 964/2003, approved and ordered October 23, 2003.
On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that
(
a) section 4 (
a) of the Adoption Fees Regulation, B.C. Reg. 293/96, is amended by striking out "care of a director under the Child, Family and Community Service Act or under the guardianship of a director under that Act or the Family Relations Act , or" and substituting "custody of a director under the Child, Family and Community Service Act or under the guardianship of a director under that Act referred to in
section 29 (3) (
a) of the Family Relations Act , or", and
(
b) the Adoption Regulation, B.C. Reg. 291/96, is amended as set out in the attached Schedule. — G. HOGG, Minister of Children and Family Development; C. CLARK, Presiding Member of the Executive Council.
Schedule
Section 1 of the Adoption Regulation, B.C. Reg. 291/96, is amended
(
a) by adding the following definition:
"aboriginal agency" means a society registered under the
Society Act that has
(
a) at least one employee who is a delegate of the director under
section 77 of the Act, and
(
b) at least one employee who is a delegate of a director under
section 92 of the
Child, Family and Community Service Act ; , and
(
b) by repealing the definition of "social worker" and substituting the following:
"social worker" means,
(
a) in the case of an adoption agency, a person who
(
i) is employed by or under contract to the adoption agency, and
(ii) is registered by the Board of Registration for Social Workers, or
(
b) in the case of the ministry or an aboriginal agency, a person employed by the ministry or aboriginal agency who
(
i) is a delegate of the director under
section 77 of the Act, and
(ii) has
(
A) a Bachelor of Social Work degree or a Master of Social Work degree, or
(
B) in the opinion of the director, qualifications and experience in social work acceptable to the director.
2 Sections 11 (2) (
b) and 15 (2) are amended by striking out "double" and substituting "certified or".
3 Sections 20 (
a) and 21 are amended by striking out "Director" wherever it appears and substituting "Chief Executive Officer".
4 Paragraph (
b) of the definition of "designated child" in
section 26 is amended
(
a) in subparagraph (
i) by striking out "care of the" and substituting "custody of a", and
(
b) in subparagraph (iii) by striking out "the director under" and substituting "a director referred to in
section 29 (3) (
a) of".
Section 28 (6) is amended by striking out "care of the director." and substituting "care, custody or guardianship of a director under the Child, Family and Community Service Act ."
