Statute: Agricultural Marshland Conservation Act

OIC Text: The Governor in Council on the report and recommendation of the Minister of Agriculture dated June 2, 2011, and pursuant to

Section 7 of

Chapter 22 of the Acts of 2000, the Agricultural Marshland Conservation Act, is pleased to: (

a) appoint James Bremner of Falmouth, Hants County, as Member and Chair of the Agricultural Marshland Conservation Commission for a term of three years commencing June 28, 2011; (

b) appoint Stephen Logan of Amherst, Cumberland County, as a Member of the Agricultural Marshland Conservation Commission for a term of two years commencing June 28, 2011; (

c) appoint Larry Hudson of Granville Ferry, Annapolis County, as a Member of the Agricultural Marshland Conservation Commission for a term of three years commencing June 28, 2011; (

d) appoint Bill Biggs of Wolfville, Kings County, as a Member of the Agricultural Marshland Conservation Commission for a term of two years commencing June 28, 2011; (

e) appoint Danny Phinney of Bridgetown, Annapolis County, as a Member of the Agricultural Marshland Conservation Commission for a term of three years commencing June 28, 2011; (

f) determine the rate of remuneration to be $125 per day plus expenses for the Chair and $100 per day plus expenses for Members, provided such reimbursements do not exceed those payable to a Member of the civil service; (

g) bind the Chair and Members, as a condition of appointment, by the principles and purposes of Values, Ethics and Conduct: A Code for Nova Scotia's Public Servants, the Conflict of Interest Policy and

Chapter 4 of the Statutes of Nova Scotia, 1991, the Members and Public Employees Disclosure Act; and (

h) order that the Province shall defend, negotiate, or settle claims or charges made against the Chair and Members of the Agricultural Marshland Conservation Commission and indemnify them from personal liability, provided the Province is satisfied that the claim arises out of activities in relation to their appointments and is not based on fraud or criminal activity and where the Province so defends them, the Province will be in control of the case.
