PART I PUBLISHED BY AUTHORITY Vol. 80 ST. JOHN’S, FRIDAY, OCTOBER 7, 2005 No. 40 LOBBYIST REGISTRATION ACT Lobbyists' Code of Conduct Introduction This Code of Conduct is founded on the principles set out in

section 3 of the Lobbyist Registration Act. The purpose of this Code is to assure the public that lobbying is done ethically and with the highest standards, with a view to maintaining and enhancing public confidence in the integrity and impartiality of government decision-making. In this regard, the Code complements the registration requirements of the Lobbyist Registration Act. Lobbyists are required to comply with the provisions of the Code of Conduct. This Introdu ction states the purposes of the Code and places it in a broader context.

Next comes a body of overriding principles, which set out in positive terms the goals and objectives to be attained. Then there are specific rules, which provide more detailed requirements for behaviour in certain situations. Principles Integrity and Honesty Lobbyists should conduct with integrity and honesty all relations with public office hol ders, clients, employers, the public and other lobbyists. Openness Lobbyists should at all times be open and frank about their lobbying activities, while respecting confidentiality. Professionalism Lobbyists should observe th e highest professional and ethical standards.

In partic ular, lobbyists should conform fully not only with the letter but also with the spirit of the Lobbyists’ Code of Conduct as well as all relevant laws, including the Lobbyist Registration Act and its regulations. Rules Transparency 1. Identity and purpose Lobbyists shall, when making a representation to a public office holder, disclose the identity of the person or organization on whose behalf the representation is made, as well as the reasons for the representation. 2. Accurate information Lobbyists shall provide inform ation that is accurate and factual to public office holders .

Moreover, lobbyists shall not knowingly mislead anyone and shall use proper care to avoid doing so inadvertently.

Disclosure of obligations Lobbyists shall indicate to their client, employer or organization their obligations under the Lobbyist Registration Act , and their obligation to adhere to this Code. Confidentiality 4. Confidential information Lobbyists shall not divulge c onfidential information unless they have obtained the inform ed consent of their client, employer or organization, or disclosure is required by law. 5.

Insider information Lobbyists shall not use any confidential or other insider information obtained in the course of their lobbying activities to the disadvantage of their client, employer or organization. Conflict of Interest 6. Competing interests Lobbyists shall not represen t conflicting or competing interests without the informed consent of those whose interests are involved. 7.

Disclosure Lobbyists shall advise public of fice holders that they have informed their clients of any actual, potential or apparent conflict of interest, and obtain the informed consent of each client concerned before proceeding or continuing with the undertaking. 8. Improper influence Lobbyists shall not place public office holders in a conflict of interest by proposing or undertaking any action that would constitute an improper in fluence on a public office holder.

Diagnostic and Therapeutic Drug Regulations 95/05 The Newfoundland and Labrador Gazette 628 October 7, 2005 2.

(1) The board may issue to an optometrist a diagnostic drug certificate.

(2) An optometrist who holds a diagnostic drug certificate may administer and prescribe (

a) topical ophthalmic anaesthetic s for the purpose of measuring a patient's intra-ocular pressure; and (

b) topical ophthalmic cycloplegics and mydriatics for the pur- pose of dilation and to facilitate examination of the eye. 3.

(1) The board may issue a therap eutic drug certificate to an optometrist who (

a) graduated on or after January 1, 1995 from an educational body approved by the board, and has successfully completed the pharmaceutical

section of the Canadian Standard As- sessment Examinations administered by the Canadian Exam- iners in Optometry; and (

b) graduated prior to January 1, 1995 from an educational body approved by the board, and (

i) has successfully completed a post-graduate course ap- proved by the board in the administration and prescrip- tion of therapeutic medications, and (ii) has passed an examination administered or approved by the board respecting the use of therapeutic medications.

(2) Notwithstanding subsection (1), where an optometrist com- pleted the requirements of paragraph (1)(

a) or (

b) before January 1, 2000, the optometrist shall complete a refresher course approved by the board in the administration of therapeutic medicines as a condition of receiving a certificate.

(3) An optometrist who holds a therapeutic drug certificate may administer and prescribe the follo wing pharmaceutical agents for the diagnosis and treatment of ocular anterior segment disorders: (

c) topical local ophthalmic anaesthetics; (

f) topical ophthalmic an ti-infective medications. 4. An optometrist who meets the qualifications in

section 3 for a therapeutic drug certificate may remove superficial foreign bodies from the human eye and surrounding tissue. 5. The board may suspend or revok e a diagnostic or therapeutic drug certificate where the member fails to maintain standards which may be set by the board. 6.

(1) Where an optometrist pres cribes or administers pharmaceu- tical agents without the appropriate certificate or prescribes or adminis- ters pharmaceutical agents not author ized by the certificate he or she holds, that action shall be considered conduct deserving of sanction for the purposes of

Part IV of the Optometry Act, 2004.

(2) Where an optometrist removes superficial foreign bodies from a human eye or surrounding tissue in violation of

section 4, that action shall be considered conduct deserving of sanction for the pur- poses of

PART I LICENSING 2.

(1) An applicant for a licence to practise optometry shall (

a) complete an application in the form provided by the board; (

b) submit (

i) satisfactory proof of graduation in a course in optometry from the School of Optometry, University of Waterloo or Universite de Montreal or another Canadian school of optometry approved by the board, (ii) satisfactory proof of graduation in a course in optometry from another school of optometry considered by the board, at the time of graduation and application, to be comparable to the standards of the institutions referred to in subparagraph (i), or (iii) satisfactory proof that (

A) he or she is or was engaged in the practice of op- tometry in another jurisdiction and is in good stand- ing with the licensing body in that jurisdiction, and (

B) satisfactory proof of graduation in a course in op- tometry from a school of optometry considered by the board, at the time of graduation and application, to be comparable to the standards of the institutions referred to in subparagraph (i); (

c) submit evidence satisfactory to the board that the applicant has not been convicted of professional misconduct in a juris-

d) submit evidence satisfactory to the board that there are no current proceedings against th e applicant for professional misconduct in a jurisdiction where the applicant is or was engaged in the practice of optometry; (

e) submit evidence satisfactory to the board that he or she is a Canadian citizen, holds an employment visa or has perma- nent resident status under the Immigration Act (Canada); (

f) successfully complete the ex aminations set or approved by the board; (

g) pay any fees set by the board; and (

h) submit evidence that he or she carries professional liability insurance satisfactory to the board.

(2) An applicant for renewal of a licence to practise optometry shall (

a) meet the requirements in su bsection (1) that the board speci- fies; (

b) provide proof of active pract ise of optometry in the preced- ing year or other evidence of ability to resume active prac- tise that the board approves; and (

c) participate in a program of continuing education when re- quired to by the board. 3.

(1) An applicant who meets the requirements of the Act and

section 2 shall be entitled to receive a licence to practise optometry and to be registered in the Newfoundland and Labrador Optometric Regis- ter.

(2) A licence to practise optometry shall be in the form provided by the board. 4. An applicant for a licence to pr actise optometry shall be permit- ted to write qualifying examinations if he or she has License to practise Qualifying exami- nations

a) filed with the registrar a completed application provided by the board; (

b) paid to the registrar the non-refundable application fees and examination fees set by the board at least 60 days before the commencement of the examinations; and (

c) provided proof satisfactory to the board of graduation in a course in optometry from a school of optometry considered by the board at the time of graduation and application to be comparable in its standards to the schools referred to in sub- paragraph 2(1)(b)(i).

PART II DISCIPLINE 5. An allegation shall be filed with the registrar under

Part IV of the Act within 2 years from the date on which the event which gave rise to the allegation last occurred. 6. An investigation conducted under subsection 27(1) of the Act shall be completed and a report de livered to the ch airperson of the complaints authorization committee within 6 months from the date the allegation was filed with the registrar. 7.

The complaints authorization committee shall consider an alle- gation and either dismiss the allegation under subsection 27(2) of the Act or take the appropriate action under subsection 27(3) of the Act within 30 days after receiving the re port of the investigation conducted under subsection 27(1) of the Act. 8. The registrar shall complete an investigation of the respondent's practice under subparagraph 3(c)(ii) of the Act within 30 days after the board approves the investigation. 9. The chairperson of the disciplinary panel shall appoint an adju- dication tribunal under

section 28 of the Act within 30 days after re- ceipt of a referral by the registrar. 10. An adjudication tribunal shal l commence a hearing under sec- tion 29 of the Act within 30 days after the tribunal is appointed. section 32 of the Act within 30 days after completion of a hearing. 12.

(1) The registrar shall notify (

a) a respondent of an allegation against him or her within 7 days of receipt of the allegation in writing; and (

b) both the complainant and the re spondent of the referral of an allegation to the complaints authorization committee within 7 days of the referral.

(2) The complaints authorization committee shall notify the complainant and the respondent of the dismissal of an allegation by it within 7 days of the dismissal.

(3) An adjudication tribunal shal l provide a copy of a decision or order to the complainant and the respondent within 7 days of filing the decision with the registrar.

PART III VISUAL ACUITY CHECKING 13. A person employed by a practitioner as an assistant and acting under his or her direct supervision may check the visual acuity of a person. 14. In these regulations (a) "board" means the Newfoundland and Labrador Optometric Board; (b) "corporate licence" means a licence issued under

a) provide to the registrar a ce rtified copy of the articles of incorporation of the corporation to be registered; (

b) provide evidence satisfactory to the registrar that the corpo- ration meets the requirements of the Act and these regula- tions about corporate names; and (

c) pay the registration fee set by the board. 4.

(1) The name of a professional optometric corporation shall contain (

a) the surnames, or the surn ames and a combination of the given names or initials and professional designations, of one or more practitioners who hold voting shares in the corpora- tion or who are practising optometry as an employee of or on behalf of the corporation; and

b) the words "Optometry Corporation" or words with a similar meaning together with the names referenced in paragraph (

a) or together with words establishing a geographic location or area of practice.

(2) The name of a corporation shall not include information other than that permitted or required in subsection (1). 5. The registrar may refuse an a pplication for registration or to amend a corporation’s entry in the regi ster where, in the opinion of the registrar (

a) the name is inaccurate or may be misleading; (

b) the name expresses or implies superiority of qualifications, experience or education over that of another practitioners; or (

c) the name would tend to bring the optometric profession into disrepute or otherwise is objectionable in light of profes- sional standards of practice and ethics. 6. A professional optometric corporation registered and licensed in another jurisdiction may be registered in the corporat e register where the corporation establishes that (

a) the corporation is registered as an extra-provincial corpora- tion under the Corporations Act; and (

b) the corporation has complied with all other requirements for registration set out in an agreement entered into between the board and an optometric regulatory body, association or other body having responsibility for the registration and li- censing of professional optometric corporations in the other jurisdiction as provided for in subsection 17(4) of the Act. 7. An application by a corporation that has been registered in the corporate register for a license or renewal of a license to provide the service of an optometrist in the province shall be made to the registrar in the form set by the board. 8.

(1) Where a corporate license expires without renewal or is revoked under

a) enter on the corporate registry a memorandum with respect to the expiry or revocation of the licence; and (

b) notify the professional optome tric corporation, all licensed practitioners practising optometry as employees of or on be- half of the corporation, and other parties that the registrar considers appropriate, that the licence of the corporation has expired or has been revoked.

(2) Upon expiry of a corporat e licence without renewal, or the revocation of a licence under

section 19 of the Act, the registrar shall determine whether the corporation is entitled to apply for a new licence and may set conditions under which the licence shall be issued.

(3) A new licence shall not be issued unless an application for a corporate licence is made in accordan ce with the Act and these regula- tions and the registrar is satisfied that he corporation has complied with all the conditions applicable to the licence. 9.

(1) The fee for registration of a professional optometric corpora- tion shall be paid not later than the entry of the corporation in the cor- porate register.

(2) The fees for issuance and renewal of a corporate licence shall be paid not later than the issuance or renewal of the licence. 10. A professional optometric corporation is jointly liable for the payment of the annual licensing fee in respect of each practitioner hold- ing voting shares in the corporation and each practitioner practising optometry as an employee of or on behalf of the corporation. 11.

(1) A practitioner is not liable to pay an annual licensing fee for a year for which the corporation has paid his or her annual licensing fee.

(2) Where a practitioner paid an annual licensing fee before acquiring voting shares in a professional optometric corporation, or before practising optometry as an employee of or on behalf of the cor- poration, the corporation is not liable to pay the practitioner’s annual licensing fee for the year for which he or she has paid the fee. 12.

Professional Optometric Corporations Regulations 97/05 The Newfoundland and Labrador Gazette 641 October 7, 2005 for registration or a corporate license, or an application for renewal of a licence, in the form of notice of change approved by the registrar, within 15 days of the change, and shall pay the fee set by the board.

(2) Where a change includes a change in the name of a corpora- tion registered under the Act, the co rporation shall also file with the registrar a certified copy of the amended articles changing the corporate name.

(3) A corporation ceases to be eligible for registration on the corporate register and its corporat e licence may be revoked under sec- tion 19 of the Act if the corporation fails to provide the registrar with the notice of change described in subsection (1) within the required time. 13.

(1) Where the name of a corporation has been changed and the conditions set out in

section 12 have been met, the registrar shall regis- ter the new corporate name in the corporate register, where the corpora- tion satisfies the registrar that all the requirements set out under

section 4 have been met.

(2) Where a corporate name has been changed and the new name registered in the corporate regi stry, the registrar, on application by the corporation, shall issue a new corporate licence in the new cor- porate name provided that the corporation continues to meet the re- quirements for licensing in the Act and the regulations.

(3) A corporation shall provide the services of an optometrist under the name of the corporation as it appears on the corporate regis- ter. 14. All applications, notices and other documents submitted to the registrar on behalf of a professional optometric corporation shall be signed by all of the practitioners who are directors or shareholders of the corporation. 15. A professional optometric corporation shall (

a) maintain current financial records in accordance with gener- ally accepted accounting principles; (

c) maintain current patient records; (

d) maintain, in accordance w ith generally accepted business standards, records with respect to its employees; and (

e) maintain other records required under the Corporations Act. 16.

(1) The registrar shall maintain the corporate register required under

section 17 of the Act which shall contain the following: (

a) registration number; (

b) incorporation number; (

c) the date of (

i) incorporation, (ii) registration and re-registration, (iii) issuance of the original corporate license and each re- newal of it, and (iv) re-issuance of a corporate license; (

d) registered address of incorporation; (

e) date and reason for a corporation’s removal from the regis- ter; (

f) date and reason for a cance llation or suspension of a corpo- rate license; (

g) list of optometric offi ces of the corporation; (

h) list of directors of the corporation and information concern- ing the directors including (

i) name and residential address, (ii) registration number from the register, and (iii) date of registration on the register; Corporate register

i) list of all persons holding voting shares in the corporation and information with respect to each voting shareholder in- cluding (

i) name and residential address, (ii) the number and class of voting shares held by each per- son, (iii) the terms, conditions and restrictions applicable to the voting shares, and (iv) the shareholder’s registration number from the register and date of registration on the register; (

j) a list of all persons holding non-voting shares in the corpora- tion and information with resp ect to each non-voting share- holder including (

i) name and residential address, (ii) the number and class of non-voting shares held by each person, and (iii) the terms, conditions and restrictions applicable to the non-voting shares; (

k) information concerning the persons who will be practising optometry as employees of or on behalf of the corporation including (

i) name and residential address, (ii) registration number from the register, and (iii) date of registration on the register; and (

l) other particulars that may be directed by the board or as the registrar considers appropriate.

(2) All corporations registered under

section 17 of the Act shall be assigned a registration number of a composition and sequence to be determined by the board.

(1) A notice required to be given to a professional optometric corporation, or to a director, shareholder or employee of a corporation, under the Act or these regulations shall be given by personal service or by prepaid registered mail to the la st address filed with the registrar with an application for registration or a notice of change.

(2) Where notice of

section 19 the following: 19.1

(1) Notwithstanding subsection 19(1), where a returning officer or a deputy returning officer appointed under subsection 7(2) is of the opinion, due to circumstances beyond his or her control, that polling in one or more zones or parts of zones on polling day cannot continue or take place, the returning officer may direct that the election proceedings at polls in one or more zones or parts of zones be adjourned. (2) Where the election proceedin gs are adjourned under subsec- tion (1), the returning officer shall, in the manner that he or she consid- ers appropriate, give notice of that adjournment to the persons affected by it.

(3) Election proceedings may be adjourned under subsection (1) (

a) temporarily to another time on the same day or to another place and time on the same day as specified by the returning officer; or (

b) to another day, time or pl ace directed by the returning offi- cer.

(4) Where an election is adjourned to another day, time or place under paragraph (3) (b), the time shall be not later than 10 working days after the original date set for the election.

(5) While an election is adjourned, the returning officer shall make all reasonable effort to ensure that election materials are secured and that the integrity of the election is not compromised.

(6) Election proceedings that recommence after an adjournment shall continue for the time that, wh en added to the time preceding the adjournment, totals the time during which those election proceedings were to occur regardless of the adjournment.

(7) Where voting proceedings are adjourned, the counting of the vote shall not begin until the close of voting for the adjourned election proceeding.

(8) Notwithstanding subsection (4), where, in the opinion of the returning officer, it is not possible or practical to resume the election proceedings within 10 working days after the original date set for the election, the returning officer shall notify the minister who shall order that the adjourned election be carried out in the zone or part of a zone at a time, date and place specified by him or her and subsection (6) shall apply to that election. 2.
