EXPLANATORY NOTE

This Bill would permit the province to participate in the program administered by the Minister of National Revenue for Canada permitting recovery of provincial and federal debts from income tax refunds and repayments.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

1. The Financial Administration Act is amended by adding immediately after

section 31 the following:

Recovery from refund or repayment

31.1 The minister may refer a debt due to the Crown or to a Crown agency to the Minister of National Revenue for Canada for recovery from the amount of a refund or repayment that may otherwise be made under

section 164 of the Income Tax Act (Canada) or under the Income Tax Act, 2000 .
