OIC Text: The Governor in Council on the report and recommendation of the Minister of Communities, Culture and Heritage dated September 17, 2012, and pursuant to
Section 5 of
Chapter 22 of the Revised Statutes of Nova Scotia, 1989, the Art Gallery of Nova Scotia Act, is pleased to: (
a) effective November 6, 2012, revoke the appointment of Wylie Spicer of Halifax Regional Municipality (Halifax), which appointment was made by Order in Council 2011-238 dated July 5, 2011; (
b) appoint Malcolm Fraser of Halifax Regional Municipality (Halifax) and Joy Laking of Bass River, Colchester County as members of the Board of Governors of the Art Gallery of Nova Scotia, each for a three year term commencing November 6, 2012; and (
c) order that the Province shall defend, negotiate or settle claims or charges made against Malcolm Fraser and Joy Laking as members of the Board of Governors of the Art Gallery of Nova Scotia and indemnify them from personal liability in connection with any such claims, provided, however, that the Province is satisfied that the claim arises out of their activities in relation to their appointment and is not based on fraud or criminal activity and where the Province so defends them, the Province will be in control of the case.
