1 2015 BILL 11 Local Food Security Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows:

PART 1 PURPOSE AND

INTERPRETATION Purpose of Act 1 The purpose of this Act is (

a) to strengthen and ensure a sustainable local food economy in New Brunswick; (

b) to promote local food procurement in New Bruns- wick; (

c) to improve the health of New Brunswickers through increased availability of fresh local food; and (

d) to provide New Brunswick students with food, agriculture, and garden-based education in school.

Definitions 2 The following

definitions apply in this Act. “Council” means the Advisory Council on Local Food Security established under

d) à fournir aux élèves du Nouveau-Brunswick une éducation en matière d’alim entation, d’agriculture et de jardinage. Définitions 2 Les définitions qui suivent s’appliquent à la présente loi. « aliments biologiques loca ux » Aliments locaux qui satisfont aux Normes canadiennes de certification en agri- culture biologique. Loi sur la sécurité alimentaire locale “farm” means premises the whole or part of which are used for agricultural purpo ses and without limiting the generality of the foregoing, includes premises used for (

a) the production of plants for the purpose of the sale of such plants, or any part thereof; and (

b) the production, including breeding, rearing, or fattening of animals for the purposes of the sale of such animals, or any part thereof. (ferme) “food, agriculture, and garden-based education” means curriculum that conveys an understanding of local food systems by way of direct educational experiences, includ- ing local food tasting and sampling, participation in school gardens, composting pr ograms, food preparation, and farm tours. ( éducation en matière d’alimentation, d’agriculture et de jardinage) “healthy food education” means curriculum that con- veys an understanding of lo cal food systems, including food-related life skills, and the impact of food system practices and food choices on health, the environment, and the economy. a) food produced or harvested in New Brunswick, and (

b) subject to any limitation in the regulations, food and beverages made in New Brunswick if at least 80% of their ingredients were produced or harvested in New Brunswick. (aliments locaux) “local food assessment” means an assessment of local food systems that provides an inventory of food resources available at the community level, and an investigation into the scope of, barriers to, and opportunities for, local food production and distribution with the goal of increasing food availability. (système alimentaire local) “local organic food” means food that is local which meets the Canadian Organic Certification Standards. b) la production d’animaux, y compris leur reproduc- tion, leur élevage ou leur engraissement, en vue de la vente de tout ou

partie de ces animaux. (farm)

a) a department, secretariat or office of the Province of New Brunswick, includin g but not limited to those portions of the public service specified in

Part I of the First

Schedule of the Public Service Labour Relations Act; (

b) a government body, board, Crown corporation or commission listed under

Part IV of the First

Schedule of the Public Service Labour Relations Act; (

c) a regional health authority as defined in the Re- gional Health Authorities Act; (

d) a District Education Council established under the Education Act; (

e) an institution as defined in the Adult Education and Training Act; and (

f) a nursing home as defined in the Nursing Homes Act. (organisme public) “sustainable development” means development that meets the needs of the present, without compromising the ability of future generations to meet their own needs. (développement durable) “vulnerable populations” means persons who, because of age, sex, health, disability, socio-economic status, or other circumstance, whether temporary or permanent, (

a) are in a position of dependence on others; or (

b) are otherwise at a greater risk than the general population of being harmed by diet-related illness or environmental contamination of food sources, and in- cludes, without limiting the generality of the foregoing, pregnant women, infants, children, women, seniors, and individuals that are immuno-compromised. c) une régie régionale de la santé au sens de la

Loi sur les régies régionales de la santé;

d) un conseil d’éducation de district établi sous le ré- gime de la

Loi sur l’éducation;

e) un établissement au sens de la

Loi sur l’enseigne- ment et la formation destinés aux adultes;

f) un foyer de soins au sens de la

Loi sur les foyers de soins. (public body) « populations vulnérables » Personnes qui, en raison de circonstances temporaires ou permanentes, telles que leur âge, leur sexe, leur état de santé, leur incapacité ou leur condition socioéconomique, sont :

a) soit dans une position de dépendance par rapport à d’autres personnes;

b) soit plus exposées que la population en général aux risques de souffrir d’une maladie liée au régime ali- mentaire ou d’une contamination environnementale des sources alimentaires, s’agissant notamment des femmes enceintes, des bébés, des enfants, des femmes, des personnes âgées et des personnes qui ont moins de résistance immunitaire. (vulnerable populations) « système alimentaire loca l » Série d’activités et de processus liés à la production, à la transformation, à la dis- tribution et à la consommation des aliments locaux. PART 2 ADMINISTRATION Powers and duties of the Minister 3 In the administration of this Act, the Minister shall (

a) establish an interdepartmental committee to coor- dinate the establishment and implementation of a local food security strategy fo r New Brunswick, consisting of the Minister of Healthy and Inclusive Communities, the Minister of Health, the Minister of Education and Early Childhood Development, and the Minister re- sponsible for the Economic and Social Inclusion Cor- poration; (

b) advise the government on issues concerning local food systems; (

c) develop measures to achie ve the purposes of this Act, including, but not limite d to, establishing a strat- egy and targets; (

d) develop recommendations to advance the follow- ing food system goals: (

i) increased production, sales, and consumption of New Brunswick foods; (ii) development and promotion of programs that deliver healthy New Brunswick-grown and -processed foods to New Br unswick residents, in- cluding, but not limited to: (

A) increased public procurement of local prod- ucts; (

B) improvement in the availability of healthy New Brunswick-grown fo od products, particu- larly to low-income and vulnerable populations; (

C) food and agriculture-based education for students that stresses the connection between farming, food, and health; (

e) submit to the Legislative Assembly an annual re- port on the findings of the Minister regarding progress achieved, and progress expect ed, with respect to local food systems in the province;

PARTIE 2 APPLICATION DE LA LOI Attributions du ministre 3 En tant que responsable de l’application de la présente loi, le ministre :

a) établit un comité intermin istériel chargé de coor- donner l’établissement et la mise en œuvre d’une stra- tégie de sécurité alimentaire locale pour le Nouveau- Brunswick, comité formé du ministre des Communau- tés saines et inclusives, du ministre de la Santé, du mi- nistre de l’Éducation et du Développement de la petite enfance et du ministre responsable de la Société d’in- clusion économique et sociale;

b) conseille le gouvernemen t sur les enjeux relatifs aux systèmes alimentaires locaux;

c) élabore les mesures nécessai res pour la réalisation des objets de la présente loi et établit notamment une stratégie et des cibles;

d) élabore des recommandations visant la réalisation des objectifs suivants en matière de système alimen- taire : (

i) une augmentation de la production, de la vente et de la consommation d’aliments du Nouveau- Brunswick, (ii) l’élaboration et la promotion de programmes d’approvisionnement des résidents néo-brunswickois en aliments sains qui sont cultivés et transformés au Nouveau-Brunswick, visant notamment : (

A) un approvisionnement accru du public en produits locaux, (

B) un accès amélioré à des produits alimen- taires sains, cultivés au Nouveau-Brunswick, par- ticulièrement pour les populations à faible revenu et vulnérables, (

C) une éducation scolaire en matière d’alimen- tation et d’agriculture qui fait ressortir la connexion entre l’agriculture, l’alimentation et la santé;

e) dépose à l’Assemblée législative un rapport annuel sur les conclusions du ministre concernant les progrès accomplis et attendus relativement aux systèmes ali- mentaires locaux dans la province;

f) investigate and recommend standards relating to local food systems in the province; (

g) conduct studies and prep are statistics relating to local food systems in the province to ensure that an ad- equate information base is available for the purposes of developing and implementing targets, programs, and policies under this Act and the regulations. Agreements 4 The Minister may enter into agreements with such persons, entities, including the Council established under

section 5, as well as governments, as the Minister consid- ers appropriate for the purposes of this Act. Advisory Council on Local Food Security 5(1) The Minister shall establish an advisory body known as the Advisory Council on Local Food Security. 5(2) The members of the Coun cil shall be appointed by the Minister and shall consist of 14 individuals as follows: (

a) four individuals who are active farmers or who represent agricultural organizations; (

b) one individual representing sustainable or organic food farming; (

c) one individual representing urban and community supported agriculture, or community gardening; (

d) one individual representing immigrant and refu- gee farming; (

e) one individual representing food distribution; (

f) one individual representing food processing; (

g) one individual representing marketing interests; (

h) one health care provider , or one individual repre- senting a community-based co alition, addressing obe- sity and chronic disease;

Conseil consultatif de la sécurité alimentaire locale 5(1) Le ministre crée le Conseil consultatif de la sécu- rité alimentaire locale. 5(2) Le Conseil est composé de quatorze membres indi- viduels nommés par le ministre en fonction de la réparti- tion suivante :

a) quatre personnes qui travaillent activement en agriculture ou qui représentent des groupements agri- coles;

b) une personne qui représente le monde de l’agricul- ture durable ou biologique;

c) une personne qui représente le monde de l’agricul- ture urbaine soutenue par la communauté ou le jardi- nage communautaire;

d) une personne qui représente les agriculteurs immi- grants et réfugiés;

e) une personne qui représente le secteur de la distri- bution alimentaire;

f) une personne qui représente le secteur de la trans- formation des aliments;

g) une personne qui représente les intérêts des mar- chés;

h) un fournisseur de soins de santé qui s’occupe de l’obésité et des maladies chroniques, ou une personne qui représente une coalition communautaire qui s’oc- cupe de l’obésité et des maladies chroniques;

i) two individuals representing low-income or vul- nerable populations; and (

j) one individual representing a non-profit environ- ment organization. 5(3) The purposes and duties of the Council are to make recommendations to the Minister to advance the purposes of this Act. 5(4) The Council shall advise the Minister on all aspects of the local food economy in New Brunswick, including with respect to (

a) the development of the New Brunswick Local Food Security Strategy; (

b) a local food assessment; (

c) a survey of best practices and innovative local food system activities, incl uding an assessment of the capacity of New Brunswick to replicate these activities across the province; (

d) the identification of st rategies to increase local food access; (

e) increased collaboration and communication be- tween government departments and agencies; (

f) increased collaboration and communication be- tween provincial and local governments; and (

g) institutional procurement agreements and targets. 5(5) The Minister may, at the request of the Council, es- tablish one or more technical advisory committees to as- sist the Council in the performance of its duties under sub- sections (3) and (4).

PART 3 LOCAL FOOD SECURITY STRATEGY AND TARGETS Targets 6(1) Within 12 months of the coming into force of this Act, the Minister shall, to further the purposes of this Act and in consultation with the interdepartmental committee, the Council, and such other groups and individuals as the

b) l’évaluation de l’alimentation locale;

c) l’étude des meilleures pratiques et des activités in- novantes relatives au système alimentaire local, y com- pris l’évaluation de la capacité du Nouveau-Brunswick de reproduire ces activités partout dans la province;

d) la mise au point de stratégies visant à faciliter l’ac- cès aux aliments locaux;

e) une collaboration et des communications accrues entre les ministères et les organismes du gouverne- ment;

f) une collaboration et des communications accrues entre les gouvernements provinciaux et locaux;

g) des accords et des cibles institutionnelles d’appro- visionnement. 5(5) Le ministre peut, à la demande du Conseil, créer un ou plusieurs comités consultatifs techniques chargés d’as- sister le Conseil dans l’ex écution des fonctions prévues aux paragraphes (3) et (4).

PARTIE 3 STRATÉGIE DE SÉCURITÉ ALIMENTAIRE LOCALE ET CIBLES Cibles 6(1) Dans les douze mois suivant l’entrée en vigueur de la présente loi, le ministre, dans le but de favoriser la réa- lisation des objets de la pr ésente loi et en consultation avec le comité interministéri el, le Conseil et les autres

a) local food procurement; (

b) local food distribution; and (

c) local food education. 6(2) To achieve one or more purposes of this Act, the Minister shall, after undertaking the consultation outlined in subsection (1), establis h qualitative and quantitative targets relating to local food. Amendment of targets 6(3) The Minister may from time to time amend the tar- gets established under this

section after consultation in ac- cordance with subsection (1). New Brunswick Local Food Security Strategy 7(1) Within 18 months of the coming into force of this Act, the Minister shall, in consultation with the interde- partmental committee, the Council, and such other groups and individuals as the Minist er considers advisable, de- velop a New Brunswick Local Food Security Strategy. Contents 7(2) The New Brunswick Local Food Security Strategy shall include (

a) a vision for achieving the purposes of this Act, and (

b) the targets established under this Act and how those targets assist in ac hieving the purposes of this Act. Review 7(3) The New Brunswick Local Food Security Strategy shall be reviewed every 5 y ears and, where appropriate, amended to reflect new and improved targets and devel- opments in New Brunswick in respect of health, environ- mental protection, access and education in relation to lo- cal food. Five-year reporting 7(4) The Minister shall, afte r consulting with the inter- departmental committee, th e Council, and such other groups and individuals as the Minister considers advis- groupes et personnes qu’il juge utile de consulter, fixe des cibles relativement à ce qui suit :

Modification des cibles 6(3) Le ministre peut au besoin modifier les cibles qui ont été fixées en application du présent article, après consultation conformément au paragraphe (1).

Stratégie de sécurité alimentaire locale du Nouveau-Brunswick 7(1) Dans les dix-huit mois su ivant l’entrée en vigueur de la présente loi, le ministre, en consultation avec le co- mité interministériel, le Con seil et les autres groupes et personnes qu’il juge utile de consulter, élabore la Straté- gie de sécurité alimentaire locale du Nouveau-Brunswick. Contenu 7(2) À la Stratégie de sécu rité alimentaire locale du Nouveau-Brunswick sont intégrés :

a) une vision pour la réalisation des objets de la pré- sente loi;

b) les cibles fixées en application de la présente loi et une explication de la manière dont ces cibles contri- buent à la réalisation des objets de la présente loi. Révision 7(3) La Stratégie de sécurité alimentaire locale du Nouveau-Brunswick est révis ée tous les cinq ans et est modifiée, s’il y a lieu, pour tenir compte des nouvelles cibles et des nouveaux développements au Nouveau- Brunswick en matière de santé , de protection de l’envi- ronnement, d’accès et d’éducation relatifs aux aliments locaux.

Rapport quinquennal 7(4) Après avoir consulté le comité interministériel, le Conseil et les autres groupes et personnes qu’il a jugé utile de consulter, le ministre dépose à l’Assemblée législative,

Loi sur la sécurité alimentaire locale able, table a report with the Legislative Assembly on the New Brunswick Local Food Security Strategy every 5 years, with the first report to be tabled by December 31, 2020. Annual progress reports 7(5) Notwithstanding subsection (4), the Minister shall provide annual progress reports to the Legislative Assem- bly, with the first being due no later than December 31 of the year following the coming into force of this Act.

Contents of reports 7(6) The contents of report s referred to in subsections (4) and (5) shall include a description of actions taken to support the New Brunswick Local Food Security Strategy and progress made in achieving targets established under

section 6, and such other matters as the Minister considers advisable.

PART 4 LOCAL FOOD ASSESSMENT AND PROCUREMENT Local food assessment 8 Within 12 months of the coming into force of this Act, the Minister shall undertake a local food assessment that shall consist of an (

a) examination of a baseline for agricultural produc- tion output in New Brunswick, including data on (

i) the amount of food produced annually within New Brunswick, (ii) the amount of food that is purchased and con- sumed by New Brunswick residents and the extent to which the food produc ed in New Brunswick is processed, distributed, and marketed locally, and (iii) the amount of New Brunswick produced food that is purchased by public bodies, (

b) identification of barriers that limit the access of the food and farming sector to production, distribution, and consumer markets within New Brunswick. à partir du 31 décembre 2020, un rapport quinquennal sur la Stratégie de sécurité alim entaire locale du Nouveau- Brunswick. Contenu des rapports 7(6) Les rapports mentionnés aux paragraphes (4) et (5) contiennent en particulier, outre les matières jugées utiles par le ministre, une description des mesures prises en sou- tien à la Stratégie de sécurité alimentaire locale du Nou- veau-Brunswick et des progrès accomplis par rapport aux cibles fixées en application de l’article 6.

PARTIE 4 ÉV ALUATION DE L’ALIMENTATION LOCALE ET APPROVISIONNEMENT EN ALIMENTS LOCAUX Évaluation de l’alimentation locale 8 Dans les douze mois suivant l’entrée en vigueur de la présente loi, le ministre entreprend une évaluation de l’ali- mentation locale comportant :

a) un examen du rendement de base de la production agricole au Nouv eau-Brunswick, y compris des don- nées sur : (

i) la quantité d’aliments produits chaque année au Nouveau-Brunswick, (ii) la quantité d’aliments achetés et consommés par des résidents du Nouveau-Brunswick ainsi que l’ampleur de la transformation, de la distribution et de la mise en marché locales des aliments produits au Nouveau-Brunswick, (iii) la quantité d’aliments produits au Nouveau- Brunswick qui sont achetés par des organismes pu- blics;

b) les obstacles qui limitent l’accès du secteur de l’alimentation et de l’agricu lture à la production, à la distribution et aux marchés de consommation au Nouveau-Brunswick.

9 Local Food Security Act Bill 11 Local food procurement 9(1) The Minister shall direct public bodies to increase the percentage of their food budgets spent on local or local organic food, annually, until such local food procurements constitute a significant percen tage of their overall food budgets specified through relevant targets. 9(2) To meet the goals set fort h in this section, a public body contract for the purchase of food may give prefer- ence to an otherwise qualifie d bidder who provides local or local organic food, provided that the cost included in the bid is not more than 10% greater than the cost included in a bid that is not for loca l or local organic food where that food will enhance the secu rity of the local food sys- tem in New Brunswick and will contribute to the sustain- able development of New Brunswick.

Procurements subject to trade agreements 9(3) This

section does not apply to procurements that are contrary to national or international trade agreements to which New Brunswick is bound by agreement with Canada.

PART 5 LABELLING OF LOCALLY PRODUCED AND PROCESSED FOODS Labelling 10 The Minister shall establish a labelling system to identify food produced and processed in New Brunswick, in consultation with the Council.

PART 6 HEALTHY FOOD EDUCATION IN SCHOOLS Definition 11 In this Part, “ministers” means the Minister of Agri- culture, Aquaculture and Fisheries, the Minister of Educa- tion and Early Childhood Development, the Minister of Health, and the Minister of Healthy and Inclusive Com- munities. Food, agriculture, and garden-based education 12 The ministers shall promot e food, agriculture, and garden-based education in schools maintaining kindergar- ten, or any of grades one to 12, inclusive.

PARTIE 5 ÉTIQUETAGE DES ALIMENTS PRODUITS ET TRANSFORMÉS LOCALEMENT Étiquetage 10 Le ministre établit, en consultation avec le Conseil, un système d’étiquetage pour les aliments produits et transformés au Nouveau-Brunswick.

PARTIE 6 ÉDUCATION NUTRITIONNELLE DANS LES ÉCOLES Définition 11 Dans la présente partie, « ministres » s’entend du mi- nistre de l’Agriculture, de l’Aquaculture et des Pêches, du ministre de l’Éducation et du Développement de la petite enfance, du ministre de la Santé et du ministre des Com- munautés saines et inclusives. Loi sur la sécurité alimentaire locale Professional development for teachers and education staff 13(1) The ministers shall assist schools and District Ed- ucation Councils to incorpor ate food, agriculture, and garden-based education into their curriculum and to de- velop related programming for the professional develop- ment of teachers and education staff. Information 13(2) The ministers shall provide information to schools on how the policy on healthy food education will improve the implementation of curriculum guidelines and policies mandated by the Department of Education and Early Childhood Development.

Professional development 13(3) Professional development provided by the De- partment of Education and Early Childhood Development shall provide instruction to teachers and education staff on how to deliver healthy food education, including food, ag- riculture and garden-based le arning opportunities to stu- dents.

PART 7 OFFENCES AND PENALTIES Offences 14 Every public body that contravenes a direction is- sued under subsection 9(1) is guilty of an offence. Penalties 15(1) A public body that is guilty of an offence under

section 14 is liable, on conviction, (

a) in the case of a first conviction, to a fine of not more than $5,000 for each day or part of a day on which the offence occurs or continues, and (

b) in the case of a subsequent conviction, to a fine of not more than $10,000 for each day or part of a day on which the offence occurs or continues. Limitation 15(2) A proceeding under this

Perfectionnement professionnel 13(3) Le perfectionnement prof essionnel offert par le ministère de l’Éducation et du Développement de la petite enfance doit informer les en seignants et le personnel d’éducation sur la façon d’ enseigner l’éducation nutri- tionnelle tout en donnant la chance aux élèves d’acquérir des connaissances en matièr e d’alimentation, d’agricul- ture et de jardinage.

PARTIE 7 INFRACTIONS ET PEINES Infractions 14 Est coupable d’une infraction tout organisme public qui contrevient à une directive donnée en application du paragraphe 9(1). Peines 15(1) Un organisme public qui est déclaré coupable d’une infraction prévue à l’article 14 est passible :

a) la première fois, d’une amende maximale de 5 000 $ pour chaque jour ou

partie de jour pendant le- quel l’infraction est commise ou se poursuit;

b) en cas de récidive, d’une amende maximale de 10 000 $ pour chaque jour ou

partie de jour pendant le- quel l’infraction est commise ou se poursuit. Délai de prescription 15(2) Toute instance intentée sous le régime du présent

article se prescrit par un délai de deux ans à compter du plus récent des événements suivants :

a) the day on which the offence was committed; (

b) the day on which evidence of the offence first came to the attention of the Minister. Conflict 16 If there is a conflict between this Act or regulations and a provision of another Act, regulation, or municipal by-law dealing with local fo od, food education, organic food, food production, procurement, or distribution, the provision that is the most protective of human health or the environment prevails.

PART 8 REGULATIONS AND COMMENCEMENT Regulations 17 The Lieutenant-Governor in Council may make reg- ulations (

a) clarifying any

definitions included in

section 2; (

b) governing and clarifying any powers and duties of the Minister under

section 3; (

c) governing the terms of any agreements entered into pursuant to

section 4; (

d) governing the administration and operation of the Council under

section 5; (

e) governing the development of targets under sec- tion 6; (

f) governing the development of the strategy under

section 7; (

g) governing the development of local food assess- ments under

section 8; (

h) governing the direction, development and imple- mentation of local food procurement measures under

section 9; (

i) governing the developm ent and implementation of a labelling system for food produced and processed in New Brunswick under

section 10;

En cas de conflit entre la présente loi ou ses règle- ments d’application et une disposition d’une autre loi, d’un autre règlement ou d’un arrêté municipal relative à l’alimentation locale, à l’éducation nutritionnelle, aux ali- ments biologiques ou encore à la production, à l’approvi- sionnement ou à la distribu tion alimentaires, la disposi- tion qui offre la meilleure protection à la santé humaine ou à l’environnement l’emporte.

PARTIE 8 RÈGLEMENTS ET ENTRÉE EN VIGUEUR Règlements 17 Le lieutenant-gouverneur en conseil peut par règle- ment :

a) clarifier les définitions énumérées à l’article 2;

b) réglementer et clarifier les attributions du ministre prévues à l’article 3;

c) réglementer le contenu des accords prévus à l’ar- ticle 4;

d) réglementer la gestion et le fonctionnement du Conseil régi par l’article 5;

e) réglementer l’élaboration des cibles régies par l’ar- ticle 6;

f) réglementer l’élaboration de la stratégie prévue à l’article 7;

g) réglementer l’élaboration des évaluations de l’ali- mentation locale prévues à l’article 8;

h) réglementer l’imposition, l’élaboration et la mise en œuvre des mesures d’approvisionnement en ali- ments locaux prévues à l’article 9;

i) réglementer l’élaboration et la mise en œuvre du système d’étiquetage prévu à l’article 10 pour les ali- ments produits et transformés au Nouveau-Brunswick;

j) governing the developm ent of educational and professional development programs under sections 12 and 13; and (

k) respecting any other matter the Lieutenant- Governor in Council considers necessary or advisable for the purposes of this Act. Commencement 18 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
