Statute: Crown Lands Act

OIC Text: The Governor in Council on the report and recommendation of the Minister of Economic and Rural Development and the Minister of Natural Resources dated March 15, 2010, and pursuant to

Section 16 of

Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to: (

a) authorize the Minister of Economic and Rural Development and the Minister of Natural Resources to enter into an Option to Purchase Crown land containing an area of approximately 505 hectares (1250 acres) situate in Melford, in the Municipality of the District of Guysborough, said land shown outlined in blue on the plan marked

Schedule "A", to Melford International Terminal Incorporated, a body corporate with its registered office in Halifax, Halifax Regional Municipality, its successors, trustees and permitted assigns, in a form substantially similar to the Option to Purchase attached as

Schedule "B", both Schedules attached to and forming part of the Report and Recommendation; (

b) approve, provided a report advising of milestone(

s) completion is submitted to the Executive Council of the Province of Nova Scotia prior to deed and/or grant issuance, the issuance of deeds and/or grants by the Minister of Natural Resources to Melford International Terminal Incorporated, a body corporate with its registered office in Halifax, Halifax Regional Municipality, its successors, trustees and permitted assigns for those areas of land qualifying for and meeting the terms and conditions of an Agreement of Purchase and Sale issued pursuant to said Option; and (

c) authorize the Minister of Economic and Rural Development and the Minister of Natural Resources to execute such documents as may be necessary to achieve the purposes of this Order.
