An Act Respecting the Real Property Tax on University Property Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: Assessment Act 1(1)

Section 1 of the Assessment Act,

chapter A-14 of the Revised Statutes, 1973, is amended by repealing paragraph (m.1) of the definition “resi- dential property” and substituting the following: (m.1) a school or university, but not including real property or a portion of real property that the Director determines is used for commercial pur- poses under paragraph 4(1)(l), 1(2) Subsection 4(1) of the Act is amended (

a) by striking out the period at the end of paragraph (

k) and substituting “; and”; (

b) by adding after paragraph (

k) the follow- ing: (

l) real property owned by a university funded under the Maritime Provinces Higher Education Commission Act and listed in

Loi sur l’évaluation 1(1) L’article 1 de la

Loi sur l’évaluation, chapi- tre A-14 des Lois révisées de 1973, est modifié par l’abrogation de l’alinéa m.1) de la définition « biens résidentiels » et son remplacement par ce qui suit : m.1) une école ou une université, à l’exclusion des biens réels ou d’une

partie des biens réels que le directeur détermine comme étant utilisés à des fins commerciales pour l’application de l’alinéa 4(1)l), 1(2) Le paragraphe 4(1) de la Loi est modifié

a) par la suppression du point à la fin de l’ali- néa

k) et son remplacement par un point- virgule;

b) par l’adjonction, après l’alinéa k), de ce qui suit :

l) les biens réels appartenant à une université qui est financée en vertu de la

Loi sur la Commis- sion de l’enseignement supérieur des provinces

Section 40 of the Act is amended (

a) in subsection (1) by adding after para- graph (e.41) the following: (e.42) prescribing for the purpose of the Direc- tor’s determination whether real property or any portion of real property is used for commercial purposes under paragraph 4(1)(l), the criteria to be taken into consideration by the Director when making the determination; (

b) by adding after subsection (1.21) the fol- lowing: 40(1.22) A regulation made under paragraph (1)(e.42) may be retroactive in its operation to Jan- uary 1, 2003, or to any date after January 1, 2003. 1(4) The Act is amended by adding after Sched- ule A the following:

chapter M-19 of the Revised Statutes, 1973, is amended in the definition “municipal tax base” (

a) in paragraph (

c) by striking out “and” at the end of the paragraph; (

b) by adding after paragraph (

c) the follow- ing: Maritimes et qui figure à l’annexe B, à l’exclu- sion des biens réels ou de toute

partie des biens réels que le directeur détermine comme étant uti- lisés à des fins commerciales conformément à tout critère qui peut être prescrit par règlement. 1(3) L’article 40 de la Loi est modifié

a) au paragraphe (1) par l’adjonction, après l’alinéa e.41), de ce qui suit : e.42) prescrivant les critères que le directeur doit considérer pour déterminer si des biens réels ou toute

partie des biens réels sont utilisés à des fins commerciales pour l’application de l’alinéa 4(1)l);

b) par l’adjonction, après le paragraphe (1.21), de ce qui suit : 40(1.22) Un règlement établi en vertu de l’alinéa (1)e.42) peut avoir un effet rétroactif au 1 er janvier 2003, ou à toute date ultérieure au 1er janvier 2003. 1(4) La Loi est modifiée par l’adjonction, après l’annexe A, de ce qui suit :

Loi sur l’aide aux municipalités 2(1) Le paragraphe 4(1) de la

Loi sur l’aide aux municipalités,

chapitre M-19 des Lois révisées de 1973, est modifié à la définition « assiette fiscale municipale »

a) à l’alinéa c), par la suppression de « et » à la fin de l’alinéa;

b) par l’adjonction, après l’alinéa c), de ce qui suit :

l) of the Assessment Act; and 2(2) The Act is amended by adding after

section 6 the following: 6.001 If the municipal tax base of a municipality under the Municipalities Act includes the assessed value of real property in the municipality that is ex- empt from taxation under paragraph 4(1)(

l) of the Assessment Act, the portion of the amount referred to in paragraph 6(

b) that is equal to the tax on such real property that would be due and owing to the municipality under subsection 5(2.001) of the Real Property Tax Act if the real property were not ex- empt from taxation under paragraph 4(1)(

l) of the Assessment Act shall be deemed to be a grant paid by the Minister to the municipality. Municipalities Act 3

Section 1 of the Municipalities Act,

chapter M-22 of the Revised Statutes, 1973, is amended in the definition “municipal tax base” (

a) in paragraph (

c) by striking out “and” at the end of the paragraph; (

b) by adding after paragraph (

c) the follow- ing: (c.1) the assessed value of real property in a municipality that is exempt from taxation under paragraph 4(1)(

l) of the Assessment Act; and Commencement 4(1) Subject to subsection (2), this Act shall be deemed to have come into force on January 1, 2003. 4(2) Subsection 2(2) of this Act comes into force on January 1, 2004. c.1) le montant de l’évaluation des biens réels dans une municipalité qui bénéficient d’une exo- nération en vertu de l’alinéa 4(1)

part visée à l’alinéa 6b) qui est égale à l’impôt sur ces biens réels qui serait dû et payable à la municipalité en application du paragra- phe 5(2.001) de la

Loi sur l’impôt foncier si ces biens réels ne bénéficiaient pas d’une exonération en vertu de l’alinéa 4(1)

l) de la

Loi sur l’évaluation est réputée être une subvention versée par le Minis- tre à la municipalité.

Loi sur les municipalités 3 L’article 1 de la

Sous réserve du paragraphe (2), la présente loi est réputée être entrée en vigueur le 1 er janvier 2003. 4(2) Le paragraphe 2(2) de la présente loi entre en vigueur le 1er janvier 2004.
