EXPLANATORY NOTES

This Bill would amend the Natural Products Marketing Act to

give the Farm Industry Review

Board the power to hear and determine appeals in relation to the suspension or

cancellation of licences and permits;

give the minister the authority

to confer upon a commodity board the power to prescribe quality standards and

practices in relation to a regulated product; and

give the minister the authority

to confer upon a commodity board the power to impose penalties.

Be it enacted by the Lieutenant-Governor and

House of Assembly in Legislative Session convened, as follows:

1. Paragraph 9(1)(

n) of the Natural Products Marketing Act is amended by deleting the word "and"

at the end of subparagraph (iii) and adding immediately after that subparagraph

the following:

(iii.1) the suspension or revocation of licences and

permits, and

Section 12 of the Act is amended by adding

immediately after paragraph (

n) the following:

(n.1) prescribing quality standards and practices in

relation to a regulated product;

(n.2) respecting the imposition of penalties;

which the penalties referred to in paragraph (n.2) are payable, the amount of

the penalties, the method by which the penalties are calculated and the times at

which the penalties are payable;
