An Act to Amend

An Act to Incorporate the Cosmetology Association of New Brunswick

WHEREAS the Cosmetology Association of New Bruns- wick wishes to make certain amendments to the Cosme- tology Act; and

WHEREAS the Cosmetology Association of New Bruns- wick prays that it be enacted as hereinafter set forth; THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: 1

Section 2 of

An Act to Incorporate the Cosmetology Association of New Brunswick,

chapter 48 of the Acts of New Brunswick, 1998, is repealed and the following is substituted: 2(1) The following

definitions apply in this Act, unless the context otherwise requires. “aesthetician” means a member who is licensed pursu- ant to this Act to carry out any of the following services: (

a) manicuring, pedicuring or artificial enhance- ments of the nails of a person; (

c) cleansing, exfoliating or beautifying of the body or the face of a person either by hand or by the use of any mechanical application or appliance or by the use of cosmetic preparations, creams, antiseptics, tonics, lotions, with artificial light or similar preparations or compounds on any person; (

d) any depilatory applications, including waxing, sugaring and tweezing, but excluding the use of laser and needles; and (

e) any other act prescribed by the by-laws. (esthé- ticien or esthéticienne) “Association” means the Cosmetology Association of New Brunswick. (Association) “Board of Directors” means the Board of Directors of the Association. (Conseil d’administration) “by-laws” means the by-laws of the Association. ( rè- glements administratifs) “certified cosmetologist instructor” means a member who has obtained the necessary qualifications as set out in the by-laws to provide instruction and education within a specified field of cosmetology. (instructeur agréé en cos- métologie or instructrice agréée en cosmétologie) “Committee” means the Provincial Examining and Li- censing Committee established pursuant to this Act. ( Co- mité) “cosmetologist” means a member who is licensed pur- suant to this Act to practise cosmetology. (cosmétologue) “cosmetology” means the work and services carried out by aestheticians, certified cosmetologist instructors, hairstylists, nail technicians, make-up artists, technical cutting stylists or specific cosmetologists. (cosmétologie) “hairstylist” means a member who is licensed pursuant to this Act to carry out any of the following services: (

a) cutting of the hair with scissors, razors, thinning shears, clippers, trimmers or other appliances; (

b) clipping, bleaching, coloring, tinting, dressing, drying, curling, waving or permanently waving, chem- ical texturing, straightening and chemical straighten- ing, cleansing, styling or the performance of similar work upon the hair of any person, either by hand or by the use of any thermal or mechanical application or ap- pliances; mis l’autorisant à fournir un ou plusieurs des services sui- vants :

e) le massage, pour relaxation seulement, du cuir chevelu, du cou et des épaules d’une personne;

f) tout autre acte prévu par règlement administratif. (hairstylist) « Comité » Le Comité provincial des examens et de l’accréditation établi en vertu de la présente loi. (Commit- tee) « Conseil d’administration » Le conseil d’administra- tion de l’Association. (Board of Directors) « cosmétologie »

c) preparation and application of wigs and artificial hair pieces; (

d) shampooing of the hair, conditioning of the hair, and performing of scalp treatments, on any person; (

e) massaging, for relaxation only, of the scalp, neck and shoulders, of a person; and (

f) any other act prescribed by the by-laws. ( coiffeur- styliste or coiffeuse-stylist) “licence” means a licence in good standing issued by the Association pursuant to this Act and the by-laws. (per- mis) “make-up artist” means a member who is licensed pur- suant to this Act to carry out any of the following services: (

a) beautifying of the face and neck of a person by applying make-up, either by hand or by the use of any mechanical application or appliance; and (

b) any other act prescribed by the by-laws. ( maquil- leur or maquilleuse) “member” means a person who is registered with the Association and who holds a valid licence, and for the purposes of disciplinary action or investigation under the Act or by-laws, includes a person whose membership has been suspended, revoked, expired or resigned. (membre) “nail technician” means a member who is licensed pur- suant to this Act to carry out any of the following services: (

a) manicuring, pedicuring or artificial enhance- ments of the nails of a person; (

b) massaging, for relaxation only, of the arms, legs, hand or feet of a person; (

c) cleansing or beautifying of the arms, legs, hands and feet of a person, either by hand or by the use of any mechanical application or appliance or by the use of cosmetic preparations, creams, artificial light or similar preparations or compounds on any person; and (

d) any other act prescribed by the by-laws. ( techni- cien de l’ongle or technicienne de l’ongle) “permit” means a permit to operate a salon or a school. (license d’exploitation) « esthéticien » ou « esthéticienne » Membre qui est ti- tulaire, sous le régime de la présente loi, d’un permis l’au- torisant à fournir un ou plusieurs des services suivants :

a) le manucure, le pédicurage ou la prothésie ongu- laire à l’intention d’une personne;

b) le massage pour relaxation seulement;

c) le nettoyage, l’exfoliation ou l’embellissement du corps ou du visage d’une personne, que ce soit à la main, à l’aide d’une application ou d’un appareil quel- conque ou encore à l’aide de préparations, crèmes, an- tiseptiques, toniques ou lotions cosmétiques, d’une lu- mière artificielle ou d’autres préparations ou produits semblables dispensés à une personne;

d) toute forme d’épilation, y compris à la cire, au sucre ou à la pince, mais à l’exclusion du laser ou de l’électrolyse;

e) tout autre acte prévu par règlement administratif. (aesthetician) « instructeur agréé en cosmétologie » ou « instructrice agréée en cosmétologie » Membre qui a obtenu les quali- fications nécessaires énoncées par règlement administratif pour dispenser un enseignement dans un domaine res- treint de la cosmétologie. (certified cosmetologist instruc- tor) « licence d’exploitation » Licence autorisant l’exploi- tation d’un salon ou d’une école. (permit) « maquilleur » ou « maquilleuse » Membre qui est titu- laire, sous le régime de la présente loi, d’un permis l’au- torisant à fournir un ou plusieurs des services suivants :

a) l’embellissement du visage et du cou d’une per- sonne par l’application d’un maquillage, que ce soit à la main ou à l’aide d’une application ou d’un appareil méca- niques;

b) tout autre acte prévu par règlement administratif. (make-up artist) « membre » Personne inscrite auprès de l’Association et titulaire d’un permis valide, y compris, pour l’applica- tion des mesures de discipline ou d’enquête régies par la présente loi ou les règlements administratifs, une per- sonne dont l’adhésion a été suspendue ou révoquée ou a expiré ou qui a démissionné. (member)

(bureau provincial) “Registrar” means the Registrar of the Association. (registraire) “salon” means a place of business at which cosmetol- ogy services are offered to the public for fee, gain or re- ward or at which a sign or advertisement is posted indicat- ing the offering of such services. (salon) “specific cosmetologist” means a member who holds a licence allowing only a defined scope of cosmetology practice, which defined scope may be prescribed by by- law. (cosmétologue à domaine restreint) “technical cutting stylist” means a member who is li- censed pursuant to this Act to carry out any of the follow- ing services: (

a) cutting of the hair with scissors, razors, thinning shears, clippers, trimmers, or other appliances; (

b) shampooing of the hair, conditioning of the hair, and performing of scalp treatments, on any person; (

c) massaging, for relaxation only, of the scalp, neck and shoulders, of a person; (

d) preparation and application of wigs and artificial hair pieces; (

e) drying, by the use of thermal applications or me- chanical device for styling the hair on any person; and (

f) any other act prescribed by the by-laws. ( styliste en coupe technique) « permis » Permis en règle délivré par l’Association sous le régime de la présente loi et des règlements admi- nistratifs. (licence) « registraire » Le registraire de l’Association. ( Regis- trar) « règlements administratifs » Les règlements adminis- tratifs de l’Association. (by-laws) « salon » Établissement où des services de cosmétolo- gie sont offerts au public à

titre onéreux ou dans l’attente de toucher une rétribution, ou qui porte une enseigne ou affiche une publicité indiquant que de tels services sont offerts. (salon) « styliste en coupe technique » Membre qui est titu- laire, sous le régime de la présente loi, d’un permis l’au- torisant à fournir un ou plusieurs des services suivants :

a) la coupe des cheveux aux ciseaux, au rasoir, aux ciseaux à effiler, à la tondeuse, au taille-cheveux ou à l’aide d’autres appareils;

b) le shampoing des cheveux d’une personne, l’appli- cation d’un après-shampoing aux cheveux d’une per- sonne et le traitement du cuir chevelu d’une personne;

c) le massage, pour relaxation seulement, du cuir chevelu, du cou et des épaules d’une personne;

d) la préparation et la mise en place de perruques et de postiches artificiels;

e) le séchage à l’aide d’applications thermiques ou d’un appareil mécanique en vue de la mise en forme des cheveux d’une personne;

f) tout autre acte prévu par règlement administratif. (technical cutting stylist) « technicien de l’ongle » ou « technicienne de l’ongle » Membre qui est titulaire, sous le régime de la présente loi, d’un permis l’autorisant à fournir un ou plusieurs des ser- vices suivants :

a) le manucure, le pédicurage ou la prothésie ongu- laire à l’intention d’une personne;

b) le massage, pour relaxation seulement, des bras, des jambes, des mains ou des pieds d’une personne;

An Act to Incorporate the Bill 44 Cosmetology Association of New Brunswick 2(2) For the purpose of this Act, a person practises cos- metology where that person engages in cosmetology for fee, gain or expectation of reward or remuneration. 2

Section 6 of the Act is repealed and the following is substituted: 6 A person may be granted a licence to practise cosme- tology in one or more of the following capacities: (

a) an aesthetician; (

b) a certified cosmetologist instructor; (

c) a hairstylist; (

d) a make-up artist; (

e) a nail technician; (

f) a specific cosmetologist; (

g) a technical cutting stylist; and (

h) any other licence category as prescribed by the by-laws. 3

Section 7 of the Act is repealed and the following is substituted. 7(1) Subject to subsection (2), no person shall practise cosmetology in any capacity or hold themselves out as be- ing entitled to practise cosmetology in any capacity unless that person is registered to practise cosmetology in that capacity under this Act or the by-laws. 7(2) Any person who is enrolled as a student at an ap- proved cosmetology school and who is duly registered as a student with the Association may perform the tasks, du-

d) tout autre acte prévu par règlement administratif. (nail technician) 2(2) Pour l’application de la présente loi, se trouve à pratiquer la cosmétologie toute personne qui se livre à cette activité à

titre onéreux ou dans l’attente de toucher une rétribution. 2 L’article 6 de la Loi est abrogé et remplacé par ce qui suit : 6 Un permis de pratiquer la cosmétologie peut être ob- tenu en une ou plusieurs des qualités suivantes :

a) esthéticien ou esthéticienne;

b) instructeur agréé en cosmétologie ou instructrice agréée en cosmétologie;

c) coiffeur-styliste ou coiffeuse-styliste;

d) maquilleur ou maquilleuse;

e) technicien de l’ongle ou technicienne de l’ongle;

f) cosmétologue à domaine restreint;

g) styliste en coupe technique;

h) toute autre qualité prévue par règlement adminis- tratif. 3 L’article 7 de la Loi est abrogé et remplacé par ce qui suit : 7(1)

Sous réserve du paragraphe (2), nul ne peut prati- quer la cosmétologie en quelque qualité que ce soit ou se présenter comme habilité à ce faire, à moins d’être inscrit à ce

titre sous le régime de la présente loi ou des règle- ments administratifs. 7(2)

Sous réserve des conditions ou limitations prévues par règlement administratif, toute personne inscrite à

titre d’étudiant ou d’étudiante dans une école de cosmétologie

6 Projet de loi 44 Loi modifiant la Loi constituant en société l’Association de cosmétologie du Nouveau-Brunswick ties and functions constituting part of the course of study, subject to any terms, conditions or limitations as may be prescribed by the by-laws. 4 Subsection 8(3) of the Act is repealed and the follow- ing is substituted: 8(3) All persons who operate a premise or establishment where cosmetology services are offered shall hold a valid salon permit which shall be subject to annual renewals and conditions as prescribed by the by-laws. 5 The Act is amended by adding after

section 8 the fol- lowing: 8.1(1) No person other than a licensed cosmetologist shall be entitled to use the title “cosmetologist”, or any words or letters indicative of such designation. 8.1(2) No person other than a licensed aesthetician shall be entitled to use the title “aesthetician”, or any words or letters indicative of such designation. 8.1(3) No person other than a licensed hairstylist shall be entitled to use the title “hairstylist” or “hairdresser”, or any words or letters indicative of such designations. 8.1(4) No person other than a licensed make-up artist and a licensed aesthetician shall be entitled to use the title “make-up artist”, or any words or letters indicative of such designation. 8.1(5) No person other than a licensed nail technician and a licensed aesthetician shall be entitled to use the title “nail technician”, or any words or letters indicative of such designation. 8.1(6) No person other than a licensed technical cutting stylist and a licensed hairstylist shall be entitled to use the title “technical cutting stylist”, or any words or letters in- dicative of such designation. 8.2(1) A member of the Association shall not be consid- ered a barber under the provisions of the Registered Bar- bers’ Act,

titre « esthéticien » ou « esthéticienne » ou des mots ou lettres évoquant cette dé- signation. 8.1(3) Seuls les coiffeurs-stylistes et coiffeuses-stylistes titulaires de permis ont le droit d’utiliser les titres « coif- feur-styliste », « coiffeuse-styliste », « coiffeur » ou « coiffeuse » ou des mots ou lettres évoquant cette dési- gnation. 8.1(4) Seuls les maquilleurs et maquilleuses titulaires de permis et les esthéticiens et esthéticiennes titulaires de permis ont le droit d’utiliser les titres « maquilleur » ou « maquilleuse » ou des mots ou lettres évoquant cette dé- signation. 8.1(5) Seuls les techniciens de l’ongle et techniciennes de l’ongle titulaires de permis et les esthéticiens et esthé- ticiennes titulaires de permis ont le droit d’utiliser les titres « technicien de l’ongle » ou « technicienne de l’ongle » ou des mots ou lettres évoquant cette désigna- tion. 8.1(6) Seuls les stylistes en coupe technique titulaires de permis et les coiffeurs-stylistes et coiffeuses-stylistes titu- laires de permis ont le droit d’utiliser le

titre « styliste en coupe technique » ou des mots ou lettres évoquant cette désignation. 8.2(1) Aucun membre de l’Association n’est barbier pour l’application de la

Loi sur les barbiers immatriculés,

chapitre 82 des Lois du Nouveau-Brunswick de 2007.

An Act to Incorporate the Bill 44 Cosmetology Association of New Brunswick 8.2(2) A member of the Association, while carrying on the trade or practice of cosmetology as defined under this Act, shall not be subject to the provisions of the Regis- tered Barbers’ Act,

chapter 82 of the Acts of New Bruns- wick, 2007. 6 Subsection 9(2) of the Act is repealed and the follow- ing is substituted: 9(2) The Board of Directors shall be composed of nine members, including officers, elected at large at the annual meeting. 7

Section 10 of the French version of the Act is amended by striking out “administrateurs” and substi- tuting “dirigeants”. 8

Section 14 of the Act is repealed. 9

Section 15 of the Act is repealed. 10 Paragraph 17(

g) of the Act is amended by adding “, amendment or revocation of the member’s licence or any permit” after “suspension”. 11 Subsection 25(1) of the Act is repealed and the fol- lowing is substituted: 25(1) All certificates or licences issued pursuant to this Act or the by-laws shall be posted and kept posted in a conspicuous place in the premises where the person named therein practises cosmetology. 12

Section 26 of the Act is repealed and the following is substituted: 26(1) Subject to subsection (2), the Committee may amend, suspend or revoke any licence or permit upon the passing of a resolution by the Committee declaring that the holder of a licence or permit is, in the opinion of the Committee, unfit to have a licence or permit by reason of (

a) failure or neglect to keep the person’s place of business in a clean and sanitary condition; (

b) failure to comply with regulations made pursuant to Provincial and Federal statutes which apply to main- taining a public place; 8.2(2) Aucun membre de l’Association n’est assujetti à la

chapitre 82 des Lois du Nouveau-Brunswick de 2007, pendant qu’il pratique le métier ou la profession de la cosmétologie au sens défini par la présente loi. 6 Le paragraphe 9(2) de la Loi est abrogé et remplacé par ce qui suit : 9(2) Le Conseil d’administration est composé de neuf membres, dirigeants compris, élus par l’ensemble des par- ticipants à l’assemblée annuelle. 7 L’article 10 de la version française de la Loi est mo- difié par la suppression de « administrateurs » et son remplacement par « dirigeants ». 8 L’article 14 de la Loi est abrogé. 9 L’article 15 de la Loi est abrogé. 10 L’alinéa 17g) de la Loi est modifié par l’adjonction de « , la modification ou la révocation du permis du membre ou d’une licence d’exploitation » après « sus- pension ». 11 Le paragraphe 25(1) de la Loi est abrogé et rem- placé par ce qui suit : 25(1) Tous les certificats ou permis délivrés sous le ré- gime de la présente loi ou des règlements administratifs doivent être affichés et rester affichés à un endroit bien en vue dans les locaux où la personne y nommée pratique la cosmétologie. 12 L’article 26 de la Loi est abrogé et remplacé par ce qui suit : 26(1)

Sous réserve du paragraphe (2), le Comité peut modifier, suspendre ou révoquer un permis ou une licence d’exploitation après avoir adopté une résolution déclarant que le titulaire du permis ou de la licence d’exploitation est, de l’avis du Comité, inapte à détenir un permis ou une licence d’exploitation pour l’un ou plusieurs des motifs suivants :

a) avoir omis ou négligé de garder son établissement dans un état propre et sanitaire;

b) avoir omis de se conformer à la réglementation provinciale et fédérale régissant l’exploitation d’un lieu public;

c) any violation of this Act or the by-laws; or (

d) failure to maintain the standards of the practice of cosmetology due to incompetence or incapacity. 26(2) Prior to a licence or permit being amended, sus- pended or revoked pursuant to subsection (1), the holder of a licence or permit shall be (

a) notified, in writing, by personal service or regis- tered mail, of the reasons for the amending, suspension or revocation; and (

b) permitted to make full answer and defence to all allegations made against that person and to have wit- nesses examined and cross examined by counsel on be- half of that person.

a) été avisé par écrit, par signification à personne ou par courrier recommandé, des motifs de la modifica- tion, de la suspension ou de la révocation;

b) eu l’occasion de répondre pleinement à toutes les allégations qui pèsent contre lui ou elle et de faire inter- roger et contre-interroger des témoins par son avocat.
