OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated January 3, 2002, and pursuant to Sections 4B and 4C of

Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act as amended by

Chapter 4 of the Acts of 2001, the Government Restructuring

(2001) Act and subsection 7(3) and clause 19(

f) of

Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the

Interpretation Act, is pleased, effective August 22, 2001, to: (a)create an office of the public service and designate its name to be the Sydney Tar Ponds Agency (NS); (b)appoint the Minister of Transportation and Public Works to preside over and have the supervision, direction and control of all affairs and matters relating to the Sydney Tar Ponds Agency (NS); (c)assign to the Sydney Tar Ponds Agency (NS) and its chief executive officer all affairs and matters relating to the Sydney Tar Ponds heretofore assigned to the Minister and Department of Transportation and Public Works except those matters referred to in clause (b); (

d) prescribe that the mandate and duties of the Sydney Tar Ponds Agency (NS) shall be as set out in

Schedule 1 attached to and forming part of the Report and Recommendation; (

e) prescribe that such other officers and employees required for the purposes of the Sydney Tar Ponds Agency (NS) shall be appointed or continue their appointments pursuant to the Civil Service Act and that Act applies to those employees; (

f) prescribe that prior to April 1, 2002, any expenses incurred by the Sydney Tar Ponds Agency (NS) shall be funded from the amounts appropriated for the Department of Transportation and Public Works; (

g) prescribe that the budget of the Sydney Tar Ponds Agency (NS) shall be a separate appropriation within the Public Service

section in the annual budget documentation, effective April 1, 2002; (

h) delete all references to the "Sydney Tar Ponds Clean Up Project" wherever they appear in Order in Council 2001-416 dated August 30, 2001 and substitute the words "Sydney Tar Ponds Agency (NS)".
