1971 THE NORTHEITN DEVELOPMENT ACT (Assented to , 1971) IJER MAJESTY, by and "\vith the advice and consent of 11 the Legislative Assembly of Albert~, enacts as follows: 1. In this Act, (a) "Commission" means The Northern Develcpnlent Commission constituted by th~s Act; (

b) HIVIinister" means the menlber of the Executive Council charged with the ad111inist.ration of this Act; (c) "Northern Development Region" nleans an area under the jurisdiction of the Conlnlission pursuant to

section 6. 2.

(1) There is hereby €stabl~shed a corporation with the name "The Northern Developnlent COll1mission" and consisting of (

a) the IVIinister, alld (

b) not more than 10 other nlembers to b2 appointed by the Lieutenant Governor in Council.

(2) An appointed 11lenlber of t11e Conlm;ssion holds office fora term of three years, unless his appointnlent is sooner terminated by the Lieutenant Governor in Council. (4) An ~ppointec1 menlber of the Conlmissiol1 \vho is not 'a nlenlber of the Executive Councilor an enlployee of the Governnlcnt nlay be paid such fees and a1lowances (

a) for attending nlectings of the COlllmission or any con1mittee thereof, and (

b) for pel'fol'n1ing r.c1c11tiona1 duties, as n1ay be prescribed by the Licuten2.nt Governor in Council.

(1) The l\finister is the chairman of the Conlmis sion. (2) \,There the Minister i? not the head of a d.epartmel~t of the public service, the LIeutenant Governor In CouncIl (

a) mav declare that the ~1inister is, with respect to this Act the head of a depart.nlent of the public service for the purposes of

section 10, subsection (3) ,and

section 55, subsection (1) of The Legis lative Assembly Act and

Part 2 of The lVLL.A. Pension Act, and (

b) notwithstanding the declaration, may prescribe the rate of 'annual conlpensation for the Ivlinister 'at a rate less than that prescribed in

section 55, subsection (1) of The Legislative Assenlbly Act for the head of a public department.

(3) Any compensation paid to the }Vlinister pursuant to subsection (2) shall be deenled for all purposes to be compensation paid to him pursuant to

section 55, subsec tion (1) of The Legislative Assembly Act. -4.

(1) The Lieutenant Governor in Council may desig nate one of the members of the Comnlission to be vice chairman thereof.

(2) If the l\Iinister is not the head of a department of the public service, the vice-cl1airnlan is the M:inister's deputy for the purposes of this Act. 5. (1) \Vith respect to the Northern Development Region (

a) the Comnlission 'has aU the po\vers, duties and functions conferred or inlposed on a county or the the council of a county, and (

b) the l\1inister has all the powers, duties and functions conferred or inlposed on the reeve of a county, except as otherwise provided by or under this Act.

(2) Except as othenvise provided by or under this Act, in any enactn1ent a refer'ence: 2 (

a) to a county, nlunicipality, improvement district or school division shall bedeenlcd to include a refer ence to the Region; (

b) to a county or municipal council or a board of trustees of a school c1idsion shall be deen1ed to include a reference to the Conlnlission; (

c) t.o the reeve of a county or chairn1an of the board of trustees of a school division shall be deelned to include a reference to the :Min~ster;

(

d) to the l\Iinister of lVlunicipal Affairs or the Dep~lty l\1inister of Municipal Affairs in relation to 1111- provement distl'~cts shall, with rcspe~t .to ,th~ i:n- provement distrIcts under the C0111nllSS10n s JUrIS diction be deemed to be a reference to the Conl missio~ 'and the vice~:cha'irman thereof, respec tively, anel not to the nanled lVIinister and deputy M'inister.

(3) The Lieutenant Governor in Council nlay by re¥,l~la tion make inapplicable the whole 01' part of any prOVlSIOn of The Countv Act, The School Act and The :Municipal Governm'ent Act 01' any other Act under which a county has powers or duties and thereupon that provision ceases to apply to the Commission, the Northern Developnlent Region and any person resident in the Region. 6.

(1) Subject ,to subseotion (2), the Commission has jurisdiction (

a) in school m'abters ~in the area heretofore constituted -as Northland School Division No. 61, and (

b) in municipal matters in the areas constituted as Improvement Districits Nun1bers 15 to 24 immedi ately before the coming into force of this Act.

(2) The Lieutenant Governor in Council may from time to time add or remove any area to or from the Northern Development Region e'ither in respect of school matters or municipal matters, or both. 7.

(1) There shall be established a Northern DeveloD ment Fund into which shall be paid the nloneys approp17i ated by the Legislature for that purpose each year, out vf whkh the Conlmission s'hall provide for the inve,Sltigation, planning, pr0111otion and co-ol'dination of nleasures to foster and advance social and econonlic development of Northern Alberta, and without linliting the generality of the fore going, nlay facilitate a.nd assist in the matters of: (

a) industrial development; (

b) transportation fac~lities; (c) 'agricultural improvenlent and diversification; (d) 1\letis so~ial and economic development ; (e) 'health, educational and soc'ial services; (

f) local acInlinistration.

(2) The Provincial Auditor shan fronl time to time and at least once in each year audit the books and accounts of the Northern Devclopnlent Fund. 3

(1) The assets and liabilities of the GoYel'nment in respect of Improvement Districts Numbers 15 to 24 are hereby vested in the Comn1ission.

(2) The Board of the Northland School Division No. 61 is ihereby dissolved and all the assets and liabilities of the Northland School Division No. 61 are hereby vested in the Commission.

(3) The Northern Alberta Development Council is hereby d'issolved and all the assets and liabilities of The Northern Alberta Development Council are hereby vested in the Con1mission. 9. This Act repeals and rep1aces (

a) Tne Northern Alberta Development Council Act, and (b). The Northland Sehool Division Act. 10. This Act comes into force on a day to be fixed by proclamation. Title: 1971 (16th, 4th) Bill 116, The Northern Development Act
